CHAPTER 1165

B3 Central Business District

1165.01 PURPOSE.

   The Central Business District is intended to support and encourage existing and future businesses and reflect revitalization standards and strategies in the concentration of retail, service, office, institutional, commercial, recreational and cultural facilities that are compatible in the uptown area of the community.

1165.02 PERMITTED USE.

   The following uses shall be permitted in the B3 Central Business District. The Zoning Administrator may determine if a use not listed shall be similar to or compatible to other permitted uses listed.
   Dwellings:
   (a)    Single-Family detached - Existing single-family dwelling uses only.
   (b)    Two-Family - Not permitted within the Uptown Commercial Overlay District.
   (c)   Multi- Family:
      (1)    Only permitted in multi-story buildings.
      (2)    Only permitted on second stories or above if located within the Uptown
         Commercial Overlay District.
      Civic, Social or Fraternal Associations
      Co-Working Spaces
      Design Studios - Small-scale only
      Fitness Studios - Similar uses such as yoga, Pilates, martial arts and dance
      Funeral Homes - Except Crematories
      Institutional/Government Offices
      Libraries
   Maker Spaces - Small-scale only
   Micropigmentation Service - Only for the use for cosmetic/permanent makeup
   Medical and Dental Offices/Clinics
   Museums/ Art Galleries
   Personal Services
   Personal Training Services - This would include uses similar to dance or martial
   art studios
   Pet Groomer - No outdoor kennels
   Pharmacy/Drug Stores
   Post Office
   Professional Offices
   Religious/Places of Worship
   Restaurant - Dine-in/Take-out without drive-thru
   Retail Sales
   Veterinarian Animal Hospital and/or Animal Clinic - No outdoor kennels

1165.03 CONDITIONAL USE.

   The following conditional uses shall be allowed in the B3 Central Business District, subject to approval in accordance with Section 1138.06. The Zoning Administrator may determine if a use not listed shall be similar to or compatible to other permitted uses listed.
   Automotive Repair Services - Not permitted within the Uptown Commercial
   Overlay District
   Bars, Pubs, Saloons or Taverns - Establishment that its primary source of
   revenue is the sale or serving of alcohol.
   Event Venue/Banquet Hall - Rental - Indoor Only
   Microbreweries, Micro-distilleries, Micro-wineries, Brewpubs - These establishments must include an attached restaurant for the on-site consumption of food and beverages, which shall be a minimum of 20% of the total sguare footage of the entire facility.
   Pay to Park - Parking lots - Not permitted within the Uptown Commercial Overlay District
   Performance Venue - Indoor only within the Uptown Commercial Overlay District.
(Excluding Adult Entertainment)
   Private/Social Clubs - Including, where members purchase, consume or store alcohol Restaurant- Dine-in/Take-out with drive-thru
   Tattoo Shops/Parlors

1165.04 DEVELOPMENT STANDARDS FOR PERMITTED USE.

   In addition to the provisions of Chapter 1183 and Section 1185.03, the following standards for arrangement and development of land and buildings shall be required in the B3 Central Business District.
   (a)   Intensity of Use. No minimum lot size is required; however, lot size shall be adequate to provide yard spaces required by these development standards.
   (b)   Lot Width. No minimum lot width is required; however, all lots shall abut a street.
   (c)   Side Yards. A side yard shall be required adjacent to a residential zoning district or a planned residential zoning district as listed in Section 1178 and 1179. Such side yards shall be not less than one-fourth the sum of the height and depth of the building, but in no case shall be less than fifteen feet.
   (d)   Rear Yard. A rear yard shall be required adjacent to a residential zoning district or a planned development zoning district as listed in Section 1178 and 1179. Such required rear yards shall be not less than one-fourth the sum of the height and width of the building, but in no case shall be less than twenty feet. A use to be serviced from the rear shall have a service court, alleyway or combination thereof not less than forty feet in width.
   (e)   Front Building Setback. No building or use shall be located further than ten (10) feet from the right-of-way line of the adjacent public or private road and no portion of the building set back area shall be used for any parking, loading or unloading purposes. Buildings located on corner lots shall maintain the same building setbacks from the right-of-way lines of the adjacent public or private roads and no portion of this building setback area shall be used for any parking, loading or unloading purposes.
   (f)   Building Size. No building shall exceed 5,000 square feet in first floor area.
   (g)   Building Height. No building shall exceed 50 feet in height.
   (h)   Building Appearance. New buildings shall be architecturally compatible with existing buildings in the immediate vicinity.

1165.05 DEVELOPMENT STANDARDS FOR CONDITIONAL USE.

   In addition to the preceding regulations and the provisions of Chapter 1183 and Section 1185.03, additional standards established by the Board of Appeals for approved Conditional Uses shall be required in the B3 Central Business District.
