ARTICLE VIII

SINGLE-FAMILY RESIDENTIAL, RS-5 LOW-DENSITY DISTRICT

Sec. 106-271.- Purpose.

The RS-5 zoning district is established for low-density residential dwelling units. The regulations in this article shall apply to all RS-5 districts.

Sec. 106-272. - Uses permitted.

No building or structure, or part thereof, shall be erected, altered or used in the RS-5 district, in whole or in part, for other than one or more of the following specified uses:

(1)

Single-family detached dwellings.

(2)

Publicly owned recreation buildings and facilities, playgrounds, playfields and parks.

(3)

Uses accessory to any of the above uses not involving the conduct of any business, trade, occupation or profession.

(4)

All uses permitted in ROS district, if first permitted as a special exception use (see article IV of this chapter).

Sec. 106-273. - Lot area, floor area, lot width, lot coverage.

(a)

The minimum lot area, minimum floor area, minimum lot width and maximum lot coverage in the RS-5 district shall be as follows:

(b)

In areas subdivided prior to February 24, 1983, a plot consisting of a lot of record may be utilized for a one-family dwelling.

Sec. 106-274. - Height.

No building or structure, or part thereof, shall be erected in the RS-5 district to a height exceeding either two stories or 25 feet, except that a steeple or tower on a church may extend to a height of not more than 50 feet.

Sec. 106-275. - Density.

In all RS-5 districts, the density shall not exceed five dwelling units per gross acre.

Sec. 106-276. - Yard setbacks.

(a)

Front yard. The front yard setbacks in the RS-5 districts are as follows:

(1)

Residential and accessory uses. Every lot used for dwelling purposes shall have a front yard no less than 25 feet in depth from a public right-of-way.

(2)

Nonresidential uses. Every lot whose principal use is nonresidential shall have a front yard not less than 40 feet in depth from a public right-of-way.

(b)

Side yard. The side yard setbacks in the RS-5 districts are as follows:

(1)

Residential and accessory uses. Every lot used for a one-family dwelling shall have side yards each of which shall be at least ten percent of the lot width with minimum side yards of seven feet and maximum required side yards of 15 feet except where such side yard borders upon a canal or waterway maintenance right-of-way, in which case the water control district may require additional setback areas.

(2)

Nonresidential uses. Every lot whose principal use is nonresidential shall have a side yard on each side, no less than 20 feet in width, with an increase of one foot in width of each side yard for each two feet in height of the structure in excess of 20 feet, except where such side yard borders upon a canal or waterway maintenance right-of-way, in which case the water control district may require additional setback areas.

(c)

Corner plots. Upon corner lots in the RS-5 districts there shall be a front yard as specified in this section and also a side yard at least 20 feet in width on the side of the plot abutting the side street.

(d)

Rear yards. The rear yard setbacks in the RS-5 districts are as follows:

(1)

Residential uses. Every lot whose principal use is residential shall have a rear yard not less than 15 feet in depth, except where such rear yard borders upon a canal or waterway maintenance right-of-way, in which case the water control district may require additional setback areas.

(2)

Nonresidential uses. Every plot whose principal use is nonresidential shall have a rear yard not less than 25 feet in depth, except where such rear yard borders upon a canal or waterway maintenance right-of-way, in which case the water control district may require additional setback areas.
