CHAPTER 9

COMMERCIAL DISTRICTS

10-9A-1: INTENT:

The C-1 central business district commercial is intended to establish and preserve a central business district convenient and attractive for a wide range of retail uses and business, government and professional offices and places of amusement in a setting conducive to and safe for a high volume of pedestrian traffic. 10-9A-2: PERMITTED PRINCIPAL USES AND STRUCTURES:

Apartments; provided, that they are located on or above the second floor of the building in which they are located, (existing) funeral homes exempted.
Bakery and catering service.
Business and vocational schools.
Business offices, professional offices, studios.
Commercial amusements.
Financial institutions.
Laundries and dry cleaning establishments.
Medical and dental offices.
Personal service and repair shops.
Printing, publishing and engraving businesses.
Private clubs and lodges.
Public utilities.
Railroads and bus terminals.
Restaurants, taverns.
Retail business.
Temples, churches, and public buildings.

10-9A-3: PERMITTED ACCESSORY USES AND STRUCTURES:

Uses and structures accessory to a principal permitted use or a special exception use are permitted subject to the provisions of chapter 14 of this title. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-9A-4: SPECIAL EXCEPTIONS:

The following special exceptions are permitted in the C-1 district, subject to provisions of subsection 10-4-6D of this title which mandate that all special exceptions be approved by the zoning board of adjustment:
Automobile body repair, automobile service shops.
Bed and breakfasts.
Carnivals, circuses, fairs, or road shows. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-9A-5: MINIMUM LOT AREAS AND WIDTH:

No minimum. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-9A-6: MINIMUM YARD REQUIREMENTS:

   A.   Front: Zero feet (0').
   B.   Corner lot, street side: Zero feet (0'). (Ord. 1999-100, 6-8-1999)

10-9A-7: STRUCTURE HEIGHT:

   A.   Minimum: Height of shortest adjoining building(s).
   B.   Maximum: Three (3) stories or forty five feet (45'). (Ord. 1999-100, 6-8-1999)

10-9A-8: MINIMUM OFF STREET PARKING AND LOADING SPACE:

   A.   Off Street Loading: One space for each ten thousand (10,000) square feet of floor area or fraction thereof.
   B.   Compliance With Americans With Disabilities Act: Where applicable, all parking and loading spaces shall comply with the Americans with disabilities act. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-9A-9: BUILDING MATERIALS AND DESIGN:

   A.   Review Requirements Of Building Facade: Construction of any improvements or alteration of the principal structure's building facade shall require a design for windows, entrances, doors, rooflines, and facade heights and style to be similar to that brick structure constructed before 1930 which is located closest to said principal structure.
   B.   Commission Review And Council Approval: Construction of any improvement or alteration requires review by the planning and zoning commission and approval by the city council before issuance of a building permit. The permit applicant must submit drawings ten (10) days prior to the planning and zoning commission's meeting, showing the front elevation (view) which identifies building materials and dimensions. The planning and zoning commission must issue a review recommendation within forty five (45) days of receipt of the drawings.
   C.   Required Materials: Visible portions of the facade of all principal building(s) shall be constructed using one or more of the following materials: masonry finish or architectural metal, not including metal siding, on all nonfenestrated areas of wall(s). For purposes of this provision, "masonry" shall be defined as fired brick, stone, or similar such material, not including concrete blocks and undressed poured concrete. Masonry may include stuccolike material when used in combination with other masonry finish. Decorative moldings may also be used.
   D.   Windows: The visible portion of the facade shall be fenestrated (provided with windows) a minimum of the average fenestrated area(s) of adjoining building(s). Windows shall provide pedestrians with visual access into the first floor area. Exposed window material consisting of unpainted steel or aluminum shall not be permitted.
   E.   No Fee For Design Review: There is no fee charged for design review. (Ord. 1999-100, 6-8-1999)

10-9B-1: INTENT:

The C-1B peripheral business district commercial is intended to establish and preserve a business district convenient and attractive for a wide range of retail uses and business, government and professional offices and places of amusement in the city with ample accommodations for off street parking and setbacks reflecting requirements for neighboring residential areas. (Ord. 1995-95, 5-9-1995)

10-9B-2: PERMITTED PRINCIPAL USES AND STRUCTURES:

Apartments; provided, that they are located on or above the second floor of the building in which they are located.
Bakery and catering service.
Business and vocational schools.
Business offices, professional offices, studios.
Commercial amusements.
Financial institutions.
Laundries and dry cleaning establishments.
Medical and dental offices.
Personal service and repair shops.
Printing, publishing and engraving businesses.
Private clubs and lodges.
Public utilities.
Railroads and bus terminals.
Restaurants, taverns.
Retail business.
Temples, churches, and public buildings.

1 space for each 6 seats of average seating in the main auditorium

1 space for each 100 square feet of floor area
Furniture, appliance, hardware, building supplies
1 space for each 250 square feet of floor space
Motels and hotels
1 space for each unit or suite, plus 1 space for each 200 square feet of commercial floor area
Professional and business offices not listed elsewhere
1 space for each 250 square feet of floor area
Restaurants, private clubs, nightclubs, cafes, and taverns
1 space for each 100 square feet of floor area
Supermarkets, shopping centers, retail stores, and service establishments
1 space for each 150 square feet of floor area and outdoor sales space
Vehicle and farm implement sales, service, and repair establishments
1.5 parking spaces for each employee

10-9C-1: INTENT:

The C-2 highway commercial district is intended to establish and preserve general commercial areas consisting of shopping centers and commercial strips where customers reach individual business establishments primarily by automobile. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-9C-2: PERMITTED PRINCIPAL USES AND STRUCTURES:

Banks and financial institutions.
Bowling alleys, skating rinks, dance halls, theaters, places of amusement, golf driving ranges and miniature golf.
Building materials dealers.
Bus and railroad terminal.
Business offices.
Churches or temples.
Convenience stores.
Drive-in restaurants.
Farm implement displays and sales, service and repair.
Fruit, vegetable and produce stands.
Mobile and manufactured home sales.
Motels and hotels.
Motor vehicle sales, service and repair, service stations, and car washes.
Private clubs or lodges.
Restaurants, cafes, nightclubs and taverns.
Shopping centers or malls.

10-9C-3: PERMITTED ACCESSORY USES:

10-9C-4: SPECIAL EXCEPTIONS:

The following special exceptions are permitted in the C-2 district, subject to provisions of subsection 10-4-6D of this title which mandate that all special exceptions be approved by the zoning board of adjustment:
   Amusement parks.
   Carnivals, circuses, fairs, road shows.
   Communication towers subject to section 10-14-10 of this title.
   Feed mills and grain elevators.

10-9C-5: MINIMUM LOT AREAS AND WIDTH:

   A.   Minimum Lot Area: Ten thousand (10,000) square feet.
   B.   Minimum Width: None.
   C.   Lot Of Record: A lot of record as of the effective date hereof that has less area or width than herein required may be used for any purpose permitted in this district, provided all other provisions of this title are met. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-9C-6: MINIMUM YARD REQUIREMENTS:

   A.   Front: Twenty five feet (25').
   B.   Side: None except where abutting an agricultural or residential district, a side yard of not less than ten feet (10') shall be provided.
   C.   Rear: None except where abutting an agricultural or residential district, a rear yard of not less than thirty feet (30') shall be provided. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)

10-9C-7: MAXIMUM HEIGHT:

Maximum height shall be two and one-half (21/2) stories or 37.5 feet. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)
