BOARDS AND AGENCIES
(A)
The City of Safety Harbor Board of Appeals is hereby established.
(B)
The membership, terms of office and procedure shall be as follows:
(1)
The members of the Board of Appeals shall consist of the same persons appointed to the Planning and Zoning Board.
(2)
The term of office for Board of Appeals members shall be for a period of two (2) years, four (4) regular members being appointed in each even year, and three (3) regular members and one (1) alternate member being appointed in each odd year for a term beginning in March of each year, consistent with each members' term of appointment to the Planning and Zoning Board.
(3)
The Board of Appeals shall, by a majority vote of the full membership, adopt rules of procedure.
(C)
Members of the Board of Appeals shall receive no salaries or fees for their services, but may receive reasonable expenses while on official business as approved by the City Commission.
(D)
No member of the Board of Appeals shall appear before the Board while acting as agent for any person upon matters the Board of Appeals has the authority to act.
(E)
The Planning and Zoning Director shall be responsible for coordinating the duties of the Board of Appeals. All City employees shall furnish to the Board such available information as may be required to carry out its duties.
(F)
The powers and duties of the Board of Appeals are established by Article XIII, Section 234.00 of this Code.
(A)
The City of Safety Harbor Planning and Zoning Board is hereby established.
(B)
The membership, terms of office and procedures shall be as follows:
(1)
The Planning and Zoning Board shall consist of seven (7) members appointed by the City Commission. The members shall either be residents of the City or meet the qualifications of subsection (B)(3) below.
(2)
Two (2) members of the Planning and Zoning Board should have a background in historic preservation, building or landscape architecture, urban planning, real estate, building/construction trades, environmental sciences, civil or transportation engineering, or a related field.
(3)
One (1) member of the Planning and Zoning Board shall be either a property or business owner within the Community Redevelopment District (CRD), as shown on the Future Land Use Map.
(4)
The term of office for the Planning and Zoning Board members shall be for a period of two (2) years, four (4) members being appointed in each even year, three (3) regular members and one (1) alternate member being appointed in each odd year for a term beginning in March of each year.
(5)
When all of the regular board members are present at a board meeting, the alternate will sit as a nonvoting member of the board, but will be able to participate in the board's discussion. If one of the regular board members is absent from a board meeting, the alternate will sit as a voting member of the board.
(6)
Any member may be removed from office by a majority vote of the full membership of the City Commission without cause.
(7)
Vacancies shall be filled by the City Commission for the unexpired term of any membership which becomes vacant. Any Board member who resigns or moves out of the City limits shall notify the City Clerk in writing of the vacancy.
(8)
The Planning and Zoning Board shall, by a majority vote of the full membership, adopt rules of procedure.
(C)
Members of the Planning and Zoning Board shall receive no salaries or fees for their services, but may receive reasonable expenses while on official business as approved by the City Commission.
(D)
No member of the Planning and Zoning Board shall appear before the Planning and Zoning Board or City Commission while acting as agent for any person upon matters the Planning and Zoning Board has the authority to act.
(E)
The Planning and Zoning Board shall be the Local Planning Agency (LPA) for the City of Safety Harbor.
(F)
The Planning and Zoning Director shall be responsible for coordinating the duties of the Planning and Zoning Board. All City employees shall furnish to the Board such available records for information as may be required to carry out its duties.
(G)
The powers and duties of the Planning and Zoning Board shall be as follows:
(1)
To conduct public hearings for the purpose of reviewing, commenting, and recommending to the City Commission matters or amendments related to the Comprehensive Plan in accordance with the provisions of Chapter 163, Florida Statutes.
(2)
To make recommendations to the City Commission regarding amendments to this Code.
(3)
To make recommendations to the City Commission regarding amendments to the Official Zoning Atlas, Conditional Uses, and Site Plans.
(4)
To conduct special planning studies as directed by the City Commission.

246.01 Historic incentives.
(A)
The City of Safety Harbor Planning and Zoning Board shall also act in the capacity of a Historic Incentives Board in accordance with the provisions of Article VIII of this Code.
(B)
The powers and duties shall be as follows:
(1)
To conduct special studies as directed by the City Commission to identify historically, architecturally, and archaeologically significant properties, structures, and areas that exemplify the cultural, social, economic, political, or architectural history of the nation, state, or city.
