CHAPTER 1266

LI Limited Industrial District

1266.01 PURPOSE.

   The purpose of the Light Industrial District is to allow for the development of business uses associated with the processing or combining of raw products or materials.

1266.02 PERMITTED USES.

   (a)   Manufacturing.
   (b)   General offices and service businesses.
   (c)   Contracting and building trades businesses.
   (d)   Food processing, baking.
   (e)   Commercial laundry or dry cleaning.
   (f)   Molding, casting, fabricating.
   (g)   Printing, binding, publishing.
   (h)   Assemblage.
   (i)   Research and product development.
   (j)   Machine shops and metal working.
   (k)   Wood working shops.
   (l)   Warehousing, distribution and wholesaling.
   (m)   Moving, cartage, trucking, and storage.
   (n)   Building material yards.
   (o)   Heavy vehicle service and repair.
   (p)   Automotive repair, body shop.
   (q)   Places of incarceration.
   (r)   Veterinary hospitals, kennels.
   (s)   Crematory.
   (t)   Bottling or packaging facility.
   (u)   Public utility distribution facilities.
   (v)   Water towers, observation towers, transmission towers, flagpoles, television and radio antennas.
   (w)   Recycle transfer point.
   (x)   Recycle processing point.
   (y)   Scrap metal transfer facility.

1266.03 ACCESSORY USES.

   One sleeping unit attached to a permitted use.

1266.04 CONDITIONAL USES.

   (a)   Any other use that is determined by the Board, to be of the same general character as the above permitted uses, except for those uses first permitted in the GI District.
   (b)   Schools.
   (c)   Clinics and institutions for human care.
   (d)   Enlargement of an existing one-family dwelling.
   (e)   Medical marijuana cultivators as defined at OAC 3796:1-1-01(9) provided that such facility is in full and complete compliance with the requirements and restrictions of all applicable sections of the OAC and Ohio Revised Code as well as all applicable licensing and reporting requirements of the Codified Ordinances of the City of Newark, Ohio.
   (f)   Medical marijuana processors as defined at OAC 3796:1-1-01(39) provided that such facility is in full and complete compliance with the requirements and restrictions of all applicable sections of the OAC and Ohio Revised Code as well as all applicable licensing and reporting requirements of the Codified Ordinances of the City of Newark, Ohio.
   (g)   Adult use cultivators as defined at R.C. § 3780.01(A)(4) and 3780.01(A)(19) - (21) provided that such facility is in full and complete compliance with the requirements and restrictions of all applicable sections of the OAC and Ohio Revised Code as well as all applicable licensing and reporting requirements of the Codified Ordinances of the City of Newark, Ohio.
   (h)   Adult use processors as defined at R.C. § 3780.01(A)(7) provided that such facility is in full and complete compliance with the requirements and restrictions of all applicable sections of the OAC and the Ohio Revised Code as well as all applicable licensing and reporting requirements of the Codified Ordinances of the City of Newark, Ohio.

1266.05 ACCESSORY STRUCTURES.

   Accessory structures shall comply with Chapter 1274.

1266.06 DISTRICT STANDARDS.

   (a)   The floor area in this district is unlimited.
   (b)   The combined square footage of the footprint of all buildings and structures on a given lot shall not be more than thirty-five percent of the lot area exclusive of any lot area in the floodway.
   (c)   New construction, including additions, shall be reviewed by Planning Commission for compliance with the City's current Development Regulations. The items to be considered in determining compliance include, but are not limited to, the following: roadway improvements, access management or traffic congestion prevention, storm water management, floodplain management, public utility connections, FAA requirements and landscaping requirements.
   (d)   All uses in this district shall comply with the applicable requirements of Chapter 1296.
   (e)   No building customarily used for night operation shall have any opening, other than stationary windows or required fire exits, within 200 feet of any R-District, and any space used for loading or unloading commercial vehicles in connection with such an operation shall not be within 150 feet of any R-District.
   (f)   No residential uses shall be permitted in the LI District, except as accessory uses to a permitted use.
   (g)   All work shall be conducted inside a building or structure.
   (h)   No gaseous or liquid discharges, dust, ash, odors, noise, or vibration created from any process may be released into the environment.
   (i)   The industrial processes involved may not carry the risk of explosion, or create an explosive product.
   (j)   All outside storage of materials shall be screened from any adjacent R-District in accordance with Section 1290.03(a).
   (k)   When a recycle transfer point, recycle processing point and/or scrap metal transfer facility is proposed, the applicant shall, in addition to meeting other provisions of this Code, submit a site plan, which has been approved by the Planning Commission. The site plan shall delineate site specific criteria including: location and square footage of existing and proposed buildings; existing and proposed vehicular circulation including access drives, parking and loading areas; existing and proposed landscaping, buffering, and fencing; yard dimensions; and any other information requested by the Planning Commission.

1266.07 HEIGHT RESTRICTIONS.

   (a)   Within 200 feet of any R-District, no structure shall exceed three stories or 50 feet in height, and no structure otherwise shall exceed in height the distance measured to the centerline of any street.
   (b)   Water towers, observation towers, transmission towers, flagpoles, television and radio antennas shall not be limited in height.

1266.08 LOT AREA AND SETBACKS.1

   The following minimum requirements shall apply, except as provided in Chapters 1270 and 1271.

1266.09 OFF-STREET PARKING AND LOADING.

   Off-street parking and loading spaces shall be provided in accordance with Chapter 1290.

1266.10 CORNER LOTS.

   Corner lots shall meet the requirements of Section 1240.11.

1266.11 LANDSCAPING ,BUFFERING, GREEN SPACE.

   Landscaping, buffering, and green space shall be provided in accordance with Chapter 1292.

1266.12 PUBLIC AND PRIVATE ROADWAYS.

   (a)   Front yard setbacks from public and private roadways shall be modified in accordance with the thoroughfare maps maintained in the office of the City Engineer.
   (b)   Lots with no legal access to an adequate public right-of-way shall obtain approval from the Planning Commission for the proposed access prior to issuance of a zoning certificate. Approval of a lot split by the Planning Commission is evidence of an acceptable legal access.

1266.13 OTHER STANDARDS/REGULATIONS.

   Deed restrictions and covenants may establish additional restrictions.

1266.14 RESIDENTIAL USES.

   In this district, a one-family dwelling and related accessory structures on a single lot or parcel in existence at the time of the adoption of this Code may be repaired or altered in accordance with Chapters 1242, 1248, 1249, or 1251 as determined by the Zoning Inspector.

1266.15 PROHIBITED USES.

   Notwithstanding the provisions of Section 1266.02, Permitted Uses and Section 1266.04, Conditional Uses, the following listed uses shall be prohibited in the LI Limited Industrial District:
   (a)   Medical marijuana dispensaries as defined at OAC 3796:1-1-01(13) and adult use dispensaries as defined at R.C. § 3780.01(A)(S).
