ARTICLE II

DISTRICTS AND MAP

Sec. 34-59.- Districts designated.

(a)

For purpose of this chapter, the following districts are designated:

(1)

A-1 Agricultural District;

(2)

R-1 One-Family Residence Districts;

(3)

R-2 Two-Family Residence Districts;

(4)

R-3 One- and Two-Family Residence Districts;

(5)

R-4 Multifamily Residence Districts;

(6)

B-1 General Business Districts;

(7)

B-2 Community Business Districts;

(8)

M-1 Light Industrial Districts;

(9)

M-2 General Industrial Districts;

(10)

MU-1 Mixed Use District.

(b)

An A-1 Agricultural District classification shall be available only to land upon its initial annexation into the city and an A-1 district classification shall not be applied to or granted to any parcel, lot or land which has previously been within the city limits and classified under this article as any other district or zone classification, and an A-1 Agricultural District classification shall not be available to nor granted on any application for change of zoning classification from such other district classification.

Sec. 34-60. - Zoning map.

The boundaries of these districts are hereby established as shown on a map entitled "zoning map," which accompanies and is hereby made a part of this article. The district boundary lines on said map are intended to follow lot lines, the centerlines of streets or alleys, the centerlines of streets or alleys projected, railroad rights-of-way, or the corporate limit lines, all as they existed at the time of enactment of this article; but where a district boundary line does not clearly coincide with lot lines, it shall be determined by scaling.

Sec. 34-61. - District boundaries—Division between lots.

Where a district boundary line divides a lot which was in single ownership and of record at the time of enactment of the ordinance from which this article is derived, the use authorized on and the other district requirements applying to the less restricted portion of such lot shall be considered as extending to the entire lot, provided that where the more restricted portion of such lot is more than 50 feet beyond such dividing district boundary line, such less restricted use shall be limited to the portion of the lot lying within 50 feet of such boundary line.

Sec. 34-62. - Same—Zoning board of appeals to determine.

Questions concerning the exact location of district boundary lines shall be determined by the zoning board of appeals according to rules and regulations which it may adopt, as hereinafter provided under section 34-541.

Sec. 34-63. - Classification of annexed territory.

All territory which may hereafter be annexed to the city shall be classified as R-2 Two-Family Residence District until such classification shall have been changed by amendment or unless changed by specific action of the city council at the time of approval of the annexation. Any change to a classification different from R-2 shall only occur following the procedure for amendment or district zoning classification change as required and set out in article XIX of this chapter.
