CHAPTER 1260

BUSINESS "A" DISTRICT

§ 1260.01 PURPOSE.

   The purpose of the Business "A" District is to provide places for businesses that are enclosed in buildings and that are small in size; to provide convenience goods and services to local residents; and to identify businesses which can be located close to residential properties without being detrimental to the residential neighborhood.

§ 1260.02 PRINCIPALLY PERMITTED USES.

   The following uses shall be permitted as of right:
   (A)   Retail business; less than 5,000 square feet in floor area.
   (B)   Personal services.
   (C)   Professional services.
   (D)   Child day care center.
   (E)   Studio for art, music or photography.
   (F)   Professional office.
   (G)   Religious places of worship.
   (H)   Residential dwellings; located on the second or third stories.

§ 1260.03 ACCESSORY PERMITTED USES.

   (A)   The following uses shall be permitted as accessory to a principal use:
      (1)   Signs; pursuant to Chapter 1290.
      (2)   Home occupation; pursuant to Chapter 1282.
      (3)   Satellite dish; pursuant to Chapter 1282.
      (4)   Fences and walls; pursuant to Chapter 1282.
      (5)   Uses, buildings and structures incidental to a principally permitted use.
   (B)   Accessory uses and buildings shall be incidental and subordinate in height, area, bulk, extent and purpose to the principal use. Accessory buildings shall not be erected prior to the principal building.

§ 1260.04 CONDITIONALLY PERMITTED USES.

   The following uses shall be permitted only after approval by the Board of Zoning Appeals pursuant to the conditional use permit process as established in Chapter 1244.
   (A)   Club.
   (B)   Government buildings.
   (C)   Mixed uses.
   (D)   Financial institution.
   (E)   Medical and dental clinic.
   (F)   Fast food restaurant.
   (G)   Commercial entertainment; excluding sexually oriented businesses.
   (H)   Commercial recreation.
   (I)   Nursing home.
   (J)   Public and institutional uses.

§ 1260.05 DEVELOPMENT STANDARDS.

   (A)   Property development standards. The following development standards shall apply to properties located within the Business "A" District.

5 feet unless a portion of the road frontage is in a residential district, then the front yard setback shall be that of the most restrictive residential district that it abuts

None unless abutting a residential district, then 5 feet each side yard.
5 feet for accessory uses
Minimum Rear Yard Setback
None unless abutting a residential district, then 25 feet. If abutting a street, 5 feet.

   (B)   Minimum off-street parking and loading standards. Minimum off-street parking and loading standards shall be as regulated by Chapter 1280.
   (C)   Buffer requirements. Buffer requirements shall be as regulated by Chapter 1276.
