CHAPTER 1151

RS3 Old Town Residential District

1151.01 PURPOSE.

   The Old Town Residential District (RS3) is provided for the oldest residential neighborhoods in Plain City, which contains a variety of home sites including both one and two family residential units, comprised of various configurations based on original platted lots which fail to meet the current development approaches. The RS3 District is intended to protect and preserve the existing neighborhoods and encourage reinvestment by providing uniform and flexible development standards. The RS3 District is not intended to be used in newly developing areas of the Municipality. (Ord. 05-08. Passed 2-25-08.)

1151.02 PERMITTED USE.

   Land and buildings in the RS3 Old Town Residential District shall be used only for the following purposes:
   (a)    Dwelling Structures. Single-family dwelling structures.
   (b)   Accessory Uses. Accessory buildings and uses in association with permitted dwellings as specified in Section 1183.05 .

1151.03 CONDITIONAL USE.

   The following uses shall be allowed in the RS3 Old Town Residential District subject to approval in accordance with Section 1138.06.
   (a)   Elementary and Secondary Schools. No rooms shall be regularly used for housing or sleeping of students.
   (b)   Public and Private Parks and Public Recreational Facilities.  
   (c)   Religious. Church or other place of worship.
   (d)   Child Day Care Services. (8351)
   (e)   Two-Family Residences (duplexes). Subject to the following:
      (1)   A minimum lot area of 8,000 square feet and a minimum lot width of fifty feet are provided.
      (2)   A minimum floor area of 800 square feet per unit is provided.
      (3)   A firewall meeting the Building Inspector's specifications is provided along any proposed common wall.
      (4)   Separate utilities and meters are provided for each unit.
      (5)   Detailed street elevation plans are provided with the conditional use permit application.
      (6)   The proposed twin single, duplex or similar structure does not substantially depart from or detract from the character of the area.
      (7)   A minimum of four off-street parking spaces is provided per structure.
      (8)   A minimum side yard setback of 8 feet or more on each side and a minimum rear yard setback of 15 feet or more are provided.
   (f)   Bed and Breakfasts.
   (g)   Home Occupation. Home occupation in association with a permitted dwelling, and in accordance with the provisions of Section 1183.13.
   (h)   Accessory dwelling unit. Accessory dwelling units may be constructed in accessory structures provided they meet the requirements of Section 1183.05 and other additional requirements determined appropriate by the Board of Zoning Appeals.

1151.04 DEVELOPMENT STANDARDS FOR PERMITTED USES.

   In addition to the provision of Chapter 1183, the following standards for arrangement and development of land and buildings shall be required for permitted uses in the RS3 Old Town Residential District.
   (a)   Lot Area and Coverage. For each dwelling unit there shall be a lot area not less than 5,000 square feet. Only one principal use shall be permitted on a lot, and such lot shall not be covered more than thirty-five percent (35%) by structure.
   (b)   Lot Width. For a dwelling there shall be a lot width of fifty (50) feet or more at the front line of the dwelling, and such lot shall have access to and abut on a public right of way for a distance of fifty (50) feet or more.
   (c)   Front Yard Setback. For dwellings there shall be a front yard setback of twenty (20) feet or more as measured from the street right of way line.
   (d)   Side Yard Setback. For dwellings or associated accessory buildings there shall be a side yard setbacks of five feet or more on each side as measured from the side lot line.
   (e)   Rear Yard Setback. For dwellings there shall be a rear yard setback of fifteen feet or more as measured from the rear lot line. For associated accessory buildings there shall be a rear yard setback of five feet or more as measured from the rear property line.
   (f)   Maximum Height. No dwelling structure shall exceed thirty-five feet in height. Height of other structures shall not exceed the height of the dwelling structure.

   The Development Standards for Conditional Uses are provided for in Chapter 1183.