(2)
To recommend to the City Commission the designation of individual sites, districts, and archaeological sites that are historically or archaeologically significant.
(3)
To develop and recommend to the City Commission additional design guidelines for alterations to landmarks or buildings within historic districts.
(4)
To recommend to the City Commission Certificates of Approval in accordance with the terms of this Code and thereby regulate alterations, new construction, relocation, and demolitions affecting designated properties.
(5)
To recommend to the City Commission amendments to this Code, the building codes and to the Comprehensive Plan for the City of Safety Harbor.
(6)
To establish and recommend to the City Commission additional guidelines, criteria and standards of approval for the issuance of Certificates of Approval.
(7)
To promote public awareness of historic and archaeological preservation.
(8)
To recommend to the City Commission the nomination of landmark buildings, archaeological sites, and historic districts to the National Register of Historic Places.
(9)
To establish and recommend to the City Commission an awards program and marker program in order to foster continuing education.
246.02 Downtown redevelopment duties.
(A)
The City of Safety Harbor Planning and Zoning Board shall also act in the capacity of a Downtown Redevelopment Board in accordance with the duties established by this Section.
(B)
The powers and duties shall be as follows:
(1)
To make recommendations to the City Commission as to the Safety Harbor Downtown Redevelopment Plan, as may be interpreted or amended from time to time.
(2)
To make recommendations to the City Commission on the boundaries of the Central Business District (CBD).
(3)
To make recommendations to the City Commission on the implementation of zoning and land use regulations that will encourage the development and redevelopment of the area encompassed by the Downtown Redevelopment Plan.
(4)
To advise on, and to review plans for compliance with downtown design guidelines which may be established by the City Commission.
(5)
To make recommendations on special projects related to the downtown redevelopment program, which may be requested from time to time by the City Commission or City Manager.
246.03 School district representation.
(A)
A representative of the local school district shall be an ex officio, nonvoting member of the Planning and Zoning Board. The representative will be appointed by the Local School Board.
(B)
The purpose of the representation is to allow the Pinellas County School District to participate in those meetings at which a Comprehensive Plan amendment, or rezoning, is considered by the Planning and Zoning Board that would, if approved, increase residential density.
(C)
The City will notify the school district representative of the date, time, place and agenda of all meetings of the Planning and Zoning Board.
(A)
The Technical Review Committee (TRC) is hereby established for the purpose of providing for the professional and technical review of development applications.
(B)
The membership shall include the Director or his designee from the following City Departments:
(1)
Planning and Zoning.
(2)
Public Works.
(3)
Fire.
(4)
Building.
(C)
If the TRC is required to vote on an item and cannot obtain a majority, the City Manager shall cast the deciding vote.
(D)
The TRC shall review the following development applications for compliance with the provisions of this Code, the Comprehensive Plan, and all applicable building codes:
(1)
Site Plans.
(2)
Subdivisions.
(3)
Conditional Uses.
(4)
Amendments to the Official Zoning Atlas.
(5)
Amendments to the Future Land Use Map Series.
(6)
Variances.
(7)
Vacations of Streets, Plats or other property.
(8)
Temporary Uses.
(9)
All other applications assigned by the City Manager.
(E)
The TRC shall have the authority to approve temporary uses and site plans in accordance with the provisions of this Code.
(F)
Regular meetings of the TRC staff shall beheld at least once per month, at an established time and place.
(G)
The TRC agenda shall be distributed to the members at least seven (7) working days prior to the regularly scheduled meeting.
(H)
The meetings shall be open to the public. Attendance of the applicant is not required.
(I)
The Planning and Zoning Department shall be responsible for the following:
(1)
Agenda preparation and distribution.
(2)
Chairing the meeting.
(3)
Recording minutes.
(4)
Notification to applicants of the regularly scheduled date, time and place for consideration of the applications.
(5)
Written notification to applicants of the outcome of the TRC review.
(A)
The City of Safety Harbor Planning and Zoning Department is hereby created.
(B)
The Planning and Zoning Department shall report to the City Manager.
(C)
The Planning and Zoning Department shall perform functions relative to the administration of the Code, the Comprehensive Plan, and other applicable building codes as determined by the City Manager.
