CHAPTER 7

C-1 GENERAL COMMERCIAL DISTRICT

11-7-1: PURPOSE AND DESCRIPTION:

   A.   The C-1 general commercial district is intended to provide a suitable setting for the commingling of a variety of retail shopping, commercial service, and small office uses capable of fulfilling most of the daily living requirements of village residents.
   B.   The regulations of the district are designed to accommodate retail and service commercial uses in a manner which will minimize interference with area traffic patterns and ensure a high standard of site layout, design, and landscaping.
   C.   The C-1 district is intended to be located only along or at the convergence of major arterial roadways where it can be sufficiently buffered from adjacent residential development.
   D.   A reference to "C-1 PUD" herein or on the Village's Zoning Map shall signify a parcel with an underlying C-1 General Commercial District zoning classification but which must be developed or redeveloped, as the case may be, as a planned unit development in accordance with the requirements set forth in Chapter 9, Planned Unit Developments, of Title 11, Zoning Regulations, including but not limited to obtaining the approval of the Village of a Final Detailed Plan as set forth in Section 11-9-5C1.

11-7-2: PERMITTED USES:

The only permitted uses of structures and land allowed in the C-1 general commercial district, as hereinafter enumerated, must be in accordance with the conditions specified below and as set forth herein. Each such use is contingent upon the Village's approval of a Final Detailed Plan as set forth in Section 11-9-5C1, as well as Final Systems Plans, Construction Plan, Construction Schedule Guarantee, Covenants and Provisions for Public Facilities, as set forth in Section 11-9-5C, for such use of a structure and land, and such use satisfying the terms, provisions and requirements for a planned unit development in Chapter 9, Planned Unit Development, of Title 11, Zoning Regulations:
Agriculture uses.
Cultural, recreational and entertainment uses (but no smoke shop/vape shop which is prohibited and is not a permitted or special use permitted in the Village).
Educational uses.
Health, medical and care facilities.
Office and professional uses.
Public and utility uses.
Religious uses.

11-7-3: SPECIAL USES:

The only special uses allowed in the C-1 general commercial district, as hereinafter enumerated, must be in accordance with all other provisions of this code and as set forth herein. Each such special use is contingent upon the Village's approval of a Final Detailed Plan as set forth in Section 11-9-5C1, as well as Final Systems Plans, Construction Plan, Construction Schedule Guarantee, Covenants and Provisions for Public Facilities, as set forth in Section 11-9-5C, with each special use also being subject to satisfying the terms, provisions and requirements for a planned unit development in Chapter 9, Planned Unit Development, of Title 11, Zoning Regulations:
Adult-use cannabis dispensing organization (not no smoke shop/vape shop).
Adult-use cannabis infuser organization.
Adult-use cannabis processing organization.
Adult-use cannabis transporting organization.
Cultural, recreational and entertainment uses:
   Amusement establishments.
   Amusement parks.
   Auditoriums, private.
   Country clubs.
   Miniature golf courses.
   Stables and riding academies.
Educational uses:
   Colleges and universities.
Health, medical and care facilities:
   Daycare centers.
   Nursery schools.
   Pharmacies.
Planned unit developments.
Religious uses:
   Chapels.
   Churches.
   Religious assembly halls and meeting rooms.
   Synagogues.
   Temples.
Retail business uses:
   Agriculture implement sales and service.
   Automobile, motorcycle and truck sales and service.
   Boat sales and service.
   Building materials and garden supply stores.
   Motor vehicle sales and service.
   Tire, battery and accessory sales and service.
Service uses:
   Animal hospitals and veterinary clinics.
   Animal pounds and shelters.
   Automobile repair and service.
   Automobile service stations.
   Banquet halls.
   Bars and taverns.
   Car wash facilities.
   Equipment rental and leasing.
   Hotels.
   Motels.
   Motor vehicle rental agencies.
   Parcel pick up and delivery services.
   Restaurants.

11-7-4: TEMPORARY USES:

Temporary uses (limited to less than 12 consecutive months), hereinafter enumerated, may be allowed in the C-1 general commercial district. The following uses constitute the only temporary uses allowed in the C-1 zoning district:
Block parties and street dances.
Carnivals and circuses.
Christmas tree sales.
Contractor offices and equipment sheds.
Real estate sales, offices and model units.
Temporary outdoor sales.
Tent theaters and meetings.

11-7-5: ACCESSORY USES:

The only accessory uses or structures which are allowed in the C-1 general commercial district, as hereinafter enumerated, shall be contingent upon the Village's approval of a Final Detailed Plan as set forth in section 11-9-5C1 depicting such accessory use or structure, and if any such accessory use or structure is being requested for a parcel for which a Final Detailed Plan has been approved, such accessory use or structure must be approved by the Village as a change to the existing Final Detailed Plan as set forth in Section 11-9-6, Changes, of Title 11, Zoning Regulations:
Agricultural buildings and structures.
Garages, carports and other parking facilities.
Radio, radar and television antenna towers and dishes.
Refuse disposal areas.
Tool houses, sheds and other similar buildings.

