CHAPTER 6

RESIDENCE DISTRICTS

11-6-1: PURPOSE; CLASSIFICATIONS:

The residence district regulations are intended to encourage a range of housing styles, prices, and living environments which are adequately insulated from the undesirable aspects of adjacent land uses while maintaining the single-family dwelling as the basic form of housing unit in Pingree Grove. In doing so, the regulations govern the location, type, intensity, and quality of development in the residential areas of the Village. The regulations of each district are designed to protect existing residential development while allowing new growth in accordance with specific development standards and objectives. Toward this end, the residential uses in the Village have been grouped into the following classifications:

11-6-2: HOME OCCUPATIONS:

   A.   Purpose: The purpose of the home occupation standards and requirements is to allow occupations to be conducted in a dwelling unit which are compatible with the neighborhoods in which they are located and which do not interfere with the rights of the surrounding property owners to enjoy the residential character of the neighborhood.
   B.   Standards: The following standards for home occupations are intended to ensure compatibility with the residential use and with the residential character of the neighborhood, and there must be clearly a secondary or incidental status of the home occupation in relation to the residential use of the dwelling unit:
      1.   A home occupation shall be conducted only by members of the family residing in the dwelling unit.
         a.   Employee Limitations: Only one employee who does not reside in the dwelling unit on the lot where a home occupation is conducted may be present in the home at any one time in connection with the home occupation.
      2.   There may be more than one home occupation permitted per dwelling unit; however, the total combined home occupations for any single dwelling unit may not exceed any of the standards set forth in this title. The dwelling unit must be the principal residence of the member(s) of the family conducting the home occupation.
      3.   A home occupation that services customers or clients at the dwelling unit may attract no more than eight (8) customers or clients per day but not between the hours of nine o'clock (9:00) P.M. one day and eight o'clock (8:00) A.M. the next day.
      4.   The home occupation shall be conducted entirely within the dwelling unit and shall be limited to three hundred (300) square feet or a maximum of twenty five percent (25%) of the gross floor area of the dwelling unit which includes the basement or attached garage, whichever is less. In addition, up to twenty five percent (25%) of the floor area of a "cellar", as defined in section 11-2-2 of this title, may be used for a home occupation. No outdoor storage or display of business equipment, materials, merchandise, inventory, or heavy equipment shall be allowed in connection with any home occupation.
      5.   There shall be no signs on the premises for home occupations other than those permitted for residence districts under this title; no exterior display; no exterior storage of merchandise, goods, supplies, equipment or materials; and no exterior alterations, permanent or temporary, to the principal or accessory buildings that would change the residential character of the structure.
      6.   Clients or customers of the home occupation may not increase vehicular traffic flow and parking by more than two (2) additional vehicles at a time, and any need for parking generated by the conduct of such occupation shall be met by off street parking spaces which are in keeping with the residential character of the neighborhood.
      7.   The receipt or delivery of merchandise, goods, or supplies for use in a home occupation shall be limited to the United States mail, similar parcel delivery service (excluding semi- trucks/trailers), or private passenger automobile.
      8.   The use of an accessory building for a home occupation is allowed, provided the occupation is conducted wholly within the accessory building and does not exceed three hundred (300) square feet in area.
      9.   No alteration of any kind shall be made to the dwelling unit where a home-based business is conducted that would change its residential character as a dwelling unit.
      10.   A home occupation shall not generate noise, vibration, glare, fumes, odors, or electrical interference beyond what normally occurs in a residential use. No home occupation shall cause the rate of water usage (gallons per minute) to exceed the standard rate capable of being produced by the existing water service, but in no case shall water usage exceed the rate capable of being produced by a one inch (1") water service. No mechanical or electrical equipment shall be installed or maintained other than such as is customarily incidental to a home. No mechanical or electrical equipment shall be operated in such a way as to interfere with the use and enjoyment of neighboring properties or indicate that the structure is being used for a non-residential purpose, or to place demands on public infrastructure that are excessive when compared to a typical single-family home.
      11.   Except for articles produced on the premises or incidental to a service provided, no stock in trade shall be displayed or sold on the premises.
      12.   On-line marketplace sale of items authorized for sale by this section is permitted.
      13.   The following uses, in addition to any which do not satisfy the other standards and requirements set forth herein, shall not be permitted as home occupations:
Amusement establishments.
Animal grooming.
Animal hospitals.
Clinics or hospitals.
Clubs or lodges, private, fraternal or religious.
Dry cleaning and laundry receiving establishments.
Firearm sales, supply and service.
Food stores.
Fuel sales.
Funeral parlors or undertaking establishments.
Furniture sales.
Garages, public.
Liquor stores.
Pet shops.
Renting or sale of trailers or automotive vehicles.
Restaurants or taverns.
Retail stores for stock displayed and/or sold on the premises.
Stables or kennels.
Wholesale establishments.
      14.   A home occupation shall not be established prior to the member(s) of the family conducting the home occupation taking possession of and residing in the dwelling unit.
   C.   Exemption: Daycare homes are exempted from the standards and requirements for home occupations set forth in subsections B1, B3, B4, B6 and B8 of this section.
   D.   Affidavit:
      1.   For each home occupation, it is required that an affidavit be completed and kept on file with the Village Clerk. The signed affidavit will state the type of home occupation proposed and shall further state that the applicant has read the requirements for a home occupation and agrees to comply therewith.
      2.   If a person has been validly operating a home occupation in compliance with previous ordinances as of the effective date hereof, he or she need not sign an affidavit but shall be permitted to do so subject however to chapter 11 of this title. Such affidavit shall be personal to the occupant, occupation and address listed in the affidavit.
      3.   A condition of lawfully maintaining a home based business, each affidavit, at the time of filing, is subject to review by the Chief of Police. The Chief reserves the right to require each filer to submit a security plan, including contact information, a description of the operation and the number of persons likely to be present, a description of any hazards at the premises, a floor-plan and other relevant information, for any home based business which the Chief believes to present any public safety concern based on the nature, location or configuration of the business. This requirement shall apply to all home-based day care centers and any other business designated by the Chief.
   E.   Special Use Permit Required: Any resident who wishes to conduct a business in their home but who does not meet the requirements of this section, with the exception of non- permitted home occupations, may apply for a special use permit pursuant to the special use procedures of the zoning regulations.

