Sec. 14-50.- General standards for residential districts.

(a)

District regulations. Regulations governing the height, bulk, mass and placement of structures within all residential districts are provided in Table IV-1.

(b)

Accessory structures. Accessory structures, or private recreational facilities shall include, but not be limited to, sheds, unattached garages, tennis courts, and swimming pools. Accessory structures shall be regulated pursuant to article V. Accessory garage apartments shall be regulated pursuant to article V.

(c)

Outdoor storage in residential districts. Outdoor storage in residential districts for residential purposes shall be limited to domestic equipment and normal supplies necessary for residents. Storage shall not be permitted in any required or unrequired front setback, not in any required side setback. Storage shall be permitted in unrequired side setbacks when completely screened by a fence or landscaping.

(d)

Lots of record. Lots within each residential zoning district must contain the minimum area and width requirements; however, in the event a lot does not meet the area or width requirements of the district within which it is located, one (1) single family home shall be allowed as a permitted use.

(e)

Nonconformities. Nonconformities shall be regulated pursuant to article VI.

(f)

Parking. Parking shall be provided pursuant to article VIII.

(g)

Landscaping. Landscaping shall be provided pursuant to article IX.

(h)

Signs. Signs shall be regulated pursuant to article X.

(i)

Fences and walls. Fences and walls shall be regulated pursuant to article XI.

Sec. 14-51. - Single family residential, very low density (SF1) district.

(a)

Intent. The intent of the SF1 district is to promote the development of large lot, single family homes in areas where such development has occurred traditionally, or in areas where resource protection, promotion of aesthetics or limited public facilities and supporting services require the intensity of development to be limited.

(b)

Development standards.

(1)

Sec. 14-52. - Single family residential, low density (SF5) district.

Intent. The intent of the SF5 district is to promote the development of single family home neighborhoods on near-quarter acre lots in existing areas of similar development, and in areas in which a low intensity of development is desired for compatibility with surrounding uses and available public facilities and supporting services.

(b)

Intent. The intent of the SF7 district is to promote the development of high quality, affordable homes in a traditional neighborhood setting in areas with available public facilities and within close proximity to supporting services.

Sec. 14-54. - Single family residential, moderate density (SFMH) district.

(a)

Intent. The intent of the SFMH district is to promote the development of high quality, affordable housing in a variety of neighborhood settings that would consist primarily of either site built single family homes, manufactured homes, mobile home subdivisions, or mobile home and recreational vehicle parks. These neighborhoods are intended to be located in areas with available public facilities and within a close proximity to supporting services.

(b)

Development standards.

Sec. 14-55. - Single family residential, mixed use (SFMU) district.

(a)

Intent. The intent of the SFMU district is to promote the development of high quality single family homes while providing an opportunity for expanded home occupations, small offices, or service operations in existing areas of similar development or areas in which such uses are compatible with surrounding uses and available public facilities and supporting services.

(b)

Development standards for residential uses.

(1)

Minimum lot dimensions.

a.

Lot area: Fifteen thousand (15,000) square feet

(c)

Development standards for nonresidential uses. All nonresidential uses permitted in the SFMU district in accordance with article V shall meet the following minimum standards.

Minimum lot dimensions.

a.

Lot area: One-half (½) acre

b.

Lot width: One hundred (100) feet

(2)

Attachment to principal residential structure. All nonresidential uses, except uses which are customarily accessory to residential uses, shall be attached to the primary residential structure.

(3)

Maximum size. All nonresidential uses, except uses which are customarily accessory to residential uses, shall have a maximum enclosed square footage of eight hundred fifty (850) square feet or consist of no more than twenty (20) percent of the enclosed floor area of the principal residential structure, whichever is less.

(4)

Maximum number of nonresident employees. No more than three (3) nonresidents shall be employed on any site.

(5)

Additional standards. Sites with nonresidential uses shall meet all of the requirements listed in subsection (b) above.

(d)

Permitted uses. Uses permitted within this district are identified in article V.

(e)

Accessory uses. Accessory uses and accessory use regulations are identified in article V.

Sec. 14-56. - Multifamily residential, low density (MF12) district.

(a)

Intent. The intent of the MF12 district is to promote the development of low density, multifamily dwelling units in a high quality environment with high percentage of open space in areas with available public facilities and a close proximity to supporting services. The district is intended to include duplex, triplex and low intensity apartment and condominium developments.

(b)

Development standards.

(1)

Minimum lot dimensions.

a.

Lot area for one (1) or two (2) dwelling units: Seven thousand five hundred (7,500) square feet

b.

