District Use Regulations

§ 206-9 Permitted uses.

Permitted principal, accessory and conditional uses for each zoning district are shown on Schedule I, Schedule of District Use Regulations.[1]
A. 
Short-term rentals.

(1) 
Other than a use and occupancy agreement resulting from the sale of a residential dwelling, no person or entity shall rent, lease, or allow the use or occupancy of any dwelling unit for a period of 28 days or less. Additionally, no person or entity shall solicit, advertise for, or offer the use or occupancy of any dwelling unit for a period of 28 days or less. Nothing shall prevent lawful rental and occupancy of a dwelling unit for a rental period of more than 28 days.
(2) 
Any person or entity found violating § 206-9A shall be subject to the following penalties:
(a) 
Upon conviction for a first offense, a fine of $350;
(b) 
Upon conviction for a second offense, a fine of $500; and
(c) 
Upon conviction for a third offense or subsequent offense, a fine of $750.
(d) 
Each day a dwelling unit is rented, leased, used, or occupied shall be deemed a separate violation.
(3) 
This subsection may be enforced by the Building Department, Police Department and/or the Fire Prevention Bureau.
