- ADMINISTRATION AND ENFORCEMENT
A.
Establishment. The office of Zoning Administrator is hereby established. For the purpose of this section, the Building Official, hereinafter referred to as Zoning Administrator shall serve in this capacity. Such other employees of the office of the Zoning Administrator shall be hired by the Zoning Administrator with the approval of the Village Board.
B.
Duties. The Zoning Administrator shall administer the Zoning Ordinance and in addition, he or she shall:
1.
Receive, file, and forward to the Planning and Zoning Commission all applications and petitions for appeals, variations, or for other matters on which the Planning and Zoning Commission is required to act under the Zoning Ordinance.
2.
Receive, file and forward to the Planning and Zoning Commission all applications for amendments, planned community developments, special uses, or for other matters which under the Zoning Ordinance require referral to the Planning and Zoning Commission.
3.
Maintain permanent and current records of the Zoning Ordinance, including but not limited to maps, amendments, rules or practice and procedure of the Planning and Zoning Commission, variations, appeals, and applications for any of the above, and records of hearings thereon including the recording of district amendments and special uses on the zoning district map.
4.
Maintain all zoning records which are a part of the administration of the Zoning Ordinance.
5.
Decide or make recommendations on all other matters under the Zoning Ordinance upon which the Zoning Administrator is required to act.
6.
Initiate, direct and review from time to time, a study of the provisions of the Zoning Ordinance, and make reports of his or her recommendations to the Planning and Zoning Commission and the Village Board.
7.
Assist the office of the Village Attorney in the development of proposed amendments to the provisions of the Zoning Ordinance as may be necessary from time to time.
8.
Update and publish changes to the Zoning Ordinance.
9.
Update and publish the zoning district map annually per state statutes.
10.
Provide and maintain public information service relative to matters arising out of the Zoning Ordinance.
11.
Give assistance to the Zoning Enforcement Officer.

A.

B.
Duties. The Zoning Enforcement Officer shall enforce the Zoning Ordinance, and in addition, he or she shall:
1.
Examine and approve an application pertaining to the use of land or structures when the application complies with the provisions of the Zoning Ordinance.
2.
Issue zoning certificates and perform similar administrative duties as permissible under law, make and maintain records thereof.
3.
Provide inspection of structures and uses of land to determine compliance with the terms of the Zoning Ordinance, and where there are violations, initiate action to secure compliance.
4.
Order discontinuance of illegal uses of land, buildings, or structures.
5.
Order removal of illegal buildings or structures or illegal additions or structural alterations.
6.
Order discontinuance of any illegal work being done.
7.
Take any other action authorized by the Zoning Ordinance to ensure compliance with or to prevent violation(s) of the Zoning Ordinance.
8.
Call on the Village Attorney to institute necessary legal proceedings to enforce the provisions of this chapter. The Zoning Enforcement Officer may call on the Police Department to assist in the enforcement of this chapter.
9.
Give assistance to the Zoning Administrator.

A.
Violation of the Zoning Ordinance. It shall be unlawful to construct or use any land, engage in any development activity (including disruption of protected vegetation), or construct or use any structure, land or water in violation of any of the provisions of the Zoning Ordinance, or otherwise neglect, refuse or fail to comply with the Zoning Ordinance's requirements. Any person who violates or fails to comply with any of the provisions of the Zoning Ordinance shall, upon conviction thereof, be subject to the penalties set forth in Section 8-4-3D, and in addition, shall pay all costs and expenses, including actual reasonable attorney and other fees involved in the case. Each day a violation exists or continues shall constitute a separate offense.
B.
Abatement. In addition to any other penalty imposed by this section for a violation of the provisions of the Zoning Ordinance, the Village reserves and maintains the continued right to abate violations of the Zoning Ordinance.
C.
Violation Causing Non-Hazardous Condition. If the Zoning Enforcement Officer determines that a violation of the Zoning Ordinance exists, and further determines that the nature of the violation does not pose great and immediate danger to the public health, safety, peace, morals or decency, the Zoning Enforcement Officer shall serve written notice by registered mail to the current owner of the property (as indicated by current tax rolls) or occupant of the property on which the violation is occurring to remove the violation within ten working days. If the violation is not removed within such ten working days, the Zoning Enforcement Officer shall cause the violation to be abated. Costs associated with the abatement shall be charged to the owner of the property which violation has occurred per Section 8-4-3D.
D.
Penalties. Failure to comply with any of the requirements of this chapter shall constitute a violation, and any person, upon conviction, shall be fined not less than $100.00 nor more than $750.00 for each offense. Each day the violation continues shall be considered a separate offense. The owner or tenant of any building, structure, premises or part thereof and any architect, builder, contractor, agent or other person who commits, participates in, assists in or maintains such violations may each be found guilty of a separate offense and subject to such penalties. The Village may also take other lawful action as is necessary to prevent or remedy any violation.

Any person, firm, or corporation who fails to comply with the provisions of the Zoning Ordinance shall pay a fine as determined by a court of competent jurisdiction for each offense plus costs of prosecution, including but not limited to attorney's fees. A failure to pay fines and costs as ordered by a court of competent jurisdiction is subject to a finding of contempt. Each day a violation exists or continues shall constitute a separate offense.
