ARTICLE 7

- RESIDENCE DISTRICTS

7.1. - General Provisions.

7.1.a. Permitted Uses. Permitted uses of land or buildings, as hereinafter listed, shall be permitted in the districts indicated under the conditions indicated. Unless otherwise specifically set forth, wherever a permitted use is named as a major category in this Article, it shall be deemed to include all and only those itemized uses under the said major category listed in the Estate Residence (RE) District. No building or tract of land shall be devoted to any use other than a use permitted hereinafter in the zoning district in which such building or tract of land shall be located, with the exception of the following:

(1)

Uses lawfully established on the effective date of this ordinance.

(2)

Special uses, allowed in accordance with the provisions of Section 7.1.b. hereunder.

Uses already established on the effective date of this ordinance and rendered nonconforming by the provisions hereof, shall be subject to the regulations of Article 5 (Nonconforming Buildings, Structures and Uses).

Home occupations and uses which are accessory to permitted uses shall be permitted in all residential districts. Uses which are accessory to special uses may be permitted when approved as part of the special use, or when the Zoning Administrator finds they are not an expansion of an approved special use.

7.1.b. Special Uses. Special uses, as hereinafter listed, may be allowed in the zoning districts indicated, subject to review by the Zoning Commission and recommendation to the City Council for approval in accordance with the provisions of Section 2.15. Unless otherwise specifically set forth, whenever a special use is named as a major category in this Article, it shall be deemed to include all and only those itemized uses listed under the said category.

The Zoning Administrator may allow land uses (permitted or special) which, though not contained by name in the zoning district list of permitted uses, are deemed to be clearly similar in nature to the listed uses.

7.1.c. Accessory Structures and Accessory Storage Buildings. Accessory structures and accessory storage buildings shall be permitted incidental to the principal use, and shall not be used as dwelling units or involve the conduct of a business.

Permitted accessory structures include, but are not limited to, swimming pools, tennis and basketball courts, other outdoor residential recreational facilities, and other open type structures like gazebos.

Permitted accessory storage buildings include open or closed type buildings, including private garages, and are designed and used for storage or parking of vehicles and storage of materials incidental to the use of the principal structure, or are designed and used for allowable uses incidental to the principal structure.

A dwelling unit is permitted one (1) accessory storage building with a maximum size of 1,092 square feet and with maximum dimensions of twenty-six (26) feet by forty-two (42) feet. Multiple family dwellings in multiple family zoning districts are not limited to these size restrictions and must obtain approval through the Site Plan Review Board.

Any accessory structure or accessory storage building that is not part of the principal structure shall be located on the same zoning lot as the principal structure, shall not exceed fourteen (14) feet in height, shall be located at least ten (10) feet from any dwelling situated on the same lot and at least six (6) feet from any other building or accessory building on the lot. Such accessory structures or accessory storage buildings shall comply to the stated yard requirements for accessory structures in each residential district; however, in those instances where the accessory structure or accessory storage building doors open to the alley, the rear yard must be a minimum of five (5) feet.

7.1.d. Lot Size Requirements. Lot size requirements shall be as specified under each zoning district in Part B of this Article.

In addition, no use shall be established or hereafter maintained on a lot recorded after the effective date of this ordinance, which is of less area or less width than prescribed hereinafter for such use in the zoning district in which it is to be located.

7.1.e. Yard Requirements.

(1)

Yard requirements shall be set forth under each zoning district. Front, side, and rear yards shall be provided in accordance with the regulations hereinafter indicated and shall be unobstructed from the ground level to the sky unless otherwise provided herein.

(2)

All accessory buildings which are attached to principal buildings (e.g., attached garages) shall comply with the yard requirements of the principal building, unless otherwise indicated.

(3)

The rear yard requirement for a through lot shall be the same as the requirement for the front yard, for the particular district in which it is located.

(4)

In residential developments containing three (3) or more units, the yard requirements may be waived in order to encourage innovative design, including cluster development and the zero lot line concept, and to provide for such housing types as the atrium or patio house. Such waiver may be obtained through planned unit development procedures under the special use provisions, as provided within each residential district.

7.1.f. Building Bulk (Volume) Limitations. Building bulk limitations shall be expressed in terms of minimum yard requirements and maximum building height. All structures must comply with the building height limitations prescribed in the zoning districts.

7.1.g. Signs. Signs shall be allowed in Residence Districts in accordance with the regulations established in Article 17.