11-7-6: SITE AND STRUCTURE REQUIREMENTS:

All uses of structures and land in the C-1 general commercial district shall conform to the following site and structure provisions and each such use shall be contingent upon the Village's approval of a Final Detailed Plan for such use, as set forth in Section 11-9-5C1, as well as Final System Plans, Construction Plan, Construction Schedule Guarantee, Covenants and Provisions for Public Facilities as set forth in Section 11-9-5C and subject to the terms, provisions and requirements for a planned unit development in Chapter 9, Planned Unit Development, of Title 11, Zoning Regulations:
   A.   Minimum Area:
      1.   District: The minimum area that may constitute a separate or detached part of the C-1 zoning district shall not be less than four (4) acres. However, land zoned in the I-1 zoning district which immediately abuts land in the C-1 district may be included in the calculations in meeting the minimum district area.
      2.   Lot: No minimum lot area shall be required.
   B.   Minimum Lot Width: Each zoning lot shall be a minimum of one hundred feet (100') in width.
   C.   Maximum Lot Coverage: The maximum lot coverage of all principal and accessory buildings located on a zoning lot shall not exceed thirty five percent (35%) of the total area of the lot.
   D.   Maximum Floor Area Ratio (FAR): The maximum floor area ratio of all principal and accessory buildings located on a zoning lot shall not exceed forty percent (40%) of the total area of the lot.
   E.   Maximum Building Height: No principal building shall exceed thirty five feet (35') in height except for agricultural buildings and structures which shall not exceed sixty feet (60') in height and church steeples and towers which shall not exceed seventy five feet (75') in height.
   F.   Minimum Yard Requirements: The following minimum yards shall be provided and maintained:
      1.   Front And Corner Side Yards:
         a.   Buildings: All buildings shall be set back from the front lot line or a side lot line abutting a dedicated street a minimum of fifteen feet (15').
         b.   Parking: All off street parking and loading areas shall be set back from the front lot line or a side lot line abutting a dedicated street a minimum of ten feet (10').
      2.   Interior Side Yards:
         a.   Buildings: All buildings shall be set back from each interior side yard a minimum of ten feet (10').
         b.   Parking: All off street parking and loading areas shall be set back from each interior lot line a minimum of five feet (5'). However, where an interior side lot line abuts a residence zoning district, all off street parking and loading areas shall be set back a minimum of ten feet (10') from the abutting interior lot line.
      3.   Rear Yard:
         a.   Buildings: All buildings shall be set back from the rear lot line a minimum of fifteen feet (15').
         b.   Parking: All off street parking and loading areas shall be set back from the rear lot line a minimum of five feet (5'). However, where a rear lot line abuts a residence zoning district, all off street parking and loading areas shall be set back a minimum of ten feet (10') from the abutting lot line.

11-7-7: DISTRICT STANDARDS:

