OFF-STREET PARKING REQUIREMENTS6

(a)
Purpose. The purpose of this section is to provide off-street parking standards that will alleviate congestion in the streets and allow for the efficient storage of motor vehicles while, concurrently, reducing any adverse environmental impacts to the urban area. By reducing glare, noise levels and air pollution to occupants and residents of adjoining properties, and by controlling stormwater drainage and soil erosion, these standards will generally contribute to the public health, safety and general welfare of the citizenry and will create a more aesthetically pleasing living environment in the Town of Ocean Isle Beach.
(b)
[Sufficient parking required.] All developments in all districts shall provide sufficient parking spaces to accommodate the number of vehicles that would ordinarily be attracted to the development in question. All land that will be used and dedicated for parking spaces must be in unified ownership with the structure that it serves. For the purpose of this section, unified ownership is defined as property owned by the same individual or corporation that owns the land being developed for which the parking plan has been designed. The developer shall provide a copy of the deed describing the properties' dimensions and if available, provide the town with a survey plat showing same. If the property proposed to be used as parking space is not owned by the developer, the developer must submit a lease between him and the lessor in a form that can be properly recorded, said lease properly describing the property and providing that the leased properties shall be used as parking perpetually. The requirements of this article set the minimum standards for parking requirements.

Unless otherwise defined in section 66-4, the following words and phrases shall have the meanings indicated when used in this article:
Gross floor area means the total area of a building measured by using the outside dimensions of the building at each floor level intended for occupancy or storage.
Maneuvering space means the space available in addition to the parking spaces for the purpose of the vehicle entering and leaving a parking space.
Parking space means the off-street space available for the parking of a vehicle. The minimum dimensions of the space shall be nine feet in width and 18 feet in length.

All applications for building permit shall include a parking plan to show conformity with this article. The plan shall show the layout of the parking facility, including number of spaces, size and location of spaces; arrangements of circulation aisles; locations of driveways; provisions for vehicular and pedestrian circulation; locations of sidewalks and curbs on or adjacent to the facility; barriers or wheel stops; interior, perimeter and street side landscaping (see section 66-640); locations, legend and details of signs; lighting standards; typical cross-section of pavement; storm drainage facilities; and other pertinent information necessary to indicate compliance with this section. Before any certificate of occupancy is issued for a commercial establishment, the approved parking plan shall be clearly laid out on the lot, whether pavement or gravel, using pavement markers, parking bumpers, etc.

(a)
[Distance from building or use.] Parking spaces shall be provided so that the parking lot serving the structure is a distance of no greater than 300 feet from the building or uses assigned to them unless otherwise granted a special use permit. A special application form will be used and supplied by the planning director which sets forth requirements one must meet.
(b)
Maneuvering. All parking and loading facilities shall be constructed so that all maneuvering will take place entirely within the property lines of the facility.
(c)
Barriers. Each parking space located at the perimeter of a parking facility shall be equipped with a curb, wheel stop, or similar device to prevent vehicle encroachment beyond property lines of parking lots and into pedestrian ways or traffic aisles.
(d)
[Compliance standards.] All new, enlarged or repainted parking facilities shall comply with the standards set forth within this article and the following:
(1)
A standard parking space shall have a minimum width of nine feet and a minimum length of 18 feet.
(2)
Parking spaces for small vehicles may be provided in lieu of standard parking spaces for residential, nonmedical office, and warehousing uses. However, no more than 25 percent of the total number of required parking spaces shall be small vehicle spaces. The minimum width of a small vehicle space shall be eight feet and its minimum length shall be 16 feet. Small vehicle parking spaces shall be designated by proper signage alerting drivers to the limitation of space size.
(3)
Spaces larger than the standard size are permitted, provided at least the minimum number of spaces required is furnished.
(4)
All nonresidential uses shall comply with the requirements of the North Carolina Building Code or General Statutes for off-street parking spaces for the handicapped, whichever is more stringent.
(5)
All parking facilities shall be paved with concrete or asphalt material, or with alternative paving material (e.g. concrete pavers, brick, "turfstone" or similar material) determined to exhibit equivalent wear-resistance and load-bearing characteristics as asphalt. Any parking areas within CAMA areas of environmental concern must comply with current CAMA regulations.
(e)
[Dual-use parking.] Required parking spaces may be assigned to another use in commercial zones contingent on nonconflicting operating times. Dual-use parking will be determined on a case-by-case basis. Minimum parking requirements for the primary business establishment must be met.
(f)
[Minimum required.] The number of off-street parking spaces may not be reduced below the minimum required for the building or uses assigned to them.
(g)
[Calculation of number of spaces.] When calculating the minimum required number of spaces, and the resulting number includes a fraction, any fraction less than ½ may be disregarded, while a fraction of ½ or greater shall be counted as one parking space.
(h)
Drainage. No stormwater drainage from a parking facility shall cross the surface of any adjoining public right-of-way to reach a stormwater drainage system.
(i)
[Ground level parking only.] All parking shall be located on the ground, and shall not be located in parking decks. "Ground level" shall be defined to mean on the actual ground and not above the surface of the ground.
