The term "private swimming pool", when used in this chapter, shall mean a manmade, rigid or semirigid receptacle for water having a depth at any point greater than twenty four inches (24"), used or intended to be used for swimming, wading or bathing, and constructed, installed or maintained in or above the ground, and which is used exclusively by the owner or occupant of the lot or premises in the village on which it is located, his family and his guests. The term does not include inflatable receptacles or other swimming pools that are of a temporary nature. "Temporary nature" means those swimming pools that are typically removed on a seasonal basis. 10-17-2: PERMIT REQUIREMENTS:
A written application for a permit shall be accompanied by plans and specifications sufficiently detailed to enable determination of compliance with the requirements of this chapter. The fee for a permit to construct a private swimming pool shall be as provided in subsection 2-3-1A11 of this code. (Ord. 2010-09, 4-14-2010; amd. 2013 Code)
10-17-3: ACCESSORY STRUCTURE:
A private swimming pool shall be considered an accessory structure for the purpose of determining the side and rear yard requirements of this title. (Ord. 2010-09, 4-14-2010)
10-17-4: ENCLOSURE REQUIRED:
Every owner, purchaser under contract, lessee, tenant or licensee of a lot or premises located within the village upon which a private swimming pool is situated shall maintain at all times on such lot or premises a fence or other structure completely surrounding such pool, in accordance with the requirements of chapter 16 of this title. (Ord. 2010-09, 4-14-2010)
10-17-5: ENFORCEMENT:
The zoning enforcement officer is charged with the duty of enforcing the provisions of this chapter. For this purpose, the zoning enforcement officer is authorized to enter any premises within the village to inspect any private swimming pool at any reasonable time. (Ord. 2010-09, 4-14-2010)
