DISTRICTS GENERALLY

§ 157.165 INTERPRETATION OF DISTRICT BOUNDARIES.

   Where uncertainty exists as to the boundaries of districts as shown on the official zoning map, the following rules shall apply:
   (A)   Boundaries indicated as approximately following the centerlines of streets, highways or alleys shall be construed to follow the centerlines;
   (B)   Boundaries indicated as approximately following platted lot lines shall be construed as following the lot lines;
   (C)   Boundaries indicated as approximately following town limits shall be construed as following town limits;
   (D)   Boundaries indicated as following shorelines shall be construed to follow the high water mark and in the event of change in the shoreline shall be construed as moving within the high water mark; boundaries indicated as approximately following the centerlines of streams, rivers, canals, lakes or other bodies of water shall be construed to follow the centerlines;
   (E)   Boundaries indicated as parallel to or extensions of features indicated in divisions (A) through (D) above of this section shall be so construed. Distance not specifically indicated on the official zoning map shall be determined by the use of the scale shown on the zoning map;
   (F)   In cases where the actual location of physical features varies from those shown on the official zoning map or in other circumstances not covered by divisions (A) through (E) above, the Town Council shall interpret the district boundaries;
   (G)   Where a district boundary divides a lot that was in single ownership on July 14, 1975, the Town Council may permit, as a special exception, the extension of the regulations for either portion of the lot not to exceed 50 feet beyond the district line into the remaining portion of the lot;
   (H)   All areas within the corporate limits of the town that are under water and are not shown as included within any district shall be subject to all of the regulations of the district that immediately adjoins the water area. If the water area joins two or more districts, the boundaries of each district shall be construed to extend into the water area in a straight line until they meet the other district; and
   (I)   Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks.

§ 157.166 APPLICATION OF DISTRICT REGULATIONS.

   The regulations set by this chapter within each district shall be minimum regulations and shall apply uniformly to each class or kind of structure or land, except:
   (A)   No building, structure or land shall be used or occupied, and no building or structure shall be erected, constructed, reconstructed, moved or structurally altered unless in conformity with all of the regulations specified in §§ 157.165 through 157.389 for the district in which it is located;
   (B)   No building or other structure shall be erected or altered to exceed the heights, accommodate or house a greater number of families, occupy a greater percentage of yard area or have narrower or smaller rear yards, front yards, side yards or other open spaces than required in §§ 157.165 through 157.389 or in any manner contrary to the provisions of this chapter;
   (C)   No part of a yard or other open space required in connection with any building for the purpose of complying with this chapter, shall be included as part of a yard, open space or off-street parking or loading space similarly required for any other building;
   (D)   No yard or lot existing on July 14, 1975, shall be reduced in dimension or area below the minimum requirements set forth in this chapter. Yards or lots created after the effective date of this chapter shall meet the minimum requirements established by this chapter;
   (E)   Within each district, the regulations set by this chapter shall be minimum regulations and shall apply uniformly to each class or kind of structure, land or water; and
   (F)   Every building erected or structurally altered shall be on a lot adjacent to a public street, or with access to a public street.

§ 157.167 SCHEDULE OF DISTRICT REGULATIONS.

   (A)   For the purpose of classifying, regulating and restricting the location of trades and industries and the location of buildings designed for industry, business, residence and other uses, the town is divided into use districts and has set forth regulations in subsequent subchapters of this chapter.
      (1)   R-A Residential Agricultural;
      (2)   R-1AAA Single-Family Residential;
      (3)   R-1A Single-Family Residential;
      (4)   R-2 One-, Two- and Multiple-Family Residential;
      (5)   C-1 Neighborhood Commercial;
      (6)   C-2 General Commercial;
      (7)   C-P Commercial Parkway;
      (8)   M-1 Light Industrial;
      (9)   TR-1 Mobile Home Parks;
      (10)   TRC-1 Mobile Home Cooperative;
      (11)   TTP Travel Trailer Park; and
      (12)   Adult Entertainment.
   (B)   The use districts referred to in division (A) above of this section are designated upon the official zoning map and expressly made a part of this chapter. No building shall be erected, nor shall buildings or premises be used for any purpose other than a purpose permitted by this chapter in the use district in which the building or premises are located. The designation of use districts and uses by letter symbols when used throughout this chapter and upon the zoning map shall have the same effect as if the full description of the districts was stated.
