ARTICLE IX

RES-MF RESIDENTIAL DISTRICT REGULATIONS

Sec. 56-151.- Intent.

The RES-MF is a medium-density residential district for mixed use residential development.

Sec. 56-152. - Permitted uses.

The following are permitted uses in the RES-MF residential district:

(a)

Any use permitted in the RES-SF district, except that backyard fowl are only permitted upon lots being used for single-family residential purposes.

(b)

Two-household dwelling units (floor area not less than 600 square feet per dwelling unit).

(c)

Multiple household dwelling units (floor area not less than 600 square feet per dwelling unit).

(d)

Independent living facility.

Sec. 56-153. - Conditional uses.

The following uses are allowed in the RES-MF district only upon approval of a conditional use permit:

(a)

Residential group homes for nine or more developmentally disabled persons, mentally ill persons, children, or elderly persons. The application for such use shall include a site plan of the site indicating property boundaries and total area, location and extent of all existing and proposed buildings; parking and circulation areas; landscaping and buffering, fences, walls, etc.; recreational facilities and open space; outdoor lighting facilities; trash receptacles; and any other physical features that might help identify the expected character of the proposed facility.

Assisted living facility. The application for such use shall include a site plan of the site indicating property boundaries and total area, location and extent of all exiting and proposed buildings; parking and circulation areas; landscaping and buffering, fences, walls, etc.; recreational facilities and open space; outdoor lighting facilities; trash receptacles; and any other physical features that might help identify the expected character of the proposed facility.

Sec. 56-154. - Lot size and coverage.

(a)

The minimum lot area for a one-household dwelling unit shall be 6,000 square feet. The minimum lot area for two-household and multi-household dwellings shall be 3,100 square feet per dwelling unit, for up to four dwelling units, plus an additional 2,100 square feet per dwelling unit beyond four.

(b)

The minimum lot frontage shall be 60 feet, unless a flag lot is authorized in the subdivision approval process. On lots adjacent to a cul-de-sac circle, the minimum lot frontage shall be measured at the front setback line.

(c)

All buildings, including accessory structures, shall not cover more than 40 percent of the total area of any lot.

Sec. 56-155. - Height.

No building hereafter erected or structurally altered shall exceed 35 feet in height.

Sec. 56-156. - Rear setback, principal building.

There shall be a rear yard of not less than 20 feet.

Sec. 56-157. - Side setback, principal building.

There shall be a side setback on each side of any building of not less than five feet in width, with six inches additional side yard for each foot of building height above 15 feet; provided, however, that on a lot having a width of less than 40 feet, as shown by the last recorded sale at the time of the passage of the ordinance from which this article was derived, there shall be a side setback on each side of a building of not less than three feet in width.

Sec. 56-158. - Front setback, principal building.

There shall be a front setback of not less than 20 feet.

Sec. 56-159. - Accessory buildings.

(a)

Accessory buildings shall be a maximum of 15 feet in height.

(b)

Accessory buildings shall not be located in the front yard of the principal building.

(c)

Accessory buildings, including a detached or attached garage where access is from an alley, shall have rear and side setbacks of not less than five feet, except for front-loaded garages where the garage doors are oriented to a street, which shall have driveways of not less than 20 feet.

(d)

Portable storage containers, excluding converted semi-trailers, are allowed as accessory buildings only if they do not exceed 200 square feet floor area. This does not preclude the use of dumpsters and portable storage containers during construction for a period of no longer than 90 days in any calendar year.

Sec. 56-160. - Minimum useable open space.

The minimum useable open space required for multi-family dwellings in this district shall be 25 percent.

Sec. 56-161. - Finish.

All structures, including accessory buildings and structures shall be finished in a neat and workmanlike manner by paint, stucco or other finish suitable for the type of materials used in their construction.
