ARTICLE 12

- N1 INSTITUTIONAL DISTRICT

12.1. - General Provisions.

General provisions for this district are set forth in Article 3, General Regulations and Uses Permitted with Administrative Approval, Section 3.1. Further, all lawful uses in the area designated as part of the N1 district which were in existence on the effective date of this ordinance may be continued as a special use, until such time as an official development plan is approved for the relevant area within the N1 district. Such uses may not be modified in any way without adoption of an official development plan for the relevant area. It is anticipated that one or more official development plans will be developed and approved for each area within the N1 Institutional District.

Subsequent to the effective date of this ordinance, no area not within the N1 district as of the effective date of this ordinance shall be designated as part of the N1 district unless such area is also designated in an approved official development plan.

12.2. - Purpose Statement.

This district is designed to provide accommodations for all uses necessary for the operation of large institutional uses, including universities, colleges and hospitals. The regulations are written so as to produce a self-contained campus development, providing all of the land uses needed for the operation of the institution, and accessory uses, including off-street parking, setbacks, open areas, etc., all in accordance with an Official Development Plan adopted for the entire property within each Institutional District. Such plan may be adopted as provided in Article 2.16 of this ordinance.

12.3. - Site Plan Review.

All development in the N1 District shall be subject to Site Plan Review, as provided for in Section 2.3.

12.4. - Permitted Uses.

All permitted uses shall be located and developed in accordance with an Official Development Plan. Notwithstanding any other provision in this ordinance, all lawful uses existing on the effective date of this ordinance may be continued as special uses until an Official Development Plan has been adopted which would allow additional or different uses. No such lawful uses shall be expanded or changed, except as provided in an official development plan. The following uses may be authorized as permitted uses pursuant to an official development plan:

Accessory uses, including the following uses when such uses are serving the primary institution's faculty, staff, and guests:

Barber and beauty shops;

(2)

Drug stores;

(3)

Gift shops;

(4)

Medical sales and rentals;

(5)

Restaurants;

(6)

Bookstores;

(7)

Ticket offices; and

(8)

Retail stores.

12.5. - Special Uses.

The following uses may be allowed as special uses in the N1 District:

a.

Cemeteries.

b.

Community center.

c.

Day care centers other than those serving the institution's faculty, staff, or students or their dependents.

d.

e.

Fraternity.

f.

Heliports for institutional use only.

g.

Offices other than those used to serve the institution's faculty, staff, and students.

h.

Radio and TV studio, offices with auxiliary towers.

i.

Radio and TV towers.

j.

Research, scientific, educational, other than that conducted by the students, faculty, or staff of the institution designated in the official development plan.

k.

Sorority.

l.

Student center or club.

m.

Such other uses as are consistent with the relevant official development plan.

n.

Uses in existence on the effective date of this ordinance which are located in areas for which the City has not adopted an official development plan.

o.

Park—Active recreation.

12.6. - Yards.

[The required yards in the N1 District shall be as follows:]

** This yard may be observed only when no other lots with frontage on this street have, or have the ability to have, a building fronting on this street.

Different distances between buildings and different provisions of open space may be specified on the official development plan in lieu of the above requirements, providing that perimeter yards shall be no less than twenty-five (25) feet deep, or, if at least fifty percent (50%) of the block is developed on the effective date of this ordinance, the perimeter yard shall be the average of the existing setbacks or twenty-five (25) feet, whichever is less. The minimum perimeter requirement may be varied when the Zoning Commission recommends and the City Council grants a variance reducing such requirement and makes the findings required for the grant of a variance under the provisions of this ordinance.

12.7. - Building Height.

No building in the N1 District shall exceed one hundred thirty-two (132) feet in height.

12.8. - Parking and Loading.

The parking and loading requirements for the Institutional District shall be as specified in Article 15, or as otherwise specified in the relevant official development plan. It is recognized that at various stages of campus development the land uses and the off-street parking spaces required for the same, may not be exactly in balance. Notwithstanding the foregoing, each official development plan shall provide for an amount of parking which would be equal [to] or greater than the parking for the area specified in such plan which would be required under the provisions of Article 15. It is further provided that such overall required parking may be reduced in cases where the Zoning Commission recommends and the City Council grants a variance reducing such overall parking requirement and makes the findings required for the grant of a variance under the provisions of this ordinance.

12.9. - Landscaping and Screening.

The landscaping and screening requirements shall be as specified in Article 16, or as otherwise specified in the relevant official development plan.

12.10. - Sign Regulations.

The sign regulations for the N1 District shall be as specified in Article 17, or as otherwise specified in the relevant official development plan.

12.11. - Required Open Space.

Any portion of an N1 district which is within twenty-five (25) feet and adjacent to a boundary of an N1 district, or a street or alley which serves as the boundary of an N1 district, shall be preserved as landscaped open space. This requirement shall not apply to any structure, or parking in existence on the effective date of this ordinance.

In determining the required open space no right-of-way or parking shall be included in the measurement of the required twenty-five (25) feet.

After the effective date of this ordinance, no structure shall be erected within the required landscaped open space, and no new parking spaces shall be constructed with [within] the required landscaped open space.