7.1.h. Off-Street Parking and Loading. In no instance shall parking be provided in the front yard of a residence, other than on a driveway to a garage. Off-street parking and loading facilities, accessory to uses allowed in Residence Districts, shall be provided in accordance with the regulations established in Article 15.

7.1.i. Landscaping and Screening. Landscaping and screening shall be required in Residence Districts in accordance with the regulations established in Article 16.

7.1.j. Overlay Districts. In addition, the provisions of the following overlay districts may apply in the residence districts: Neighborhood Conservation District and Thoroughfare District.

7.1.k. Site Plan Review. All development in the R5, R6, R7 and R8 Residence Districts shall be subject to Site Plan Review, as provided for in Section 2.3.

7.2. - A1 Agricultural District.

7.2.a. Purpose Statement. The A1 Agricultural District is designed for agricultural uses on lands primarily in the outlying areas of the City, prior to development of those areas into subdivisions. When subdividing occurs, it is expected that these areas will be rezoned to a class other than agricultural, in keeping with the general plan of that portion of the City of Peoria.

7.2.b. Permitted Uses. The following uses are permitted in the A1 District:

(1)

Accessory uses.

(2)

Aviaries.

(3)

Child care home.

(4)

Crop cultivation, farming.

(5)

Family care facility (that meets standards for use with administrative approval).

(6)

Farming—Cattle, horses, sheep, poultry.

(7)

Gardening, including truck farming.

(8)

Greenhouses.

(9)

[Reserved.]

(10)

Nurseries, plant materials.

(11)

One family dwelling as farm.

(12)

Orchards.

(13)

Roadside stands.

(14)

Single-family detached dwelling.

(15)

Park—Passive recreation.

(16)

Park—Active recreation, which is designated at the time of platting and subject to plan review for elements including, but not limited to, location of structures or activities, lighting, fencing, and parking, and approval of the City Planning Commission and City Council.

(17)

Small wind energy conversion systems (SWECS).

7.2.c. Special Uses. The following special uses may be allowed in the A1 District:

(1)

Cemeteries.

(2)

Churches, temples, synagogues.

(3)

Congregate housing.

(4)

Convents, monasteries, seminaries.

(5)

Crematories.

(6)

Day care centers.

(7)

Elderly housing.

(8)

Family care facility (that does not meet standards for use with administrative approval).

(9)

Golf, tennis, outdoor recreation.

(10)

Group care facility.

(11)

(12)

One or more mobile home or demountable temporary structures may be permitted for the purpose of providing space auxiliary to the use for which the site has been zoned. This use of a mobile home or temporary demountable structure may be granted for periods of up to six months, which time may be extended by a condition or amendment to the special use. All requirements of Chapter 38 [Chapter 19] of the City Code relating to mobile homes must be met by any mobile home or structure installed under this regulation. Construction facilities for uses auxiliary to construction activities on construction sites for the period during which a building permit issued by the City [is] in force, are exempt from this requirement for a special use.

7.2.d. Lot Size Requirements.

Minimum Lot Area:

All lots within the A1 District: Ten (10) acres.

7.2.e. Yard Requirements. No buildings except roadside stands shall be constructed within fifty (50) feet of any property line.

7.2.f. Building Height Limitations. Single-family dwellings and accessory structures shall not exceed thirty-five (35) feet in height. Barns, sheds, and silos, shall not exceed fifty (50) feet in height.

7.3. - RE Estate Residence District.

7.3.a. Purpose Statement. The RE Estate Residence District is intended to promote low density residential uses of a semi-rural character. This district is located in areas of existing large-lot development and/or in areas of natural beauty where maximum open space preservation is desired. The density shall not exceed one (1) gross dwelling unit per two (2) acres.

7.3.b. Permitted Uses. The following uses are permitted in the RE District:

(1)

Accessory uses and structures, incidental to and on the same zoning lot as the principal use, as follows:

(a)

Garages and carports. Garage dimensions shall not exceed 26 feet by 42 feet.

(b)

Gardens, private.

(c)

Greenhouses and conservatories, private (noncommercial).

(d)

Home occupations as set forth in Article 4.

(e)

Swimming pools and tennis courts, private (noncommercial).

(f)

Toolhouses, sheds, and other similar buildings for the storage of domestic supplies.

(g)

Temporary storage of building materials and equipment for on-site construction for a period not to exceed the duration of such construction.

