CERTIFICATE OF OCCUPANCY

§ 157.070 BUILDING PERMITS REQUIRED.

   (A)   No building or other structure shall be erected, moved, added to or structurally altered without a permit issued by the Building Official. No building permit shall be issued except in conformity with the provisions of this chapter, except after written order from the Board of Adjustment in the form of an administrative review, special exception or variance as provided by this chapter.
   (B)   The issuance of a permit upon plans and specifications shall not prevent the Building Official from thereafter requiring the correction of errors in the plans and specifications or preventing the building operations being carried on thereunder when in violation of this chapter or any town ordinance.

§ 157.071 APPLICATION FOR BUILDING PERMIT.

   All applications for building permits for any structure and its accessory buildings shall be accompanied by a scale drawing at a scale acceptable to the Building Official in duplicate showing the following:
   (A)   The actual dimensions and shape of the lot to be built upon, including the location and actual boundaries of abutting watercourses and water bodies;
   (B)   The exact sizes and locations on the lot of buildings already existing if any;
   (C)   The location and dimensions of the proposed buildings or alterations;
   (D)   The location and layout of the proposed sewage disposal system;
   (E)   When applicable, the required parking spaces, loading and unloading spaces, maneuvering space and openings for ingress and egress;
   (F)   When applicable, grading and drainage plans showing any and all cuts, fills and provisions for adequately carrying off surface water on premises plus provisions for any surface water that would naturally flow over or through the area, the plans to be reviewed and approved by the Town Engineer;
   (G)   Other information as lawfully may be required by the Building Official, including:
      (1)   Existing or proposed uses of the building and land;
      (2)   The number of families, housekeeping units or rental units the building is designed to accommodate;
      (3)   Conditions existing on the lot; and
      (4)   Other matters as may be necessary to determine conformance with and provide for the enforcement of this chapter.
   (H)   One copy of the plans shall be returned to the applicant by the Building Official after he or she shall have marked the copy either as approved or disapproved, attested by his or her signature on the copy. The original, similarly marked, shall be retained by the Building Official.

§ 157.072 CERTIFICATE OF OCCUPANCY REQUIRED.

   No land or building erected or altered in its use of structure shall be used until the Building Official shall have issued a certificate of occupancy stating that the land or building and its proposed use are found to be in conformity with the provisions of this chapter. Within three days after notification that a building or premises is ready for occupancy or use, it shall be the duty of the Building Official to make a final inspection and to issue a certificate of occupancy if the land or building and its proposed use are found to conform with the provisions of this chapter; or, if the certificate is refused, to state the refusal in writing with the cause. A temporary certificate of occupancy may be issued by the Building Official for a period not exceeding six months during alterations or partial occupancy of a building pending its completion, provided that the temporary certificate may require the conditions and safeguards as will protect the safety of the occupants and the public.

§ 157.073 EXPIRATION OF BUILDING PERMITS.

   If the work described in any building permit has not begun within 90 days from its date of issuance, the permit shall expire. If the work described in any building permit has not been substantially completed within two years of its issuance, the permit shall expire.

§ 157.074 CONSTRUCTION AND USE TO BE AS PROVIDED IN APPLICATIONS, PLANS, PERMITS AND CERTIFICATES OF OCCUPANCY.

   Building permits or certificates of occupancy issued on the basis of plans and applications approved by the Building Official authorize only the use, arrangement and construction. Use, arrangement or construction at variance with that authorized shall be deemed a violation of this chapter.

§ 157.075 SPECIAL INSPECTOR.

   Special inspector and shoring and reshoring requirements:
   (A)   Threshold buildings shall be inspected by a special inspector who shall be a registered architect or engineer who has qualified as same with the department of professional regulation;
   (B)   The duly authorized representatives of special inspectors shall have at least five years’ experience as a building inspector, builder, engineer, architect, or as a superintendent, foreperson or competent mechanic in charge of construction;
   (C)   Documented proof of the above qualifications and experience must be furnished to the local code enforcement agency for approval. The authorized representatives must sign daily inspection reports;
   (D)   A special inspector may also be a person certified or registered under the Building Officials’ Association of Florida, the Southern Building Code Congress, the Council of American Building Officials and Dade or Broward County Inspector of Certification; and
   (E)   All shoring and reshoring procedures, plans and details shall be prepared and sealed by a state registered engineer and a signed and sealed copy of all shoring documents shall be submitted to the architect, structural engineer, and the local code enforcement agency prior to issuance of permit. All shoring and reshoring installations shall be supervised, inspected, and certified to be in compliance with the shoring documents by the contractor. The same shall also be inspected by the special inspector.