11-6-4: CONVERSIONS:

In R residence districts, conversions of existing residential buildings shall be governed by the following:
   A.   The quotient secured by dividing the floor area of all dwelling units on a lot by the number of dwelling units on such lot shall not be less than five hundred (500) square feet.
   B.   No existing residential use shall be so converted as to conflict with, or further conflict with, the requirements in subsection A of this section.
   C.   Where applicable, an efficiency dwelling unit or lodging room may be considered 0.75 dwelling unit in determining compliance with subsection A of this section.

11-6A-1: PURPOSE AND DESCRIPTION:

   A.   The R-1 residence and agricultural district is intended to create an environment which promotes a mixture of agriculture uses and estate type single-family residential development.
   B.   Those areas included in the R-1 district are intended for extremely low density single-family residential use.
   C.   Many of these locations are environmentally sensitive and are frequently characterized by steep or rolling hills, wooded terrain, and contain soils with poor development potential.
   D.   Public utilities are not expected to be available in areas classified in the R-1 zoning district.
   E.   To protect the character of the district, permitted activities are limited to single-family residential dwellings and certain specified agriculture, religious, and public uses. All commercial activities are prohibited in the R-1 zoning district. (Ord. 2004-02, 2-2-2004)

11-6A-2: PERMITTED USES:

