- GENERAL ZONING PROVISIONS
This Zoning Title, including the Zoning District Map made a part hereof and adopted hereby by reference, shall be known, cited, and referred to as the Village of Poplar Grove's Zoning Ordinance.

This title is enacted pursuant to the authority granted by the State of Illinois Statutes. Specific statutory references are provided within the body of this Title solely as a means of assisting the reader. References are not to be considered as all-inclusive and shall in no manner be construed so as to limit the application or interpretation of this Title.

This comprehensive amendment to the Village of Poplar Grove's Zoning Ordinance is adopted for the following purposes:
A.
To promote and protect the public health, safety, morals, convenience and general welfare of the people.
B.
To secure adequate natural light, pure air and safety from fire and other dangers.
C.
To divide the Village of Poplar Grove into zones or districts, prescribing and regulating the location, erection, reconstruction, alteration and use of buildings, structures and land for residential, business, manufacturing and other specified uses.
D.
To fix reasonable standards to which buildings and structures shall conform; and provide that alterations or remodeling of existing buildings or structures be conducted in accordance with current standards as set forth herein.
E.
To protect the character and maintain the stability of residential, business and industrial areas within the Village of Poplar Grove and to promote the orderly development of the areas.
F.
To lessen or avoid the hazards to persons and damage to property resulting from the accumulation or runoff of storm or flood waters.
G.
To limit congestion in the public streets and highways.
H.
To regulate and limit the intensity of use of land.
I.
To establish building setback lines along streets and traffic-ways and to regulate the location of structures designed for residential, business and manufacturing or other uses within such areas.
J.
To prohibit uses or structures which are incompatible with the character of other appropriate existing or intended uses within specified zoning districts.
K.
To provide for the gradual elimination of those existing uses of land, buildings and structures that do not conform to the standards of the zoning district in which they were are located.
L.
To conserve and enhance the taxable value of land and buildings throughout the Village of Poplar Grove.
M.
To define and limit the powers and duties of the administrative officers and bodies as provided herein.

In their interpretation and application, the provisions of this title shall be held to be the minimum requirements for the promotion of the public health, safety, morals and welfare, and shall be in favor of the Village and not be considered a limitation of any other power the Village may possess.
A.
Where property is affected by the regulations imposed by any provision of this title and by other governmental regulations, the regulations which are more restrictive or which impose higher standards or requirements shall prevail.
B.
No building, structure, or land shall hereafter be used or occupied, and no building or structure or part thereof, shall hereafter be constructed, moved, or structurally altered except in conformity with all of the regulations specified for the district in which it is located.
C.
Except as provided in this Title under Chapter 9. Nonconforming Uses, no building, structure, development or premises shall be hereinafter used or occupied and no applicable permit issued that does not conform to the requirements of this title.
D.
In cases of mixed-occupancy or mixed-use buildings or parts thereof, the regulations for each land use shall apply to that portion of the structure or land so occupied or so used.
E.
Except for outlots authorized under the Village's Subdivision Regulations to contain permanently protected green space area, no yard or other open space shall be considered as providing a yard or open space for a building or structure on any other lot.

This title and any amendment hereto are declared to be severable. If any part, sentence, paragraph, subsection, section or clause is adjudged unconstitutional or invalid, it is hereby provided that the remainder of this chapter or amendment shall not be affected thereby. If any part, sentence, paragraph, subsection, section or clause is adjudged unconstitutional by a court of competent jurisdiction or invalid as applied to a particular property, building or other structure, it is hereby provided that the application of such portion of this chapter to other property, buildings or structures shall not be affected thereby.

All prior ordinances or parts of ordinances of the Village of Poplar Grove in conflict herewith are hereby repealed.
