§ 157.040 CREATION OF BOARD.

   A Planning and Zoning Board is hereby established which shall consist of five members who shall be appointed by the Town Council. In addition, the Town Council may appoint not more than two alternate members, designating them as such. Alternate members may attend complete Board meetings regardless of whether a quorum of regular members is seated. Alternate members may participate in Board deliberations and debate, but they may only make motions and vote in the absence of voting member or in the event of disqualification of a regular member or the vacancy in a regular member’s seat. The longer serving alternate member shall be given first priority in sitting in a member’s absence and voting.

§ 157.041 ORGANIZATION AND MEMBERS.

   (A)   The members of the Planning and Zoning Board shall elect one of its non-alternate members to serve as Chairperson and one as Vice-Chairperson. The term of the Chairperson and Vice-Chairperson shall be for a period of one year, provided, however, nothing shall prevent the Board from re-electing the same persons to succeed themselves.
   (B)   Each member or alternate member shall be a resident of the town and be a registered elector at the time of appointment and have resided in the town for at least six months immediately preceding appointment.
   (C)   Each member and each alternate member shall serve a term of two years. Any member or alternate member of the Board may be removed or suspended from office as provided in F.S. § 112.501 or § 112.51. Any vacancy occurring during the unexpired term of office of any member shall be filled by the Council for the remainder of the term.

§ 157.042 MEETINGS; RECORDS.

   (A)   The Planning and Zoning Board shall meet upon the call of the Chairperson, the Vice- Chairperson, the Town Mayor, the Town Clerk, or the town planner, or pursuant to a motion adopted at a meeting of the Board. The Board may hold regular, special or workshop meetings. The regular meeting dates of the Board shall be set by motion of a quorum of the Board and may be so changed. All meetings of the Board shall be open to the public. The time and place of meetings, and other order of business and procedures to be followed at meetings, shall be prescribed by the Board, and at a minimum will be governed by Robert’s Rules of Order.
   (B)   The presence at a meeting of three regular or alternate members of the Board shall constitute a quorum. The affirmative vote of a majority of the regular and sitting alternate members present and voting shall be necessary for the adoption of any motion.
   (C)   A written record of the proceedings of the Board shall be kept by the Town Clerk, showing its action on each question considered. The record shall be filed in the office of the Town Clerk and shall be open for public inspection during regular town business hours. The individual charged with the responsibility of maintaining Board records shall be the Board Secretary.

§ 157.043 AUTHORITY AND DUTIES OF THE PLANNING AND ZONING BOARD.

   The Planning and Zoning Board shall have the following authority and duties:
   (A)   To act in an advisory capacity to the Town Council on questions relating to zoning, comprehensive planning and land use, and to conduct investigations on matters of proposals to change zoning and land development regulations and to report its findings and recommendations on the proposals to the Council;
   (B)   Recommend to the Town Council the amendments to any land development code as the Board may deem to be necessary in the promotion of the public health, safety, welfare, economic order, or aesthetics or necessary to clarify or to carry into effect the purposes of the land development codes or the town’s comprehensive plan; and
   (C)   (1)   Hear applications and submit recommendations to the Town Council on the following:
         (a)   Proposed change of the permitted use of any specifically designate property;
         (b)   Applications for conditional use;
         (c)   Proposed amendment to the zoning or land development codes;
         (d)   Proposed subdivision plats and subdivision variances;
         (e)   Review annexation requests;
         (f)   Site plan review;
         (g)   Telecommunication tower requests for site plan and conditional use;
         (h)   Vested rights petitions; and
         (i)   Adoption of and amendments to the city’s comprehensive plan.
      (2)   In connection with any recommendation by the Planning and Zoning Board, the Board shall include any conditions, requirements or limitations which the Board may believe to be necessary or desirable to protect adjacent properties and the surrounding neighborhood, or to promote the public health, safety, welfare, economic order or aesthetics or environment.