Permitted uses of structures and land as hereinafter enumerated shall be allowed in the R-1 residence and agricultural district only in accordance with the conditions specified. The following uses constitute the only permitted uses in the R-1 zoning district:
Agriculture uses:
Agriculture buildings and structures.
Agriculture uses, general; except as noted elsewhere.
Cultivation of field and garden crops.
Farm stands - products grown on the premises in the R-1 district.
Farms.
Cultural, recreational and entertainment uses:
Athletic fields.
Gymnasiums, school and park.
Nature preserves and sanctuaries.
Parks and playgrounds.
Swimming clubs and pools.
Educational uses:
Elementary schools.
High schools.
Junior high schools.
Kindergartens.
Residential uses:
   Garages, private residential.
   Single-family dwellings.

11-6A-3: SPECIAL USES:

Special uses, as hereinafter enumerated, may be allowed in the R-1 residence and agricultural district only in accordance with the provisions specified in section 11-3-4 of this title. The following uses constitute the only special uses allowed in the R-1 zoning district:
Agriculture uses:
   Roadside farm stands.
Cultural, recreational and entertainment uses:
Auditoriums, private.
Country clubs.
Golf courses.
Health, medical and care facilities:
Convalescent homes.
Daycare homes.
Nursing homes.
Planned unit developments.
Public and utility uses:
Fire stations.
Government offices.
Police stations.
Post offices.
Sewage treatment and distribution facilities.
Water treatment and distribution facilities.
Water wells, reservoirs, towers, and storage facilities.
Religious uses:
Chapels.
Churches.
Convents.
Parsonages.
Rectories.
Religious assembly halls and meeting rooms.
Synagogues.
Temples.
Residential uses:
   Institutional housing.
Retail and business uses:
   None.

11-6A-4: TEMPORARY USES:

Temporary uses, as hereinafter enumerated, may be allowed in the R-1 residence and agricultural district. The following uses constitute the only temporary uses allowed in the R-1 zoning district:
Block parties and street dances.
Contractor offices and equipment sheds when and where in service to an active Village-approved construction project.
Home and garage sales.
Real estate sales offices and model units.

11-6A-5: ACCESSORY USES:

Agricultural buildings and structures.
Children's playhouses.
Conservatories, private.
Garages, carports, and other parking facilities.
Gazebos and other similar structures.
Greenhouses, private.
Radio, radar, and television antenna towers and dishes.
Swimming pools and tennis courts.
Tool houses, sheds and other similar buildings.

11-6A-6: SITE AND STRUCTURE REQUIREMENTS:

All uses of structures and land in the R-1 residence and agricultural district shall conform to the following site and structure provisions:
   A.   Lot And Building Requirements:
      1.   Minimum Lot Area Per Principal Building: Two hundred thousand (200,000) square feet.
      2.   Minimum Lot Width: Three hundred feet (300').
      3.   Yards:
         a.   Front yard: Thirty feet (30').
         b.   Corner lot/side yard: Thirty feet (30').
         c.   Interior lot/side yard: Fifteen feet (15'), plus one foot (1') for every one foot (1') in height over thirty feet (30').
         d.   Rear yard: Forty feet (40').
         e.   Minimum green area in side yard: Five feet (5').
      4.   Height Limitations:
         a.   Principal structure: Thirty five feet (35'); no limit for agriculture.
         b.   Accessory structure: Twenty feet (20'); no limit for agriculture.
   B.   Dwelling Standards:
      1.   Minimum square footage for dwelling floor area: One thousand nine hundred (1,900).
      2.   Maximum floor area ratio to lot area ratio, including garage and accessory buildings: 0.035; none for agriculture. (Ord. 2004-02, 2-2-2004; amd. 2011 Code)

11-6A-7: DISTRICT STANDARDS:

