Home Occupations
Section 400.200 Definition.

As used herein, a home occupation shall mean an occupation, business, or profession carried on entirely within a dwelling unit by a person living in the dwelling unit, which is clearly incidental and secondary to the use of the dwelling unit for residential purposes, and which conforms to the following criteria:
A home occupation shall not change the outside appearance of the dwelling unit and shall not be visible from the street.
A home occupation shall not generate traffic, parking, electrical, sewerage or water use in excess of what is normal in the residential neighborhood.
A home occupation shall not create a hazard to person or property, result in electrical interference or become a nuisance.
A home occupation shall not result in the outside storage or display of any goods, supplies, materials or products connected with the home occupation, nor the storage or display of any such items in accessory buildings or garages, attached or detached.
No more than one home occupation shall be conducted within any dwelling unit.
A home occupation shall not include the employment of any persons not residing in the dwelling unit for residential purposes.
The home occupation, including storage in connection therewith, may occupy not more than twenty-five percent (25%) of the floor area and in no event more than five hundred (500) square feet of floor area. Floor area of a dwelling unit shall include the floor area of all heated and ventilated and thereby habitable rooms and areas within the dwelling unit, including basements and habitable attic space.
No machinery or equipment shall be utilized in connection with the home occupation which interferes with radio or television reception in the residential neighborhood.
A home occupation shall be compatible with residential uses and shall not detract from the residential character of the neighborhood.
There shall be no indication of the home occupation on the exterior or outside of the dwelling unit and premises, except for one sign no larger in area than two by three (2x3) feet.
A home occupation shall produce no noise, odors, vibrations, glare or fumes detectable to normal sensory perception beyond the confines of the subject dwelling unit.

Home occupations, as defined in Section 400.200, shall be permitted in the "R-1" Single and Two-Family District upon compliance with the provisions herein.
Section 400.220 Permit Required.

No dwelling unit shall be used for a home occupation, and no person shall conduct or engage in a home occupation without first obtaining a home occupation permit from the Zoning Enforcement Officer.
Section 400.230 Applications For Permit.

Application for a home occupation permit shall be made to the Zoning Enforcement Officer by a person residing at the dwelling unit on a form provided by the Zoning Enforcement Officer.
Section 400.240 Zoning Enforcement Officer's Determination.

The Zoning Enforcement Officer shall review the application and make reasonable inquiry necessary to determine whether or not the proposed home occupation is within the scope of the home occupation criteria.
Section 400.250 Denial or Revocation.

The Zoning Enforcement Officer may deny or revoke a home occupation permit for non-compliance with the criteria for a home occupation as set forth in Section 400.200. If the permit is revoked, said use of the dwelling unit for a home occupation shall be terminated.
Section 400.260 Non-Transferability.

A home occupation permit is not transferrable to another person or to another dwelling unit.
Section 400.270 Inspections.

An applicant for a home occupation permit shall allow such reasonable inspections of the dwelling unit as may be requested by the Zoning Enforcement Officer both before and after issuance of a permit to determine compliance with the criteria for a home occupation.

Any lawful use of a dwelling or property located within the "R-1" Single and Two-Family District for business, occupational or professional purposes existing on March 16, 1989 may be continued as a nonconforming use in accordance with Article X without obtaining the permit provided herein.