(h)

Temporary real estate tract offices, for the sole purpose of conducting the sale of lots of the tracts upon which such tract office is located, for a period not to exceed the duration of such sales.

(i)

Storage of firewood allowed, but prohibited from required side yards and the area located between the front building setback line and the corresponding street property line.

(j)

Miscellaneous accessory structures including but not limited to satellite receiving dishes and play houses.

(2)

Child care home.

(3)

Duplex, designated at the time of platting.

(4)

Family care facility (that meets standards for use with administrative approval).

(5)

7.3.c. Special Uses. The following special uses may be allowed in the RE District:

Day care centers.

(6)

Family care facility (that does not meet standards for use with administrative approval).

(11)

One or more mobile home or demountable temporary structures may be permitted for the purpose of providing space auxiliary to the use for which the site has been zoned. 7.4. - R1 Single-Family Residence District.

7.4.a. Purpose Statement. The R1 Single-Family Residence District is intended to provide for residences at a density greater than estate development but less than that of conventional suburban subdivisions and to protect these areas from the encroachment of incompatible uses. The density shall not exceed two (2) gross dwelling units per acre.

7.4.b. Permitted Uses. The following uses are permitted in the R1 District:

(1)

Accessory uses and structures, incidental to and on the same zoning lot as the principal use, as specified in Section 7.3.b.(1).

(2)

Child care home.

(3)

Duplex, designated at the time of platting.

(4)

Family care facility (that meets standards for use with administrative approval).

(5)

7.5. - R2 Single-Family Residence District.

7.5.a. Purpose Statement. The R2 Single-Family Residence District is intended to provide single-family suburban residences with moderate sized lots. The density shall not exceed four (4) gross dwelling units per acre.

7.5.b. [Permitted Uses.] The following uses are permitted in the R2 District:

(1)

Accessory uses and structures, incidental to and on the same zoning lot as the principal use, as specified in Section 7.3.b.1.).

(2)

Child care home.

(3)

Duplex, designated at the time of platting.

(4)

Family care facility (that meets standards for use with administrative approval).

(5)

Group family.

(6)

Single-family detached dwellings.

(7)

Private, noncommercial garden.

(8)

Park—Passive recreation.

(9)

Park—Active recreation, which is designated at the time of platting and subject to plan review for elements including, but not limited to, location of structures or activities, lighting, fencing, and parking, and approval of the City Planning Commission and City Council.

7.6. - R3 Single-Family Residence District.

7.6.a. Purpose Statement. The R3 Single-family Residence District is primarily designed to preserve presently developed single-family neighborhoods in the City. The district is intended to allow for the development of single-family residences on small or irregularly shaped vacant lots. This district is also intended for undeveloped areas, prior to the development of those areas into subdivisions. When subdividing occurs, these areas may be rezoned in keeping with the general plan of that portion of the City of Peoria. The density shall not exceed 7.26 gross dwelling units per acre.

7.6.b. Permitted Uses. The following uses and no others are permitted in the R3 Single-Family Residence District:

(1)

Accessory uses and structures, incidental to and on the same zoning lot as the principal use, as specified in Section 7.3.b.(1).

(2)

Child care home.

(3)

Duplex, designated at the time of platting.

(4)

Family care facility (that meets standards for use with administrative approval).

7.7. - R4 Single-Family Residence District.

7.7.a. Purpose Statement. The R4 Single-Family Residence District is primarily designed to preserve and enhance small lot, residential areas that were developed with high population densities. The district also is intended to allow for the development of single-family residences on small or irregular shaped vacant lots, as well as other selected uses that are compatible with the residential character of the district. The density shall not exceed 11.62 gross dwelling units per acre.

7.7.b. Permitted Uses. The following uses are permitted in the R4 District:

(1)

Accessory uses and structures, incidental to and on the same zoning lot as the principal use, as specified in Section 7.3.b.(1).

(2)

Child care home.

(3)

Duplex, designated at the time of platting.

(4)

Family care facility (that meets standards for use with administrative approval).

Bed and breakfast.

7.8. - R5 Residential Cluster Development District.

7.8.a. Purpose Statement. The R5 Residential Cluster Development District is designed to provide for alternative modes of residential development with a greater variety in type, design, and layout, while maintaining the character of an owner-occupied neighborhood. This district would allow for higher-density housing than would be permitted in a single-family residence district, but less than multi-family residential districts. The density shall not exceed 12.10 dwelling units per acre.
