ARTICLE XII

RECREATION/OPEN SPACE OS DISTRICT

Sec. 106-371.- Purpose of district.

The OS recreation/open space district is intended for outdoor sports and recreational activities in which the participants are actively engaged, but which may also provide entertainment for spectators but which activities are not of a commercial, profit-making nature. The activities for which the OS district is provided are normally and primarily conducted in the open air while related accessory uses may be in the open air or in a building or structure. The functional characteristics of an OS district may require its location within, or in close relationship to, residential areas, public recreational areas or scenic areas. Because of the nature of uses involved and the variety of arrangements of uses and facilities on the site plan of development, broad general regulations for plot size, yards, setbacks and height must be adequate for any location at which an OS district may be established.

Sec. 106-372. - Uses—Permitted.

No building or structure, or part thereof, shall be erected, altered or used, or land or water used, in the OS district in whole or in part, for other than one or more of the following specified uses:

(1)

Archery range.

(2)

Baseball driving range.

(3)

Boat dock.

(4)

Cabanas.

(5)

Fishing pier.

(6)

Golf course.

(7)

Golf driving range.

(8)

Group fishing boat dock, marinas.

(9)

Lawn bowling.

(10)

Open space, passive parks.

(11)

Tennis courts.

(12)

Other active and passive recreation facilities not specifically mentioned such as baseball and football fields, basketball courts, soccer fields, swimming pools, etc.

(13)

Uses and buildings accessory to and of the above uses not involving the conduct of any business, trade, occupation, or profession.

(14)

The following uses if first approved as a special exception use, see article IV of this chapter:

a.

Social, athletic, neighborhood or community club (nonprofit).

b.

Campgrounds, overnight and short-term.

c.

Other recreational uses.

d.

Excavation activity as an interim use prior to development for recreation purposes except that commercial ventures shall be permitted in city parks at the discretion of the governing body.

Sec. 106-373. - Same—Prohibited.

The permissible uses enumerated for the OS district in this article shall not be construed to include, either as a principal or accessory use, any of the following which are listed for emphasis:

(1)

Any business or commercial use not permitted as a principal use, except when meeting requirements of an accessory use.

(2)

Any industrial or manufacturing use.

(3)

Drive-in theater, drive-in restaurant or drive-in refreshment stand.

Sec. 106-374. - Height.

No building or structure, or part thereof, shall be erected or altered in the OS district to a height exceeding 50 feet.

Sec. 106-375. - Plot size.

Every plot in the OS district shall be not less than 100 feet in width and 10,000 square feet in area.

Sec. 106-376. - Yard setbacks.

(a)

No structure, except fences or walls, shall be located within 50 feet of any residentially zoned property nor within 75 feet of the right-of-way line of a trafficway as depicted on the county trafficways plan as amended from time to time, or within 25 feet of any other street right-of-way line.

(b)

No building or roofed portion of any structure shall be located within 25 feet of any plot line.

(c)

No required open space, yard or setback area shall be used or developed for any purpose other than by landscaping and by the minimum amount of walkways and/or driveways reasonably necessary to serve the permitted OS district uses.
