ARTICLE 10

- OFFICE DISTRICTS

10.1. - General Provisions.

The general regulations for the Office Districts are set forth in Article 3, General Regulations.

In addition, the provisions of the following overlay districts may apply to new development in both office districts: Riverfront District and Controlled Thoroughfare District.

Refer to the Official Zoning Map for the exact location of the Overlay Districts.

10.2. - O1 Arterial Office District.

10.2.a. Purpose Statement. The O1 District is designed to function as an office and related employment use area along major roadway corridors. The intent is to encourage high-quality office development that serves as a transitional use between the arterial roadway and adjacent residential areas of the City.

Transition areas adjacent to residential districts and areas at or near major intersections are identified as having a significant impact on the City. This is due to the need to protect the integrity and environment of the City's residential neighborhoods, traffic safety conditions and the land use character of key intersections. Therefore, all development proposed within these districts shall be subject to site plan review and approved as specified in Section 2.3 of this ordinance.

10.2.b. General Requirements. All development in the O1 Arterial Office District shall be subject to the general requirements of Site Plan Review, as provided for in Section 2.3.

10.2.c. Permitted Uses. The following uses are permitted in the O1 District:

(1)

Accessory uses.

(2)

Churches, temples, synagogues.

(3)

Computer services.

(4)

Financial institutions.

(5)

Medical and dental clinics.

(6)

Offices, business, government, professional.

(7)

Residential—Above ground floor.

(8)

Social services, individual and family.

(9)

Park—Passive recreation.

(10)

Park—Active recreation, which is designated at the time of platting and subject to plan review for elements including, but not limited to, location of structures or activities, lighting, fencing, and parking, and approval of the City Planning Commission and City Council.

10.2.d. Special Uses. The following special uses may be allowed in the O1 District:

(1)

Reserved.

(2)

One or more mobile home or demountable temporary structures may be permitted for the purpose of providing space auxiliary to the use for which the site has been zoned. This use of a mobile home or temporary demountable structure may be granted for periods of up to six months, which time may be extended by a condition or amendment to the special use. All requirements of Chapter 38 [Chapter 19] of the City Code relating to mobile homes must be met by any mobile home or structure installed under this regulation. Construction facilities for uses auxiliary to construction activities on construction sites for the period during which a building permit issued by the City is in force, are exempt from this requirement for a special use.

Public, private schools.

(5)

Public safety buildings.

(6)

Day care center.

(7)

Financial institutions with drive-up.

(8)

Park—Active recreation.

(9)

Schools for the arts.

10.2.e. Lot Area and Width.

10.2.f. Yards.

(1)

[Generally.] The minimum yard requirements in the O1 District shall be as follows:

Abutting Residential (Transitional Buffer Yards—TBY). Where an O1 lot abuts the side or rear lot line of a residential lot, the side or rear yard shall be ten percent (10%) of the lot width/length or ten (10) feet, whichever is greater; however no TBY shall be less than ten (10) feet nor be required to be greater than twenty-five (25) feet.

Front and corner side yards shall be the same as the adjacent residential district.

10.2.g. Building Height. No building or structure in the O1 District shall exceed forty-five (45) feet in height.

10.2.h. Off-Street Parking and Loading. The parking and loading requirements for the O1 District shall be as specified in Article 15.

10.2.i. Landscaping and Screening. The landscaping and screening requirements for the O1 District shall be as specified in Article 16.

10.2.j. Sign Regulations. The sign regulations for the O1 District shall be as specified in Article 17.

10.3. - O2 Exclusive Office Park District.

10.3.a. Purpose Statement. This district is designed to function primarily as an employment district. It provides a use and design opportunity for major office related employment uses to locate within the City. The intent is to encourage the development of a campus-type office environment protected from incompatible uses.

However, the district also permits a limited amount of distribution functions which are often combined with office functions. These special uses are intended to facilitate the development of multi-tenant buildings (i.e., "Flex Tech" or "Business Park" developments) that may be suited to small business which by necessity must combine office, distribution and light processing at a single location.

10.3.b. General Requirements. All development in the O2 District shall be subject to the general requirements of site plan review as specified in Section 2.3.

10.3.c. Permitted Uses. The following uses are permitted in the O2 District:

(1)

Accessory uses.

(2)

Churches, temples, synagogues.

(3)

Computer services.

(4)

Day care centers.

(5)

Financial institutions—No drive-up.

(6)

Offices, business, government, professional.

(7)

Offices, medical, dental.

(8)

Social services, individual and family.

(9)

Medical and dental clinics.

(10)

Park—Passive recreation.

(11)

Park—Active recreation, which is designated at the time of platting and subject to plan review for elements including, but not limited to, location of structures or activities, lighting, fencing, and parking, and approval of the City Planning Commission and City Council.

10.3.d. Special Uses. The following special uses may be allowed in the O2 District:

(1)

Auxiliary retail, inside building, used for offices.

(2)

Reserved.

(3)

Cultural facilities.

(4)

Cultural facilities, as an accessory use.

(5)

Financial institutions with drive-up.

(6)

Gardens, botanical, zoological.

(7)

Health centers.

(8)

Limited warehousing, storage, distribution as an accessory use.

(9)

Reserved.

(10)

Medical and dental lab.

(11)

10.3.e. Development Area and Width.

Minimum Lot Area:

Standard Lot: 2 acres[;] may be sub-divided into smaller lots.

10.3.f. Yards.

(1)

[Generally.] The minimum yard requirements for permitted and special uses shall be as follows:

(2)

Abutting Residential. Where an O2 lot abuts the side or rear lot line of a residential lot, the interior side and rear yard requirements shall be the greater of 10.3.f.(1) above or the required transitional buffer yard requirements. Transitional buffer yard requirements are ten (10%) percent of the lot width/length for side or rear yards abutting residential; however, no TBY shall be less than ten (10) feet nor be required to be greater than twenty-five (25) feet.

10.3.g. Building Height. No building or structure in an O2 District shall exceed the following height limitations:

(1)

Permitted Uses: 96 feet.

10.3.h. Off-Street Parking and Loading. The parking and loading requirements for the O2 District shall be as specified in Article 15.

10.3.i. Landscaping and Screening. The landscaping and screening requirements for the O2 District shall be as specified in Article 16.

10.3.j. Sign Regulations. The sign regulations for the O2 District shall be as specified in Article 17.