All uses of structures and land in the C-1 district are subject to the general standards and regulations of this title. In addition, all uses located in the C-1 district shall be subject to the following:
   A.   Site Plan Review: To ensure compliance with the applicable provisions of this title, any exterior construction, change in use, or increase in the intensity of an existing use, excluding normal maintenance activity, in the C-1 zoning district shall require site plan review by the village board.
   B.   Preliminary Development Plan Review: Prior to the commencement of construction activity, the village board shall approve a preliminary development plan for all areas located in the C-1 district. Such preliminary plan shall at a minimum include the following:
      1.   The anticipated location of all uses to be included in the proposed development;
      2.   The anticipated gross floor area of all buildings to be included in the proposed development;
      3.   The maximum building heights, perimeter setbacks, percent of open space and landscape treatment of the proposed development;
      4.   The impact of the development on the surrounding traffic network and proposed improvements to that network; and
      5.   A conceptual engineering plan indicating the anticipated location of all wells, septic fields or sewage treatment facilities and detention/retention facilities to be included in the proposed development.
   C.   Operation Within Enclosed Structure: All business, service, storage, and display of goods shall be conducted within completely enclosed structures, except:
Accessory uses, when allowed.
Agricultural uses.
Automobile service stations.
Motor vehicle rentals.
Motor vehicle sales.
Off street parking and loading.
Outdoor seating areas accessory to bars, restaurants and taverns.
Refuse disposal areas.
Sale or display of merchandise sold or offered for sale through vending machines, provided such machines do not occupy an aggregate ground area of more than sixteen (16) square feet.
Temporary uses, when allowed.
   D.   Exterior Lighting: All exterior lighting shall be shaded or inwardly directed in such a manner so that no direct lighting or glare is cast upon any adjacent residential or institutional property. The intensity of such lighting shall not exceed two (2) foot-candles as measured at the abutting property line.
   E.   Landscaping And Screening:
      1.   Landscaping:
         a.   All developments in the C-1 district shall be designed consistent with the landscaping code of the village.
         b.   Plantings shall be required for all landscaped areas within lots, including utility and drainage easements and setbacks.
         c.   Wherever possible, existing vegetation, such as mature trees, hedgerows and wetland plantings, shall be preserved and incorporated into the landscape design.
      2.   Screening:
         a.   Trash enclosures, utility boxes, meters, pedestals, and loading service areas must be screened from adjacent properties, public rights of way, parking areas and pedestrian walkways. Screening shall consist of a solid wall or fence, or landscape material, equal in height or taller than the material being screened.
         b.   Refuse or trash collection areas shall be provided at the rear of each structure or positioned in or near the common parking lot or a driveway, as recommended by the commission, and shall be completely screened from view on all sides, with solid fencing of masonry construction, to a height of seven feet (7'); and shall include concrete pad and a solid operable door of adequate width. Each refuse area shall be provided with a closed and covered trash container of a type and size pursuant to village ordinances. It shall be the responsibility of the owner and/or manager of the property to ensure the refuse areas are kept in a neat and well ordered manner at all times. The owner and/or manager of the structure shall ensure that any spillover at the time of refuse removal is promptly and properly cleaned up, and that refuse is removed on a regular basis pursuant to village ordinances.
         c.   Overnight truck and semitrailer outdoor parking and storage is prohibited. Overnight truck and semitractor trailer parking and storage shall be permitted within an enclosed loading dock, garage or within a walled and gated sight screen enclosure. Said enclosure shall be open to the sky and constructed of the same masonry exterior materials as the principal building and of a height equal to the height of the first floor of the principal building. Temporary overnight parking, not to exceed forty eight (48) hours, may be permitted for delivery vehicles which arrive after normal business hours.
         d.   The outdoor storage of any materials is prohibited. (Ord. 2004-02, 2-2-2004)
   F.   Architectural Standards: Construction of all commercial buildings within a business district shall be constructed pursuant to the following architectural standards:
      1.   The building shall be compatible to surrounding buildings to maintain the character of the area. Visual interest and pedestrian scale shall be considered in the site layout. The rear and sides of a building shall have architectural features similar in quality and design to the front of the building.
      2.   The building shall be face brick on all elevations, provided they are visible to public areas. Other masonry materials may be considered if the building area is over seventy five thousand (75,000) square feet. Accent features may be other materials; however, the amount of EIFS, dryvit, and standing seam metal shall be limited. Architectural shingles, synthetic slate or slate shall be used on roofs.
      3.   Architectural features shall break up the building massing. The use of columns, brick patterns, windows, false windows, medallions, cornices, pilasters, quoins, decorative lighting, and protrusions must provide interest in the building elevations. The roofline must also be varied. A full pitch roof is preferred; however, other roof types will be considered. All mechanical equipment shall be screened from view on all sides of the building through the use of parapet walls or appropriate screening.
      4.   The building color shall blend into surrounding buildings and the natural environment. The predominant color for most buildings shall be relatively subtle; the natural brick or stone colors of red, gray and brown shall predominate. Darker or brighter accent colors may be used, provided they are not garish or overpowering. Brick, stone, and glass and the surfaces shall not be painted. All service doors shall be painted to match the building. Window glazing shall be clear or slightly tinted, not dark or reflective. Building color schemes approved by the village board shall not be altered without prior approval from the village board.
      5.   Awnings and canopies shall be in character with the architectural style of the building. Awnings and canopies shall be positioned at least eight feet (8') above the sidewalk 1 . Awnings shall fit within the frame of the storefront; they shall not hide the building facade, distort its proportions, or cover architectural features. Where several storefronts are developed as a single building, they shall have awnings of the same style and similar color. Adjacent buildings developed at different times shall have awnings of a compatible style and color scheme. Awnings shall be made of canvas or a durable fabric material that can be easily cleaned. Awning frames shall be an accessory to the building facade and not a permanent feature.
      6.   Street furniture (benches, trash receptacles, lighting, walkways, etc.) shall be considered when designing commercial centers and shall be required in certain developments. Bicycle racks shall be required for developments adjacent to bike paths. Bicycle racks shall be located near the entrances of buildings, convenient for riders to use.
   G.   Signs: All uses shall conform to the applicable sign requirements set forth in this code. (Ord. 2004-02, 2-2-2004; amd. 2011 Code)
