REMEDIES AND PENALTIES

13.10.- Remedies.

In case any building or structure is or is proposed to be erected, constructed, reconstructed, altered, converted or maintained, or any building, structure or land is or is proposed to be used in violation of any provision of this ordinance, the building inspector or any other appropriate authority of the city may, in addition to other remedies, and after due notice to the owner of the violation, institute injunction, or other appropriate action or proceeding to prevent such unlawful erection, construction, reconstruction, alteration, conversion, maintenance or use to correct or abate such violation or to prevent the occupancy of such building, structure or land.

13.2. - Penalties.

Any firm, person or corporation who shall do anything prohibited by these regulations as the same exist or as they may hereafter be amended, or who shall fail to do anything required by the regulations as they now exist or as they may hereafter be amended, upon conviction of a violation shall be considered guilty of a misdemeanor punishable either by a fine not exceeding $100.00 or not more than 30 days jail, or both. Each and every day that such violation exists shall be deemed a separate offense.

Furthermore, should any violation continue for more than 20 days from the date of conviction, then the municipal court judge is hereby empowered, by entry of appropriate order of the municipal court, to authorize the city to rectify the violation (remove scrap cars, clean yard, remove mobile homes, etc.) at the property owner's expense.
