Fences and hedges, when located within a front, side or rear yard, or within five feet (5') of a lot line, shall be subject to the following location and height restrictions:
A. Height: No portion of a fence shall exceed seven feet (7') in height. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)
B. Street Right Of Way: Fences and hedges shall be located so no part thereof is within two feet (2') of an alley or two feet (2') of a street right of way.
C. Front Yard: In any zoning district within the city, no fence exceeding four feet (4') in height shall be located within any portion of the front yard.
D. Permit Requirements: All fences shall be subject to the following permit requirements:
1. Application; Accompanying Documents: All applications for a fence permit shall be submitted to the administrative officer and must be accompanied by a sketch or design of the proposed fence, a plat showing the proposed location of the fence and a description of the materials of which the fence will be constructed.
2. Shared Lot Line: In the event the proposed fence will be constructed on a shared lot line, it is advisable that persons constructing a fence should inform adjoining neighbors of said plans.
E. Location; Maintenance: Fences and hedges shall be located entirely within the confines of the property. The owner of the property upon which the fence is constructed is required to maintain the fence or hedge. Posts and supports for the fence shall be located on the inside of the fence on the property on which the fence is constructed.
F. Snow Fences: A wooden snow fence or a plastic snow fence may be erected on a temporary basis, not to exceed six (6) months, to alleviate the adverse effects of drifting snow or warn and prevent access to an area by unauthorized persons. When erected on a temporary basis to prevent access of unauthorized persons to any area, wood snow fences or plastic snow/safety fences shall be removed within twenty four (24) hours after the elimination of the reason for which the fence was erected originally.
G. Construction In Workmanlike Manner: All fences shall be constructed in a workmanlike manner and shall be maintained and repaired as needed. (Ord. 97-99, 4-22-1997)
10-13-2: SWIMMING POOL REQUIREMENTS:
Fenced enclosures shall be provided for outdoor swimming pools with a depth of eighteen inches (18") or more, and shall be subject to the following requirements:
A. Height; Spaces: Fences must be at least four feet (4') in height from ground level but not to exceed seven feet (7') from the top rim of the pool, and have no spaces that would allow a four inch (4") diameter sphere to pass through.
B. Self-Closing, Self-Latching Devices: Fences must have a self-closing and self-latching device on the gate. (Ord. 1994-92, 6-14-1994, eff. 6-14-1994)
C. Location: Fences must be located so no part thereof is within two feet (2') of an alley or two feet (2') of a street right of way. (Ord. 97-99, 4-22-1997)
10-13-3: BARBED WIRE AND ELECTRIC FENCES:
Barbed wire and electric fences shall be subject to the following requirements:
A. Zone Restriction: Barbed wire and electric fences shall not be allowed in residential or commercial zones.
B. Location: Barbed wire and electric fences shall be prohibited within five feet (5') of a public sidewalk or within four feet (4') of a street right of way where a public sidewalk does not exist.
C. Livestock Operations: Electric fences shall not be permitted in any district except for the enclosure of livestock operations in an A-1 agricultural district.
D. Electric Charge: No electric fence shall carry a charge greater than twenty five (25) milliamperes nor a pulsating current longer than one-tenth (1/10) per second in a one second cycle.
