ARTICLE XIII

SATELLITE DISH ANTENNAS

Sec. 26-1093.- Installation; permit, etc.

(a)

Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

Satellite dish antennas means broadcast receivers designed to receive satellite television and radio signals for distribution and shall include the terms "television dish" and "satellite dish."

No permit required. For installation of satellite dish antennas that are one meter or less in diameter, no application, permit, or official review shall be required regardless of the zoning district in which said structure is located. For installation of satellite dish antennas for commercial uses, no application, permit, or official review shall be required for satellite dish antennas that are greater than one meter in diameter but less than two meters in diameter. For installation of all other satellite dish antennas, a permit must be obtained from the town as set forth below.

Permit required. Application for an installation permit for all such antennas two meters in diameter or greater, shall be made to the town building official accompanied by plans, specifications and other data, sufficiently detailed and prepared by an engineer or architect duly registered and licensed in the state. The engineer or architect must include a statement to accompany the plans and specifications to the effect that the satellite dish antenna, when constructed in accordance with the plans and specifications, can be safely maintained under wind forces to which it can be subjected in the location where placed. The term "wind resistant" is deemed to mean the ability to withstand winds of 140 miles per hour, the requirements of the Standard Building Code or the requirements of the American Institute of Design (AID); whichever is greater.

(d)

Aesthetic considerations. All satellite dish antennas requiring permits shall be screened from view whenever possible and/or painted in such a manner as to be harmonious with the structures on which they are located. Satellite dish antennas may be installed on roof tops, provided the dish is enclosed in a parapet so long as a signal can still be received. It shall be the responsibility of the property owner and/or persons or groups in control of the property to maintain the satellite dish antennas in accordance with applicable law.
