ARTICLE XVII

ENFORCEMENT

Sec. 34-503.- Enforcement of chapter.

It shall be the duty of the building inspector, with the aid of the police department, to enforce this chapter in accordance with the administrative provisions of this Code and this chapter.

Sec. 34-504. - Application for building permit.

Every application for a building permit shall be accompanied by plans in duplicate and plot plan drawn to scale in ink or blue print, showing the actual shape and dimensions of the lot to be built upon, the exact location, size and height of the building or structure to be erected or altered, the existing and intended use of each building or part, the proposed number of families or housekeeping units, and such other information with regard to the lot and neighboring lots as may be necessary for the enforcement of this chapter. One copy of such plans shall be signed and returned to the applicant when approved by the building inspector together with such permit as may be granted.

Sec. 34-505. - Survey and marking of property.

Prior to building construction, stakes based on actual survey shall be set and shall be maintained in their proper located on the property during construction.

Sec. 34-506. - Certificate of occupancy.

Before using any building or premises or part thereof hereafter created, erected, changed, converted or enlarged in use or structure, a certificate of occupancy shall be obtained from the building inspector. Such certificate shall show that such building or premises, or part thereof, and the proposed use thereof conform with the provisions of this chapter.

Sec. 34-507. - Violation of chapter; penalty.

Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with any of the provisions of this chapter shall, upon conviction, be fined not less than $50.00, or more than $500.00 for each offense. Each day that a violation continues shall constitute a separate offense.

Sec. 34-508. - Remedy of violation.

In case any building or structure is erected, constructed, reconstructed, altered, repaired, converted or maintained, or any building, structure or land is used in violation of the provisions of this chapter, the city attorney, in addition to other remedies under law is hereby authorized to institute an action to enjoin, or any other appropriate action or proceeding to prevent such erection, construction, reconstruction, alteration, repair, conversion, maintenance or use.
