CHAPTER 17

08 - DISTRICTS—CLASSIFICATION AND BOUNDARIES

17.08.010 - Classification—Purpose—Designated.

A.

For the purpose of regulating and limited the use of land areas and buildings, and the erection, restoration and alteration of buildings, and the erection of additions thereto so as to secure adequate light, pure air, and safety from fire and other dangers, to conserve the taxable value of land and buildings throughout the city, to lessen or avoid congestion in the public streets, and otherwise promote the public health, safety, comfort, morals and welfare, the city is divided into eleven classes of districts, as shown on the zone district map which is made a part of the ordinance codified within this chapter.

B.

The use, height, volume and area regulations are uniform within each separate district and the districts shall be known as:

1.

R-1 low-density single-family residential district;

2.

R-2 medium-density single-family residential district;

3.

R-3 high density manufactured housing community residential district;

4.

R-4 low-density multiple-family residential district;

5.

R-5 high-density multiple-family residential district;

6.

C-1 convenience commercial district;

7.

C-2 neighborhood commercial district;

8.

C-3 community commercial district;

9.

C-4 downtown commercial district;

10.

C-5 highway commercial district;

11.

I industrial district.

17.08.020 - Zoning map.

The boundaries of these districts are shown upon the zoning district map, which accompanies and is made a part of the ordinance codified in this title. The zoning district map and all the notations, references and other matters shown thereon are a part of this title and have the same force and effect as if the zoning district map and all the other notations, references and other matters shown thereon were all fully set forth or described in this title, the original of which zoning district map is properly attested and is on file with the city clerk.

17.08.030 - Boundary rules.

Where uncertainty exists with respect to the boundaries of the various districts as shown on the zoning district map accompanying and made part of the ordinance codified in this title, the following rules shall apply:

A.

District boundaries are street lines, alleys, railroad rights-of-way or waterways, or lines which form the rear lot lines of adjacent and contiguous lots of a platted subdivision unless the dimensions of the district are indicated on the map.

B.

Where the district boundaries are not shown to be streets, alleys, railroad rights-of-way or waterways, and where the property has been, or may be held by one ownership and of record on the effective date of the ordinance from which this title is derived, is divided by a district boundary line, the entire lot shall be construed to be within the most restricted district; provided, that this construction shall not apply if it increases the more restricted frontage of the lot by more than twenty five feet.