All uses of structures and land in the R-1 residence and agricultural district are subject to the general standards, ordinances, and regulations of the village. In addition, all uses located in the R-1 zoning district shall be subject to the following district standards:
   A.   Exterior Lighting: All exterior lighting shall be shaded or inwardly directed in such a manner so that no direct lighting or glare is cast upon adjacent residential or institutional property. The intensity of such lighting shall not exceed two (2) foot-candles as measured at the abutting property line.
   B.   Landscaping And Screening: All uses shall conform with the applicable requirements for landscaping and screening.
   C.   Off Street Parking And Loading: All uses shall conform to the applicable requirements for off street parking and loading set forth in this title.
   D.   Performance Standards: All uses shall conform to the performance standards set forth in this title.
   E.   Signs: All uses shall conform to the applicable requirements for signs set forth in this title. (Ord. 2004-02, 2-2-2004)

11-6B-1: PURPOSE AND DESCRIPTION:

   A.   The R-2 rural residence district is intended to provide a quality environment for single-family dwellings on moderately large lots.
   B.   The R-2 district is located in those portions of the village where moderately large lot residential development presently exists and where similar development appears likely to occur in the future.
   C.   Areas designated in the R-2 zoning district may or may not have, depending upon their location, at least partial access to public utilities.
   D.   To protect the character of the district, permitted activities are limited to single-family residential dwellings and certain specified agriculture, cultural, educational, religious, and public uses. All commercial activities are prohibited in the R-2 zoning district. (Ord. 2004-02, 2-2-2004)

11-6B-2: PERMITTED USES:

Permitted uses of structures and land, as hereinafter enumerated, shall be allowed in the R-2 rural residence district only in accordance with the conditions specified. The following uses constitute the only permitted uses in the R-2 zoning district:
Cultural, recreational and entertainment uses:
Athletic fields.
Gymnasiums, school and park.
Nature preserves and sanctuaries.
Parks and playgrounds.

11-6B-4: TEMPORARY USES:

Temporary uses, as hereinafter enumerated, may be allowed in the R-2 rural residence district. The following uses constitute the only temporary uses allowed in the R-2 zoning district:

Contractor offices and equipment sheds when and where in service to an active Village-approved construction project.
Home and garage sales.
Real estate offices and model units.

All uses of structures and land in the R-2 rural residence district shall conform to the following site and structure provisions:
   A.   Lot And Building Requirements:
      1.   Minimum Lot Area Per Principal Building: Twelve thousand (12,000) square feet.
      2.   Minimum Lot Width: Eighty five feet (85').
      3.   Yards:
         a.   Front yard: Thirty feet (30').
         b.   Corner lot/side yard: Thirty feet (30').
         c.   Interior lot/side yard: Twelve feet (12').
         d.   Rear yard: Thirty feet (30').
         e.   Minimum green area in side yard: Four feet (4').
      4.   Height Limitations:
         a.   Principal structure: Thirty five feet (35').
         b.   Accessory structure: Fifteen feet (15').
   B.   Dwelling Standards:
      1.   Minimum square footage for dwelling floor area: One thousand seven hundred (1,700).
      2.   Maximum floor area ratio to lot area ratio, including garage and accessory buildings: 0.035. (Ord. 2004-02, 2-2-2004; amd. 2011 Code)

11-6B-7: DISTRICT STANDARDS:

All uses of structures and land in the R-2 rural residence district are subject to the general standards and regulations of this title. In addition, all uses located in the R-2 zoning district shall be subject to the R-1 district standards (section 11-6A-7 of this chapter). (Ord. 2004-02, 2-2-2004)

11-6C-1: PURPOSE AND DESCRIPTION:

   A.   The R-3 and R-4 residence districts are intended to promote single-family residential development in a suburban environment.
   B.   The R-3 and R-4 districts provide for the orderly expansion of existing neighborhoods and encourage new growth in areas appropriate for urbanized, predominantly single-family development in a more dense environment.
   C.   The R-3 and R-4 districts are concentrated in those portions of the community which can be readily provided with public facilities and services.
   D.   To protect the character of the district, permitted activities are limited to single-family, cultural, educational, religious, and public uses. All commercial activities are prohibited in the R-3 and R-4 zoning districts. (Ord. 2004-02, 2-2-2004)