Lot area for three (3) or more dwelling units: Three thousand six hundred (3,600) square feet per unit, not to exceed twelve and one tenth (12.1) dwelling units per acre

c.

Lot width: Seventy (70) feet

Sec. 14-57. - Multifamily residential, medium density (MF18) district.

(a)

Intent. The intent of the MF18 district is to promote the development of affordable, medium density, multifamily dwelling units in a high quality environment with an appropriate amount of open space in areas with a high level of available public facilities that are within a close proximity to supporting services. The primary purpose of the district is to provide high quality, medium- to large-scale multifamily developments while maintaining affordability.

(b)

Development standards.

(1)

Minimum lot dimensions.

a.

Lot area for one (1) or two (2) dwelling units: Seven thousand five hundred (7,500) square feet

b.

Lot area for three (3) to six (6) dwelling units: Three thousand (3,000) square feet per unit

c.

For lot area of twenty thousand (20,000) square feet or more: Two thousand four hundred (2,400) square feet per unit, not to exceed 18.15 dwelling units per acre

d.

Lot width: Seventy (70) feet

Sec. 14-58. - General development standards for commercial districts.

(a)

District regulations. Regulations governing the height, bulk, mass, and placement of structures in all commercial districts are provided in Table IV-2.

(b)

Use restrictions. Use restrictions in the commercial districts are set forth in article V.

(c)

Nonconformities. Nonconformities shall be regulated pursuant to article VI.

(d)

Parking and loading. Parking and loading facilities shall be provided pursuant to article VIII.

(e)

Landscaping. Landscaping shall be provided pursuant to article IX.

(f)

Signs. Signs shall be regulated pursuant to article X.

(g)

Fences and walls. Fences and walls shall be constructed pursuant to article XI.

(h)

Installation of public utilities. All public utility service connections, including telephone, cable and electric distribution service, shall be installed underground on all sites of thirty thousand (30,000) square feet or more. In addition, all lots included within the site plan review overlay district (article XI) shall also install all utility service connections underground.

(i)

Sidewalks. Sidewalks shall be provided pursuant to article XIV.

(j)

It shall be unlawful for thrift shops or salvage shops to display merchandise outside on the street or curb frontage of any retail, sales, rental, commercial business in any zoning district in the city. All thrift stores and salvage shops shall comply with this requirement within sixty (60) days of the effective date of this ordinance.

Sec. 14-59. - Neighborhood commercial (NC) district.

(a)

Intent. The intent of the NC district is to promote the development of small size, low intensity commercial uses which provide limited goods and services for a particular geographic area of the city. The district is intended to be located in areas with available public facilities in a manner compatible with surrounding uses and in close proximity to those residential areas which are to be served.

(b)

Development standards.

Sec. 14-60. - General commercial (GC) district.

(a)

Intent. The intent of the GC district is to promote the development of commercial uses which provide a variety of basic goods and services for city residents. The district is intended to be located in areas with a high level of available public facilities in a manner compatible with surrounding uses.

(b)

Development standards.

(1)

Minimum lot dimensions.

a.

Lot area: Five thousand (5,000) square feet

Lot width: Fifty (50) feet

Sec. 14-61. - Commercial office residential and entertainment (CORE) district.

(a)

Intent. The CORE district is intended to be a clearly identifiable "downtown" or "central business district" for Pahokee. As such, the area is to serve as a focal point for a variety of local and regional activities including retail sales, personal and business services, public and private offices, and entertainment and residential opportunities. Further, the arrangement of structures, open space, landscaping and public plazas and parks are just as important as the uses to be located within the district. The district is intended to have a street-level focus and create an environment conducive to pedestrian activities. Finally, the incorporation of a consistent landscaping, signage, sidewalk and street design theme throughout the district is intended to be created to further delineate the boundaries of the district and emphasize its importance.

(b)

General development standards.

(1)

Underground placement of electrical, telephone and cable television lines. The following electrical, telephone, and cable television distribution lines shall be placed underground:

a.

Those which provide service directly to an individual lot or structure.

b.

Those electrical service lines which are less than twenty-three (23) kilovolts (KV) in capacity and located in an easement measuring at least two hundred (200) feet in length within one (1) unified lot, project or development.

(2)

Minimum sidewalk widths. Minimum sidewalk widths within the CORE district are established by Figure IV-1.

(3)

Sidewalk paving requirements. All sidewalks in the CORE district shall be paved with concrete or other equally durable impervious surface. Not less than twenty (20) percent of the surface area of any sidewalk required to be at least fifteen (15) feet wide shall be paved with brick or similar decorative materials approved pursuant to the applicable review process.

