CHAPTER 7

A-1 AGRICULTURAL DISTRICT

10-7-1: INTENT:

The A-1 agricultural district is intended to maintain and enhance agricultural operations and preserve agricultural lands utilized for crop production or the raising of livestock and to serve as a holding zone for lands where future urban expansion is possible, but not yet appropriate due to the lack of urban facilities and services. The preservation of agricultural land is intended to prevent urban sprawl, control the public costs of providing urban services and reduce urban/rural conflicts which arise as a result of premature development of rural areas. The district is further intended to preserve open space and natural resource areas. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-7-2: PERMITTED PRINCIPAL USES AND STRUCTURES:

Agriculture, horticulture, dairy farming, poultry farming, livestock farming, general farming, truck gardening, and other agricultural activities.
Parks, playgrounds, and recreation areas.
Single-family dwellings.
Those structures essential to farming operations not otherwise restricted within this title. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-7-3: PERMITTED ACCESSORY USES AND STRUCTURES:

Accessory uses or structures accessory to the provisions of chapter 14 of this title.
Farm buildings incidental to agricultural uses.
Private garages.
Private greenhouses or plant nurseries not operated for commercial purposes.

10-7-4: SPECIAL EXCEPTIONS:

The following special exceptions are permitted in the A-1 district subject to provisions of subsection 10-4-6D of this title which mandate the approval of all special exceptions by the zoning board of adjustment:
   Airports, meeting or exceeding the most current FAA standards and regulations.
   Dog kennels and dog runs.
   Greenhouses and plant nurseries operated for commercial purposes.
   Public utilities.
   Recreational development seasonal or temporary use.
   Roadside stand for sale of produce raised on the premises. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-7-5: MINIMUM LOT AREAS AND WIDTH:

   A.   Single-family dwelling:
      1.   Lot area: One acre.
      2.   Lot width: One hundred fifty feet (150').
   B.   Agricultural uses:
      1.   No minimum lot area.
      2.   All other uses permitted in this district:
         a.   Lot area: One acre.

10-7-6: MINIMUM YARD REQUIREMENTS:

A lot of record as of the effective date hereof that has less area or width than herein required may be used for any purpose permitted in this district, provided all other provisions of this title are met.

10-7-7: MAXIMUM HEIGHT:

Maximum height shall be two and one-half (21/2) stories or 37.5 feet. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-7-8: MINIMUM OFF STREET PARKING AND LOADING SPACE:

For residential dwellings, there shall be two (2) spaces for each dwelling unit. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-7-9: SPECIAL REGULATIONS:

   A.   Waste Disposal: Provision must be made for disposal of manure, other organic wastes, or chemicals in such a manner as to avoid pollution of groundwater or any lake, river, or receiving stream. Livestock confinement buildings for the purpose of raising hogs, poultry or cattle must conform to the provisions of subsection B of this section.
   B.   Restrictions For Certain Uses; Livestock: Agricultural uses are permitted with no restrictions as to the operation of such vehicles or machinery as are customarily incidental to such uses, and with no restrictions to the sale or marketing of products raised on the premises; provided, that any building, structure or yard for the raising, feeding, housing or sale of livestock or poultry shall be located at least three hundred feet (300') from residentially zoned land; and provided further, that there shall be no disposal of garbage, rubbish or offal, other than regular removal, within three hundred feet (300') of residentially or commercially zoned land. Pasturing of livestock shall be restricted to no closer than one hundred feet (100') of residentially or commercially zoned land.
   C.   Signs: All signage must meet the sign regulations described in chapter 12 of this title.
   D.   Feedlots Prohibited: Commercial feedlots are specifically prohibited in the A-1 district. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)