11-6C-2: PERMITTED, SPECIAL, TEMPORARY AND ACCESSORY USES:

Permitted, special, temporary and accessory uses of structures and land, as specified in the R-2 district, shall be similarly applicable to the R-3 and R-4 zoning districts. (Ord. 2004-02, 2-2-2004; amd. 2011 Code)

11-6C-3: SITE AND STRUCTURE REQUIREMENTS:

   A.   R-3 District: All uses of structures and land in the R-3 residence district shall conform to the following site and structure provisions:
      1.   Lot And Building Requirements:
         a.   Minimum Lot Area Per Principal Building: Nine thousand five hundred (9,500) square feet.
         b.   Minimum Lot Width: Seventy five feet (75').
         c.   Yards:
            (1)   Front yard: Thirty feet (30').
            (2)   Corner lot/side yard: Twenty five feet (25').
            (3)   Interior lot/side yard: Ten feet (10').
            (4)   Rear yard: Twenty five feet (25').
            (5)   Minimum green area in side yard: Three feet (3').
         d.   Height Limitations:
            (1)   Principal structure: Thirty five feet (35').
            (2)   Accessory structure: Fifteen feet (15').
      2.   Dwelling Standards:
         a.   Minimum square footage for dwelling floor area: One thousand five hundred (1,500).
         b.   Maximum floor area ratio to lot area ratio, including garage and accessory buildings: 0.035.
   B.   R-4 District: All uses of structures and land in the R-4 residence district shall conform to the following site and structure provisions:
      1.   Lot And Building Requirements:
         a.   Minimum Lot Area Per Principal Building: Eight thousand five hundred (8,500) square feet.
         b.   Minimum Lot Width: Sixty five feet (65').
         c.   Yards:
            (1)   Front yard: Twenty five feet (25').
            (2)   Corner lot/side yard: Twenty five feet (25').
            (3)   Interior lot/side yard: Eight feet (8').
            (4)   Rear yard: Twenty five feet (25').
            (5)   Minimum green area in side yard: Three feet (3').
         d.   Height Limitations:
            (1)   Principal structure: Thirty five feet (35').
            (2)   Accessory structure: Fifteen feet (15').
      2.   Dwelling Standards:
         a.   Minimum square footage for dwelling floor area: One thousand three hundred (1,300).
         b.   Maximum floor area ratio to lot area ratio, including garage and accessory buildings: 0.035. (Ord. 2004-02, 2-2-2004; amd. 2011 Code)

11-6C-4: DISTRICT STANDARDS:

All uses of structures and land in the R-3 and R-4 residence districts are subject to the general standards and regulations applicable to the R-1 district (section 11-6A-7 of this chapter). (Ord. 2004-02, 2-2-2004; amd. 2011 Code)

11-6D-1: PURPOSE AND DESCRIPTION:

   A.   The R-5 attached and multiple-family residence district is intended to promote residential development in a suburban environment.
   B.   The R-5 district provides for the orderly expansion of existing neighborhoods and encourages new growth in areas appropriate for multi-family development.
   C.   The R-5 district is concentrated in those portions of the community which can be more readily provided with public facilities and services.
   D.   To protect the character of the district, permitted activities are limited to residential uses. All commercial activities are prohibited in the R-5 zoning district. (Ord. 2004-02, 2-2-2004)

11-6D-2: PERMITTED, SPECIAL, TEMPORARY AND ACCESSORY USES:

   Permitted, special, temporary and accessory uses of structures and land in the R-5 district are as follows:
   A.   Permitted uses:
   Apartments.
   Condominiums.
   Multiple-family dwellings.
   Parks and recreational areas when publicly owned and operated.
   Single-family attached residence dwellings.
   B.   Special uses:
   Cemeteries.
   Churches and other places of worship.
   Dormitories.
   Golf courses.
   Institutions for the aged, managed care facilities.
   Medical and dental offices and group medical centers.
   Parking lots.
   Planned unit developments.
   Public facilities such as libraries and museums or those required to service the district.
   Schools, including playgrounds and athletic fields auxiliary thereto.
   C.   Temporary uses:
   Home and garage sales.
   Model sales units.
   Similar and compatible uses as determined by the village board.
   D.   Accessory uses:
   Parking facilities.
   Swimming pools.
   Tennis courts.

