CHAPTER 17
100 ADULT ENTERTAINMENT ESTABLISHMENTS
§ 17.100.010 Purpose.
It is the intent of this chapter to prevent community wide adverse economic impacts, increased crime, decreased property values, and the deterioration of neighborhoods which can be brought about by the concentration of adult entertainment establishments in close proximity to each other or proximity to other incompatible uses such as schools for minors, churches, and residentially zoned districts or uses. The City Council finds that it has been demonstrated in various communities that the concentration of adult entertainment establishments causes an increase in the number of transients in the area and an increase in crime, and in addition to the effects described above can cause other businesses and residents to move elsewhere. It is, therefore, the purpose of this chapter to establish reasonable and uniform regulations to prevent the concentration of adult entertainment establishments or their close proximity to incompatible uses, while permitting the location of adult entertainment establishments in certain areas as shown in Exhibit A attached to the ordinance codified in this chapter.

§ 17.100.020 Definitions.
A.
As used herein, the terms and phrases shall have the same meaning as defined in Section 5.24.020 of this Code.
B.
Establishment of an adult entertainment establishment. as used herein, to "establish" an adult entertainment establishment shall mean and include any of the following:
1.
The opening or commencement of any adult entertainment establishment as a new business;
2.
The conversion of an existing business, whether or not an adult entertainment establishment, to any adult entertainment establishment defined herein;
3.
The addition of any of the adult entertainment establishments defined herein to any other existing adult entertainment establishment; or
4.
The relocation of any such adult entertainment establishment.

§ 17.100.030 Minimum proximity requirements.
No adult entertainment establishment shall be established or located within certain distances of certain specified land uses or zones as set forth below:
A.
No such business shall be established or located within 1,000 feet of any other adult entertainment establishment.
B.
No such business shall be established or located within 1,000 feet from any existing residential zone or use, park, church, school.
C.
The distances set forth above shall be measured as a radius from the primary entrance of the adult entertainment establishment to the property lines of the property so zoned without regard to intervening structures.
