FINAL PLAT

§ 151.430 GENERALLY.

   (A)   The St. Clair County Recorder of Deeds shall not record any final plat of a subdivision located within the subdivision jurisdiction of the village until the final plat has been approved by the Village Board of Trustees.
   (B)   The Board shall not approve any final plat unless it determines that it is in compliance with all pertinent requirements of the Development Code including those set forth in the sections below.

§ 151.431 FILING, TIME LIMITS.

   (A)   The subdivider of every subdivision, whether major or minor but excluding land specifically exempted from the Illinois Plats Act, being ILCS Ch. 765, Act 205, as now or hereafter amended, who desires final plat approval shall file four copies (24" by 36" size) and one copy (11" by 17" size) of the final plat and supporting data with the village staff not later than two years after the preliminary plat approval has been granted.
   (B)   However, with the written consent of the Village Board of Trustees, the subdivider may delay application for final approval of part(s) of the tract shown on the preliminary plat for successive one-year periods.

§ 151.432 INFORMATION REQUIRED.

   (A)   Every final plat shall be prepared by a registered land surveyor on new linen tracing cloth- or polyester-base film with waterproof black ink at a scale not greater than 100 feet equals one inch, provided that the resultant drawing shall not exceed 36 inches square and one copy (11" by 17").
   (B)   The final plat and supporting data shall portray/provide all of the following information:
      (1)   North arrow, graphic scale and data;
      (2)   Name of subdivider;
      (3)   Accurate metes and bounds or other adequate legal description of the tract;
      (4)   Accurate boundary lines, with dimensions and bearings or angles which provide a survey of the tract, closing with an error of closure of not more than one foot in 10,000 feet;
      (5)   Reference to recorded plats of adjoining platted land by record name, plat book and page number;
      (6)   Accurate locations of all existing streets intersecting the boundaries of the subdivision;
      (7)   Right-of-way lines of all streets, other rights-of-way, easements and lot lines with accurate dimensions, angles or bearings and curve data, including radii, arcs or chords, points of tangency and central angles;
      (8)   Name and right-of-way width of every proposed street;
      (9)   Location and purpose of any existing or proposed easements;
      (10)   Number of each lot, lot dimensions and (in a separate list) lot areas;
      (11)   Purpose(s) for which sites, other than private lots, are reserved;
      (12)   Building or setback lines with accurate dimensions;
      (13)   In a supporting document, restrictions of all types which will run with the land and become covenants in the deeds of lots;
      (14)   Indication of ponding limits for the 100-year storm event;
      (15)   Indication of the responsibilities with dam ownership (see §§ 151.220 through 151.223);
      (16)   Indication of risks associated with parcels downstream of a dam (see §§ 151.220 through 151.223);
      (17)   Location of all wetlands, habitat linkage and green space;
      (18)   Covenants and restriction that run with the land;
      (19)   Note indicating the private land owners are responsible for the maintenance of all drainageways, storm sewer and appurtenances, storm water, grass, detention area and the like not on village street right-of-way; and
      (20)   Note indicating that no fences, sheds, logs, piles, landscaping features or fill to be placed in drainage easements and/or areas subject to flooding in the 100-year storm event.

§ 151.433 CERTIFICATES REQUIRED.

   As required by state law, the following certificates shall be executed on the final plat:
   (A)   Owner's certificate.

§ 151.434 ADMINISTRATIVE REVIEW, ADVISORY REPORT.

   (A)   Within 30 days from the date of application for final plat approval and filing per § 151.340, the village staff shall review the final plat (and supporting data) subject to § 151.340, and shall advise the Planning Commission in writing whether it substantially conforms to the approved preliminary plat or any subsequent revisions required by the Village Board.
   (B)   The Village Planning Commission shall prepare a report or minutes and forward same to the Village Board of Trustees.

§ 151.435 ACTION BY BOARD OF TRUSTEES.

   (A)   The Village Board of Trustees shall either approve or disapprove the application for final plat within 60 days from the date of submission of approved Planning Commission minutes unless the Board and the subdivider mutually agree to extend this time limit. The Board of Trustees shall not approve any final plat unless:
      (1)   The final plat substantially conforms to the approved preliminary plat; or subsequent revisions required by the Village Board;
      (2)   The final plat manifests substantial compliance with the official map and with the design and improvements standard of this Development Code;
      (3)   To the Board's knowledge and belief, the final plat complies with all pertinent requirements of state law; and
      (4)   All conditions of §§ 151.410 through 151.415 have been met.
   (B)   If the Village Board of Trustees disapproves the final plat, they shall specify the aspects in which the plat fails to meet the above conditions for approval.
   (C)   The village staff shall notify the developer of the Board's disapproval to the final plat. If approved, one copy of final plat shall be retained by the Clerk, one copy shall be filed with the village staff, and one copy shall be given to the subdivider.

§ 151.436 APPROVED FINAL PLATS.

   (A)   Developer to record a copy of the final plat and covenants and furnish the village with three recorded copies of each.
   (B)   Once a final plat is approved by the Village Board of Trustees, it shall not thereafter be modified; provided, however, that, minor changes may be made upon approval of written application to the Village Board. Major changes require the filing of a new final plat and complete re-review.