11-6D-3: SITE AND STRUCTURE REQUIREMENTS:

All uses of structures and land in the R-5 zoning district shall conform to the following site and structure provisions:
   A.   Lot And Building Requirements:
      1.   Minimum Lot Area Per Principal Building: Every attached and multiple family dwelling hereinafter erected shall be located on a lot having the following minimum area requirements:
         a.   Two-family dwellings: Five thousand (5,000) square feet per unit.
         b.   Multi-family dwellings: Four thousand (4,000) square feet per dwelling unit.
         c.   Lot coverage: Not more than sixty percent (60%) of the area of the lot may be covered by a building and structure including accessory buildings.
      2.   Yards:
         a.   Front yard: Thirty feet (30'), plus one foot (1') for each foot in height greater than thirty feet (30').
         b.   Corner lot/side yard: Twenty five feet (25').
         c.   Interior lot/side yard: Eight feet (8'), plus one foot (1') for each foot in height greater than thirty feet (30').
         d.   Rear yard: Thirty feet (30').
         e.   Minimum green area in side yard: Three feet (3').
      3.   Height Limitations:
         a.   Principal structure: Thirty five feet (35').
         b.   Accessory structure: Twenty feet (20'). (Ord. 2004-02, 2-2-2004; amd. 2011 Code)
   B.   Dwelling Standards:
      1.   One- and two-story attached dwelling structures shall have a total floor area of not less than eight hundred (800) square feet per floor for each dwelling unit measured from the outside walls including utility rooms but excluding all other areas not used for living, eating or sleeping purposes.
      2.   Multiple-family dwelling structures shall have a total floor area of not less than seven hundred (700) square feet for each dwelling unit measured from the outside walls including utility rooms but excluding all other areas not used for living, eating or sleeping purposes. 11-6D-4: DISTRICT STANDARDS:

All uses of structures and land in the R-5 zoning district are subject to the general standards and regulations applicable to the R-1 district (section 11-6A-7 of this chapter). (Ord. 2004-02, 2-2-2004; amd. 2011 Code)

11-6E-1: PURPOSE AND DESCRIPTION:

   A.   The SR single-family residence district is intended to provide a quality environment for single-family dwellings on large lots.
   B.   The SR district is located in those portions of the village where moderately large lot residential development presently exists and where similar development appears likely to occur in the future.
   C.   Areas designated in the SR zoning district may or may not have, depending upon their location, at least partial access to public utilities.
   D.   To protect the character of the district, permitted activities are limited to single-family residential dwellings and certain specified other uses. All commercial activities are prohibited in the SR zoning district except for agricultural uses. (Ord. 2004-02, 2-2-2004)

11-6E-2: PERMITTED USES:

Permitted uses of structures and land, as hereinafter enumerated, shall be allowed in the SR district only in accordance with the conditions specified. The following uses constitute the only permitted uses in the SR zoning district:
Cultural, recreational and entertainment uses:
Athletic fields.
Gymnasiums, school and park.
Nature preserves and sanctuaries.
Parks and playgrounds.
Swimming clubs and pools.
Educational uses:
Elementary schools.
High schools.
Junior high schools.
Kindergartens.
Residential uses:
Garages, private residential.
Single-family dwellings.

