CHAPTER 10

INDUSTRIAL DISTRICTS

10-10A-1: INTENT:

The M-1 light industrial district is intended to establish and preserve areas for industrial and related uses of such a nature that they do not create serious problems of compatibility with other kinds of land uses, and to make provision for certain kinds of commercial uses which are necessary to service the immediate needs of people in these areas. 10-10A-2: PERMITTED PRINCIPAL USES AND STRUCTURES:

Animal pound or kennel.
Automobile body repair and paint shop.
Bottling works.
Building material sales and storage.
Contractor's shop and storage yard.
Dairy processing facility.
Farm implement sales, service, repair and assembly.
Freight terminal.
Frozen food lockers.
Grain elevator and feed mill.
High technology wholesaling and manufacturing to include electronics, medical and biogenetics, computers and software research, and related activities.
Personnel storage lockers and warehouses.
Railroads, railroad yards and public utilities.
Sheet metal products manufacture.
Truck or bus garage and repair shop.
Welding and blacksmith shop.
Wholesaling and warehousing but not including the bulk storage of liquid fertilizers or flammable liquids. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-10A-3: PERMITTED ACCESSORY USES AND STRUCTURES:

Uses and structures accessory to a principal permitted use or a conditional permitted use are permitted subject to the provisions of chapter 14 of this title. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-10A-4: SPECIAL EXCEPTIONS:

The following special exceptions are permitted in the M-1 district, subject to provisions of subsection 10-4-6D of this title which mandate that all special exceptions must be approved by the zoning board of adjustment:
   Carnivals, circuses, fairs, road shows.
   Communication towers subject to section 10-14-10 of this title.
   Concrete products and central mixing and proportioning plant.
   Stockyards and/or sales barns and yards. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994; amd. Ord. 2001-103, 9-11-2001)

10-10A-5: MINIMUM LOT AREA:

   A.   Area: Ten thousand (10,000) square feet.
   B.   Lot Of Record: A lot of record as of the effective date hereof that has less area or width than herein required may be used for any purpose permitted in this district, provided all other provisions of this title are met. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-10A-6: MINIMUM YARD REQUIREMENTS:

   A.   Yards:

   B.   Transitional yards:
      1.   Where a side or rear lot line coincides with a side or rear lot line in an adjacent residential or commercial district, a yard shall be provided along such side or rear lot line and such yard shall be at least equal in depth to that yard required in the abutting district.
      2.   Where a lot within the M-1 district fronts on a street which forms the boundary line between the M-1 district and a residential or commercial district, then such lot shall provide a front yard at least equal in depth to the front yard required in such abutting district. 10-10A-7: MINIMUM OFF STREET PARKING AND LOADING SPACE:

   A.   Parking:
 
Warehousing, storage and manufacturing
1 space for each employee on duty at any one time, plus 1 for each vehicle used by the industry
 
   B.   Off Street Loading: One space, fifty feet by twelve feet (50' x 12'), for each twenty thousand (20,000) square feet of floor area or fraction thereof.
   C.   Compliance With Americans With Disabilities Act: Where applicable, all parking and loading spaces shall comply with the Americans with disabilities act. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-10A-8: MAXIMUM HEIGHT:

Maximum height shall be four (4) stories or sixty feet (60'). (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-10B-1: INTENT:

The M-2 heavy industrial district is intended to establish and preserve areas for necessary industrial and related uses of such a nature that they require isolation from many other kinds of land uses, and to make provision for commercial uses which are necessary to service the immediate needs of people in their areas. 10-10B-2: PERMITTED PRINCIPAL USES AND STRUCTURES:

Asbestos, brick and clay products manufacture.
Bulk storage of petroleum products and commercial fertilizers.
Concrete products and central mixing and proportioning plant.
Flour, feed and grain milling storage.
Machinery manufacturer.
Paint and varnish manufacturer.
Sheet metal products manufacturer.
Structural iron and steel fabrication.

10-10B-4: SPECIAL EXCEPTIONS:

The following special exceptions are permitted in the M-2 district, subject to provisions of subsection 10-4-6D of this title which mandate the approval of all special exceptions by the zoning board of adjustment:
   Acid manufacturer.
   Carnivals, circuses, fairs, road shows.
   Communication towers subject to section 10-14-10 of this title.
   Explosive manufacturer or storage.
   Fertilizer manufacturer.
   Junkyards, including automobile wrecking and/or salvage.
   Materials recycling.
   Stockyards, slaughterhouses, poultry processing and packaging, and/or sale barns and yards. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-10B-5: MINIMUM LOT AREAS AND WIDTH:

10-10B-6: MINIMUM YARD REQUIREMENTS:

   A.   Yards:

   B.   Transitional yards:
      1.   Where a side or rear lot line coincides with a side or rear lot line in an adjacent residence or commercial district, or an existing residential use, a yard shall be provided along such side or rear lot line not less than forty five feet (45') in depth and shall contain landscaping and planting so designed and/or planted to provide an effective visual screen, when viewed horizontally, between two feet (2') and eight feet (8') above average ground level.
      2.   Where a lot within an M-2 district fronts on a street which forms a boundary line between the M-2 district and a residential or commercial district, or an existing residential use, then such lot shall have a front yard of not less than forty five feet (45') in depth. Parking shall not be permitted therein and such yard shall be appropriately landscaped with grass and/or other suitable plantings. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)
