40 - ACCESSORY USES, YARDS AND FENCES10

17.40.010 - Accessory uses and structures.

A.

Compatibility. Accessory uses and structures shall be compatible with the principal use of the lot on which they are located and shall not be established prior to the establishment of the principal use. The keeping, preparation or culture of poultry, pigeons, or livestock shall not be an accessory use.

B.

Location. Accessory uses may be located in court yards and required yards only as provided in Table 19.

C.

Standards. All accessory uses shall conform to the standards in Table 20.

D.

Radio or Television Towers or Antennas. Radio or television towers or antennas as accessory uses shall not have an antenna height exceeding fifty-five feet, shall not be more than three feet from the principal building, and shall not be so positioned as to be a hazard to any utility line.

E.

Decks, Patios and Porches. Decks or patios that are enclosed by windows or screens and a permanent roof shall be considered as accessory structures rather than as part of the principal building. Such decks shall be subject to the requirements of Tables 19 and 20.

F.

Dog Runs. No more than one enclosed dog run as defined herein shall be permitted on any lot in a residential district. The fence enclosing the run shall be an open fence as defined herein; a maximum of eight feet in height and fifty feet in total perimeter length shall be located ten feet from all lot lines.

G.

Garages, Carports and Parking. Garage, carports, and open parking spaces as accessory uses shall be subject to applicable provisions under the off-street parking and loading section of the city ordinance of Park City.

17.40.020 - Yards—Obstructions.

Court yards and required yards may be obstructed by accessory uses or building projections only as provided in Section 17.40.040.

17.40.030 - Fences.

Requirements for fences shall be in conformance with Title 12, Section 12.08.120.

17.40.050 - Height and coverage regulations.

Maximum height in residential districts:

In feet: Seventeen or seventy-five percent of the maximum building height allowed in Section 17.20.030 of this code.

In stories*: One.

Maximum coverage of required rear yards (a): Thirty-five percent.

Minimum setback from any lot line in feet (b): Three.

Minimum setback from principal or other accessory building in feet (c): Ten.

* The term "story," as used in this section, is hereby defined as "the space in a building between two adjacent floor levels or between a floor and the roof."

(a)

Cumulative for all accessory structures in rear yard. Excludes areas occupied by open patios and decks and swimming pools. Percentage of coverage applies to area of actual rear yard when it is smaller than area of required rear yard.

(b)

Except fences, walls, landscape screens, berms, and hedges. Structures are subject also to the yard requirements of Table 19, which may impose greater setbacks from lot lines for certain structures.

(c)

Except enclosed decks and patios and accessory uses that are structurally a part of the principal building.

(d)

On residential lots in any residential district.

(e)

Limitation of maximum square feet of garages is seven hundred square feet for residential lots of less than .35 acres (thirteen thousand sixty-eight square feet).

(f)

Limitation of maximum square feet of garages is one thousand seven hundred square feet for residential lots between .35 acres (thirteen thousand sixty-eight square feet) and less than .5 acres (twenty-one thousand seven hundred eighty square feet).

(g)

Limitation of maximum square feet of garages is two thousand nine hundred fifty square feet for residential lots of .5 acres (twenty-one thousand seven hundred eighty square feet) and over.
