CHAPTER 1264

BUSINESS "C" DISTRICT

§ 1264.01 PURPOSE.

   The purpose of the Business "C" District is to provide places for businesses which serve regional markets; provide goods and services to other businesses, as well as consumers; provide services to automobiles; and serve the traveling public.

§ 1264.02 PRINCIPALLY PERMITTED USES.

   The following uses shall be permitted as of right:
   (A)   Retail business.
   (B)   Personal services.
   (C)   Professional services.
   (D)   Financial institutions.
   (E)   Medical and dental clinic.
   (F)   Restaurant.
   (G)   Fast food restaurant.
   (H)   Commercial recreation.
   (I)   Commercial entertainment; excluding sexually oriented businesses.
   (J)   Child day care center.
   (K)   Studio for art, music or photography.
   (L)   Auditorium.
   (M)   Club.
   (N)   Nursing home.
   (O)   Professional office.
   (P)   Religious places of worship.
   (Q)   Government buildings.
   (R)   Public parking garage or lot.
   (S)   Animal hospital/kennel.
   (T)   Delivery services business.
   (U)   Greenhouse and plant nursery.
   (V)   Hotel/motel.
   (W)   Funeral home.
   (X)   Service business.

§ 1264.03 ACCESSORY PERMITTED USES.

   (A)   The following uses shall be permitted as accessory to a principal use:
      (1)   Signs; pursuant to Chapter 1290.
      (2)   Satellite dish; pursuant to Chapter 1282.
      (3)   Fences and walls; pursuant to Chapter 1282.
      (4)   Uses, buildings and structures incidental to a principally permitted use.
   (B)   Accessory uses and buildings shall be incidental and subordinate in height, area, bulk, extent and purpose to the principal use. Accessory buildings shall not be erected prior to the principal building.

§ 1264.04 CONDITIONALLY PERMITTED USES.

   The following uses shall be permitted only after approval by the Board of Zoning Appeals pursuant to the conditional use permit process as established in Chapter 1244.
   (A)   Tavern, bar or lounge.
   (B)   Mixed uses.
   (C)   Shopping center.
   (D)   Recycling station for aluminum products.
   (E)   Automobile filling station.
   (F)   Automobile sales and service of new cars, boats and recreational vehicles.
   (G)   Automobile sales and service of used cars, boats and recreational vehicles.
   (H)   Public and institutional uses.

§ 1264.05 DEVELOPMENT STANDARDS.

   (A)   Property development standards. The following development standards shall apply to properties located within the Business "C" District.

Minimum Front Yard Setback
5 feet unless a portion of the road frontage is in a residential district, then the front yard setback shall be that of the most restrictive residential district that it abuts
No accessory uses permitted in the front yard
Minimum Side Yard Setback
None unless abutting a residential district, then 5 feet each side yard.
5 feet for accessory uses
Minimum Rear Yard Setback
None unless abutting a residential district, then 25 feet. If abutting a street, 5 feet.
5 feet for accessory uses
 
   (B)   Minimum off-street parking and loading standards. Minimum off-street parking and loading standards shall be as regulated by Chapter 1280.
   (C)   Buffer requirements. Buffer requirements shall be as regulated by Chapter 1276.
