Sec. 66-351.- Establishment.

Pursuant to G.S. 160D-301 and 160D-307, there is created a planning board of the town, to perform the functions and duties prescribed in this article.

Sec. 66-352. - Membership, vacancies and attendance.

(a)

The planning board shall consist of seven members. Five members shall be citizens and residents of the town and shall be appointed by the town board of commissioners. Two members shall be citizens of the Brunswick County who reside outside of the town, but within the extraterritorial boundary and shall be appointed by the Brunswick County Board of Commissioners in the manner prescribed in G.S. 160D-307. The members of the planning board shall serve for terms of three years, such terms to be staggered as follows: no more than two members shall be scheduled for replacement due to the expiration of term in any one year and of the initial five board members appointed by the board of commissioners, two shall serve two-year terms and two shall be appointed to serve three-year terms and one shall be appointed to serve a one-year term.

Vacancies occurring for reasons other than expiration of term shall be filled as they occur for the unexpired remainder of the term.

(c)

Faithful attendance at meetings of the planning board shall be a prerequisite to continued membership. The board of commissioners may remove and replace any member who is absent from three meetings during a calendar year without being excused by the board of commissioners for reasons of sickness or emergency.

Sec. 66-353. - Meetings.

Regular meetings of the planning board are set by the board at such times and places as it deems appropriate. Law requires the regular meeting schedule be maintained on permanent file in the office of the town clerk. Changes in the schedule must be announced five days in advance of the meeting and placed on the door of the town hall as a notice to all citizens. The board shall hold at least one meeting monthly, and all of its meetings shall be open to the public. However, if there are no items for action by the planning board, the chairman may cancel a monthly meeting; and if necessary special meetings may be called by the chairman, with a five-day notice to be given.

Sec. 66-354. - Jurisdiction and voting.

There shall be a quorum present for the purpose of taking any official action.

Sec. 66-355. - Powers and duties.

It shall be the duty of the planning board, in general to:

(1)

Make studies of the area within its jurisdiction and surrounding areas.

(2)

Determine objectives to be sought in the development of the study area.

(3)

Prepare and adopt plans for achieving these objectives.

(4)

Develop and recommend policies, ordinances, administrative procedures and other means for carrying out plans the board of commissioners may direct.

(5)

Advise the commissioners concerning the use and amendment of means for carrying out plans.

(6)

Exercise any functions in the administration and enforcement of various means for carrying out plans the board of commissioners may direct.

(7)

Perform any other related duties the commissioners may direct.

(8)

Perform any specific task or duty designated by this chapter and any other code, ordinance or regulation enforced by the town.

Sec. 66-356. - Operation rules and regulations.

(a)

The planning board shall elect a chairperson, vice-chairperson and create and fill such offices as it may determine. The board of commissioners for the Town of Ocean Isle Beach shall appoint a person to serve as secretary for the planning board. The term of the chairperson and other officers shall be for a one-year period, with eligibility for re-election, and shall be elected at the June planning board meeting.

(b)

The board shall adopt bylaws and rules for transaction of its business and shall keep a record of its members' attendance and of its resolutions, discussions, findings and recommendations, which shall be a matter of public record and maintained by the town clerk.