11-6E-3: SPECIAL USES:

The special uses specified in the R-1 district (section 11-6A-3 of this chapter) shall likewise apply to the SR district. (Ord. 2004-02, 2-2-2004)

11-6E-4: TEMPORARY USES:

Temporary uses as enumerated in the R-1 district (section 11-6A-4 of this chapter) may be allowed in the SR district. (Ord. 2004-02, 2-2-2004)

11-6E-5: ACCESSORY USES:

Accessory uses as enumerated in the R-1 district (section 11-6A-5 of this chapter) may be allowed in the SR district. (Ord. 2004-02, 2-2-2004)

11-6E-6: SITE AND STRUCTURE REQUIREMENTS:

All uses of structures and land in the SR district shall conform to the following site and structure provisions:
   A.   Lot And Building Requirements:
      1.   Minimum Lot Area Per Principal Building: Fifteen thousand (15,000) square feet.
      2.   Minimum Lot Width: Ninety five feet (95').
      3.   Yards:
         a.   Front yard: Thirty feet (30').
         b.   Corner lot/side yard: Thirty feet (30').
         c.   Interior lot/side yard: Fifteen feet (15').
         d.   Rear yard: Forty feet (40').
         e.   Minimum green area in side yard: Five feet (5').
      4.   Height Limitations:
         a.   Principal structure: Thirty five feet (35').
         b.   Accessory structure: Fifteen feet (15').
   B.   Dwelling Standards:
      1.   Minimum square footage for dwelling floor area: One thousand nine hundred (1,900).
      2.   Maximum floor area ratio to lot area ratio, including garage and accessory buildings: 0.035. (Ord. 2004-02, 2-2-2004; amd. 2011 Code)

11-6E-7: DISTRICT STANDARDS:

All uses of structures and land in the SR district are subject to the general standards and regulations of this title. In addition, all uses located in the SR zoning district shall be subject to the R-1 district standards (section 11-6A-7 of this chapter). (Ord. 2004-02, 2-2-2004)

11-6F-1: PURPOSE AND DESCRIPTION:

The HD heritage district is intended to provide continuity for areas of the village existing as of January 1, 2004. To protect the character of the district, permitted activities are limited to single-family residential dwellings and those uses existing as of January 1, 2004. 11-6F-2: PERMITTED USES:

Permitted uses of structures and land existing as of January 1, 2004, shall continue and shall be henceforth considered and governed as legal nonconforming uses. (Ord. 2004-02, 2-2-2004)

11-6F-3: TEMPORARY USES:

Temporary uses, as hereinafter enumerated, may be allowed in the HD heritage district. The following uses constitute the only temporary uses allowed in the HD heritage district:
Block parties and street dances.
Christmas tree sales.
Contractor offices and equipment sheds when and where in service to an active Village-approved construction project.
Home and garage sales.

11-6F-4: ACCESSORY USES:

Accessory uses, as hereinafter enumerated, may be allowed in the HD heritage district. The following constitute the only accessory uses allowed in the HD heritage district:
Children's playhouses.
Garages, carports, and other parking facilities.
Gazebos and other similar structures.
Greenhouses, private.
Horses, subject to the following standards and conditions:
   A.   The property upon which horses are kept or maintained shall be no less than five (5) contiguous acres.
   B.   The subject property shall be under single ownership.
   C.   Up to two (2) horses shall be allowed on a qualifying five (5) acre property, plus one more horse for each additional acre of property to a maximum of five (5) horses.
   D.   Each horse shall be owned by the property owner. No animal shall be boarded for hire or used for the giving of lessons in horsemanship.
   E.   The keeping and maintenance of the property and these animals shall not be allowed to become a nuisance to other proximate residents and the village, generally. Due care shall be required to prevent odor and noise from emanating from the subject property.
   F.   All such animals shall be restrained or fenced.
Swimming pools and tennis courts.
Tool houses, sheds and other similar buildings.

         a.   Principal structure: Forty five feet (45').
         b.   Accessory structure: Twenty feet (20').

      1.   Minimum square footage for dwelling floor area: n/a.
