ARTICLE IX

ENVIRONMENTAL REGULATIONS

Sec. 24-116.- Minimum open space requirements.

Not less than twenty (20) percent of any residential, business or industrial district site shall be landscaped and pervious as defined in article XVIII, section 24-245. Some district regulations require a higher percentage; see article III, sections 24-30 through 24-53.

Sec. 24-117. - Natural resources overlay zone.

(A)

Land subject to special review. Figure 5 of the Oakland Park Future Land Use Element series (Ecological and Historical Resources) is hereby made a part of this chapter and the zoning map. Site plan reviews impacting any of the nineteen (19) natural resource sites shown thereon shall achieve maximum feasible preservation of these resource sites. Any adverse impact shall be offset by mitigation to be determined by conditions attached to the site plan approval.

Sec. 24-118. - Estuarine water quality.

(A)

Vegetation. Any development adjacent to the North Fork of the Middle River, the C-13 Canal or their tributaries shall retain or plant native vegetative ground cover for five (5) feet adjacent to the water body (except for boat dock access paths) to absorb and filter rainfall runoff. See Figure 3 of Future Land Use Element for canal system locations.

(B)

Drainage outfalls. No new stormwater outfalls shall be authorized to discharge directly into these water bodies shown on Figure 3 of the Future Land Use Element unless filtration devices acceptable to the permitting agencies are provided.

Regional permits. Before site plan approval, the applicant shall provide copies of all requisite permits from Broward County, the South Florida Water Management District and all other agencies having jurisdictional regulation.

Sec. 24-119. - On-site stormwater runoff.

The first one (1) inch of rainfall shall be retained on-site through the use of swales, trench drains, retention ponds and other techniques acceptable to the permitting agencies. Wherever possible, preference shall be given to natural or "green" water storage features including, but not limited to, bioswales, constructed wetlands, rain gardens, multi-use water retention features, and comparable.

Sec. 24-120. - Air pollution control.

(A)

Construction sites. During construction, cleared land not subject to active development shall be either mulched or regularly sprayed to minimize the blowing of dust. This includes unpaved vehicle use areas.

(B)

Processing uses. At the time of both site plan review and occupational licensing, industrial processing uses shall require approval by the Broward County Department of Natural Resource Protection to assure compliance with air pollution standards.

Sec. 24-121. - Wellfield protection.

Proposed uses within the area shown on Figure 2 of the city's Future Land Use Element shall be subject to review by the Broward County Department of Natural ResourceProtection under its wellfield protection regulations. This shall be enforced at both the time of site plan review and occupational license. See Broward County Ordinance 84-60 and Resolution 84-2025 (with amendments).

Sec. 24-122. - Tree preservation and replacement.

Tree preservation and replacement. All tree preservation and replacement within the City of Oakland Park shall conform to the adopted Landscape and Streetscape Design Standards, as amended from time to time.
