DETAILED SITE PLANS
Detailed Site Plan review is intended to assess compliance of a proposed development with the specific use, dimensional and other regulations of this Code and the terms of any prior approval of the project, including a Planned Development Site Plan. Therefore, Detailed Site Plans shall be designed to show the specific arrangement of the buildings and other improvements on a site in relation to each other, existing site conditions, and surrounding property, together with specific information on the nature and intensity of land use. Detailed Site Plans shall be generally required:
(1)
Prior to the application for a Building Permit, except as noted in Section 102-901 below;
(2)
Prior to the establishment or expansion of a Special Exception use; and
(3)
Prior to the establishment or expansion of any use (see Section 102-902).

(a)
Application submittal. The application for Detailed Site Plan review shall be submitted on a form prescribed by the City. A developer may submit an application for approval of a Detailed Site Plan and of a Building Permit concurrently, at his or her own risk; provided that no Building Permits shall be issued until the Detailed Site Plan is approved. City Staff shall review the Detailed Site Plan for conformance with the City Code, including any Planned Development Site Plan, if applicable.
(b)
Submittal Requirements. A Detailed Site Plan shall be submitted to the City Planning and Zoning Division. At a minimum, the Detailed Site Plan shall contain the following information:
(1)
Name and address of the applicant and property owner;
(2)
Boundary lines of the site, including dimensions and legal description;
(3)
Adjacent streets, easements, north arrow, scale, topography, date prepared and any revision date(s);
(4)
Location, arrangement, size and height of all proposed structures with identification of proposed uses contained thereon;
(5)
Square footage and floor area ratio of all proposed nonresidential uses;
(6)
Location and total number of residential units proposed and the gross density of the development;
(7)
Open space percentage and uses, walkways, sidewalks, service areas, fire lanes and parking spaces, including number and size of parking spaces required and provided;
(8)
Location and size of all proposed roads and access driveways, fences or walls, buffering and landscaped areas, solid waste disposal sites, and signs;
(9)
Identify the 5 inch and larger caliper trees on site and those trees to be removed or replaced and landscaping to be planted, materials to be utilized, etc.;
(10)
Location and size of all utility lines and fire hydrants;
(11)
Location and size of all existing or proposed environmental areas, including identification of areas designated by the Southwest Florida Water Management District or the Environmental Protection Commission of Hillsborough County, as appropriate, to be of high aquifer recharge/contamination potential mitigation areas or retention/detention ponds; and
(12)
Other requirements as provided by staff.

(a)
Detailed Site Plan Evaluation. Detailed Site Plans shall be evaluated based upon the following criteria for approval, where applicable:
(1)
Whether the plan meets the requirements of the land development code and other city code requirements;
(2)
Whether the proposed development is consistent with the comprehensive plan;
(3)
Whether the proposed development is consistent with prior applicable approvals, including any Planned Development Site Plan; and
(4)
Whether the proposed development meets the level of service standards adopted in the comprehensive plan.
(b)
Staff Review of Detailed Site Plan. Following its review, the City Manager, after approval from the appropriate City Staff, shall either approve, approve with conditions, or disapprove the Detailed Site Plan and, if approved, shall issue a letter of authorization for construction.
(c)
Appeal Procedure of Detailed Site Plan. Appeal of the decisions related to the Detailed Site Plan shall be made in accordance with Section 102-69 of this Chapter.

(a)
Approval of the Detailed Site Plan authorizes the applicant to proceed with an application for Building Permit. Any comments issued by the City staff will need to be addressed prior to the approval of the Building Permit. Prior to commencement of construction activities authorized with the approved Detailed Site Plan, an erosion and Sediment Control Plan shall be approved by the City Manager. Developments requiring approval of construction drawings, and similar approvals, may be processed concurrently with the Detailed Site Plan, within the discretion of the City Manager.
(b)
Expiration and Extension of Detailed Site Plans.
(1)
Detailed Site Plan approvals shall expire in five years, except as provided below.
(2)
The City Manager may, as a condition of approval of a Detailed Site Plan, establish an expiration date that is sooner than otherwise required pursuant to this Section, in order to ensure prompt compliance with the Code in a case involving code enforcement action, or to further the public health, safety and welfare.
(3)
The expiration date of a Detailed Site Plan may be extended by the City Manager for a period of one year if the developer has proceeded in good faith and upon consideration of external issues such as the state of the economy or environmental calamities which may have affected the build out period. The expiration date of a Detailed Site Plan shall be scheduled to expire concurrently with the expiration of concurrency approval. The expiration date for any approved site plan may be extended for a period longer than five years, in connection with a local development agreement.