(4)

Street front tree planting. One (1) tree shall be planted for every twenty-five (25) feet of street frontage. Tree trunks shall not be placed closer than twenty-five (25) feet to street light standards. All tree planting areas located within sidewalks and paved plazas shall be accented around their periphery with brick or equivalent decorative materials approved pursuant to the applicable review process. Trees shall conform to the specifications of this chapter, but as a minimum trees required under this section shall be street trees of Florida Number 1 Grade or better as outlined in "Florida Grades and Standards for Nursery Plants, Parts I, II," State of Florida Department of Agriculture. Shade trees planted shall have a height of at least fifteen (15) feet; however, if palm trees are planted, a clear wood height of at least eight (8) feet is required.

Overhead weather protection.

a.

Overhead weather protection shall be incorporated into building walls facing street segments designated on Figure IV-I as requiring sidewalks of a minimum width of fifteen (15) feet. Overhead weather protection shall extend along the entire street frontage. Overhead weather protection shall extend along the entire street frontage. Overhead weather protection may be provided by awnings, building overhangs, arcades, or similar structures. Overhead weather protection shall be a minimum of five (5) feet in depth and shall be at a height that conforms with existing protective structures.

b.

Along street segments not designated on Figure IV-I as requiring sidewalks of a minimum width of fifteen (15) feet buildings shall provide either overhead weather protection along their entire street frontage or be designed so that such overhead weather protection can be added at a future date. Overhead weather protection may be provided by awnings, building overhangs, arcades or similar structures. Overhead weather protection shall be a minimum of five (5) feet in depth and shall be at a height that conforms with existing protective structures.

(6)

Planter screening for parking structure facades. Facades of parking structures shall incorporate planters providing a total one (1) square foot of planting area for each linear foot of facade per parking level. Planting areas may be arranged in a linear fashion or clustered at intervals. Planters shall be provided with permanent irrigation to permit watering of plant materials. Planters shall be planted pursuant to the provisions of this chapter.

(7)

Screening of building equipment. Building equipment shall be screened so that it cannot be seen from above or below. For the purposes of this section, building equipment shall include heat, ventilation and air conditioning equipment; radio, television and satellite reception devices; and other similar equipment. Required equipment screening shall be included as an integral element of the overall architectural design of a building or structure.

(8)

Roof coverings. Roof areas shall be finished in a manner to present an attractive appearance; tar, tar and gravel, or ballast shall not be utilized as finishing materials. Roof areas may be landscaped; however, landscaped areas shall be provided with automatic irrigation to permit watering of plant materials. Landscaped areas shall be planted in accordance with the provisions of this chapter.

(9)

Nonconformities. Nonconformities shall be regulated pursuant to article VI.

(10)

Parking and loading. Parking and loading facilities shall be provided pursuant to article VIII.

(11)

Landscaping. Landscaping shall be provided pursuant to article IX.

(12)

Signs. Signs shall be regulated pursuant to article X.

(13)

Fences and walls. Fences and walls shall be constructed pursuant to article XI.

(c)

Sec. 14-63. - Light industrial (LI) district.

(a)

Intent. The intent of the LI district is to promote the development of high quality warehousing, wholesale trade, research and development, and other industrial activities of a light nature in park type settings. The district is intended to be located in areas with a high level of available public facilities and in a manner compatible with surrounding uses.

(b)

Development standards.

The district is intended to be located in areas of a high level of available public facilities in a manner that reduces external impacts on surrounding and near-by uses.

(b)

Development standards.

District regulations. Regulations governing the height, bulk, mass, and placement of structures in the public facilities district are provided in Table IV-5.

Fences and walls. Fences and walls shall be constructed pursuant to article XI.

(i)

Installation of public utilities. All public utility service connections, including telephone, cable and electric distribution service, shall be installed underground on all sites of thirty thousand (30,000) square feet or more. In addition, all lots included within the site plan review overlay district (article XI) shall also install all utility service connections underground.

(j)

Sidewalks. Sidewalks shall be provided pursuant to article XI.

(k)

Intent. The intent of the WOR district is to promote the full development of the Lake Okeechobee shoreline in a manner consistent with federal, state and local goals and objectives for the resource.

District regulations. Regulations governing the height, bulk, mass, and placement of structures in the water oriented recreation district shall be governed pursuant to all applicable state and federal regulations.

(c)

Use restrictions. Use restrictions in the public facilities district are set forth in article V.
