ARTICLE V

- R-1 ONE-FAMILY RESIDENCE DISTRICTS

Sec. 34-156.- Scope.

The provisions of this article apply to the R-1 One-Family Residence Districts.

Sec. 34-157. - Permitted principal uses.

The following are permitted principal uses:

(1)

One-family detached dwellings.

(2)

Any buildings or structures occupied by or used for churches, Sunday schools, parish houses, public and parochial schools, public libraries, museums, art galleries and similar public cultural uses, located not less than 20 feet from any side lot line in any R district.

(3)

Essential services, as defined in section 34-11 and municipal administrative of public service buildings or properties, except such uses as storage yards, warehouses, garages or other uses customarily conducted as gainful business, provided any building is located not less than 20 feet from any lot in any R district.

(4)

Public parks, playgrounds and community centers.

(5)

Gardening and general farming, but not confinement feeding operations.

(6)

Hay baling as permitted by section 34-434.

Sec. 34-158. - When authorized by board of appeals.

The following uses shall be permitted by special use permit only:

(1)

Branch telephone exchanges, electric substations and booster or pressure regulating stations, without service yard storage.

(2)

Country clubs, golf courses, swimming clubs, tennis clubs, and similar recreational uses, provided that any principal building or swimming pool shall be located not less than 100 feet from any lot in any R district.

(3)

Kindergartens, child care centers or nursery schools, provided that any play lot used in connection therewith be suitably fenced and screened in accordance with the requirements of the board.

Sec. 34-159. - Permitted accessory uses.

Accessory uses customarily incidental to a permitted principal use on the same lot therewith shall be permitted, including:

(1)

Private garages or parking areas.

(2)

Living quarters of persons employed on the premises.

(3)

Home occupations as regulated by section 34-426.

(4)

Communication antenna (which does not require support by a new communication tower), free standing or attached to an existing residential structure, or to an existing communication tower, provided:

a.

The freestanding structure does not exceed 50 feet in height;

b.

Communication antennas located on an existing structure shall not extend more than 20 feet above said structure;

c.

The communication antenna complies with all applicable FCC and FAA regulations;

d.

The communication antenna complies with all applicable building codes;

e.

The communication antenna complies with all other requirements of this chapter.

Sec. 34-160. - Height regulations.

No principal structure shall exceed 2½ stories or 30 feet in height, and no accessory structure shall exceed 1½ stories or 20 feet in height, except as provided in section 34-476.

Sec. 34-161. - Lot area, frontage and yard requirements.

The following minimum requirements shall be observed, subject to the additional requirements, exceptions and modifications in sections 34-477 through 34-479, inclusive. Each lot shall have a minimum lot area of 8,000 square feet.

Sec. 34-162. - Lot frontage exceptions.

Notwithstanding the provisions of section 34-161, the minimum lot width for any lot, separately platted or existing as a single parcel as of July 1, 2012, shall be 50 feet. Nothing in this section shall be construed or interpreted to permit the creation of new residential building lots after July 1, 2012, with a lot width less than required by section 34-161.
