CHAPTER 1283

Permits

1283.01 ZONING CERTIFICATE AND BUILDING PERMIT REQUIRED.

   (a)   Permit Required: No person shall erect, move, add to or structurally alter a building or other structure without first obtaining a zoning certificate from the Zoning Inspector and a building permit from the Building Inspector. No building permit shall be issued by the Inspector except in conformity with this Zoning Code, unless he or she received a written order from the Board of Zoning Appeals in the form of an appeal or variance, as provided by this Zoning Code.
 
   (b)   Zoning Certificate Exemptions: The following activities shall be exempt from the requirement of obtaining a zoning certificate:
      (1)   Accessory structures of less than 120 square feet in floor area for commercial permits and less than 200 feet in floor area for residential permits.
      (2)   Interior remodel of a single-family home that does not change the profile of the building.
      (3)   Any minor alteration that, in the opinion of the Zoning Inspector, does not require a zoning certificate.
 
   (c)   Building Permit Exemptions: The Building Inspector exempt activities from the requirement of obtaining a building permit if such activities also do not require a building permit pursuant to the Ohio Building Codes.

1283.02 ZONING CERTIFICATE AND BUILDING PERMIT APPLICATIONS.

   All applications for zoning certificates and building permits shall be accompanied by plans drawn to scale, showing the actual dimensions and shape of the lot to be built upon; the exact sizes and locations on the lot of buildings already existing, if any; and the locations and dimensions of the proposed building or alteration. The application shall include such other information as lawfully may be required by the Zoning Inspector or Building Inspector, including existing or proposed building or alteration; existing or proposed uses of the building and land; the number of families, housekeeping units or conditions existing on the lot; and such other matters as may be necessary to determine conformity with, and provide for the enforcement of, this Zoning Code. One copy of the plans shall be returned to the applicant by the Inspector, after he or she has marked such copy either as approved or disapproved and attested to the same by his or her signature on such copy. The original and one copy of the plans, similarly marked, shall be retained by the Inspectors. (Ord. 0-15-4. Passed 2-19-15.)
 

1283.03 APPLICATION FOR ZONING CERTIFICATE.

   Applications for zoning certificates shall be submitted to the Zoning Inspector, and must be completed in full and accompanied by the appropriate fee. Applications for zoning certificates shall be on forms provided by the Zoning Inspector.
   At a minimum the applicant must supply the following information:
   (a)   Name, address and phone number of all persons having an ownership in the premises upon which the improvements are proposed, together with a written statement from all such persons indicating knowledge of and agreement with the proposal;
   (b)   The location, dimensions and parcel tax identification number of the lot or lots including a legal description;
   (c)   Zoning district;
   (d)   Relative location of any and all nearby public and private streets;
   (e)   The existing and proposed use of the lot or lots;
   (f)   A plan of the site drawn to scale showing dimensions of the lot and the location of all existing and proposed building and structures;
   (g)   Required front, rear, side yard area, open space, and parking;
   (h)   On residential parcels, the number of dwelling units contained within each building;
   (i)   Proposed number of occupants, employees, bedrooms;
   (j)   Location and dimensions of all buildings or structures to be erected, altered, moved or used;
   (k)   At the discretion of the Zoning Inspector, any other information concerning the lot or adjacent lots as may be necessary to determine conformance with and provide for the enforcement of this Zoning Code.

1283.04 ISSUANCE, RECORD, AND EXPIRATION OF ZONING CERTIFICATES.

   (a)   Issuance of Zoning Certificates. No permit for the erection, alteration, moving or repair of any building shall be issued until an application has been made for a zoning certificate. The certificate shall be issued in conformity with this Zoning Code upon submission of the application.
      (1)   Zoning Certificate Required for Conforming Uses. No person shall use or occupy or permit the use or occupancy of any building or premises, or both, or part thereof, hereafter created, erected, changed, converted or wholly or partly altered or enlarged in its use or structure, without first obtaining a zoning certificate therefor from the Zoning Inspector, stating that the proposed use of the building or land conforms to the requirements of this Zoning Code.
      (2)   Zoning Certificate Required for Nonconforming Uses. No person shall maintain, renew, change or extend a nonconforming structure or use without first obtaining a zoning certificate therefor from the Zoning Inspector. The zoning certificate shall state specifically wherein the nonconforming use differs from the provisions of this Zoning Code, provided that upon enactment or amendment of this Zoning Code, the owners or occupants of nonconforming uses or structures shall have 6 months to apply for zoning certificates. Failure to make such application within 6 months shall be presumptive evidence that the property was in conforming use at the time of enactment or amendment of this Zoning Code.
      (3)   Temporary Zoning Certificates. A temporary zoning certificate may be issued by the Zoning Inspector for a period not exceeding 6 months during alterations or partial occupancy of a building pending its completion. Such temporary zoning certificate may include such conditions and safeguards as will protect the safety of the occupants and the public.
      (4)   Issuance of Zoning Certificates For Projects Requiring Site Plan Review. The Zoning Inspector shall not issue a zoning certificate for any application requiring site plan review by the Planning Commission and/or the Board of Zoning Appeals, namely planned unit developments and mobile home parks, unless the site plan has been approved by the Commission and/or the Board.
 
   (b)   Record of Zoning Certificates; Copies. The Zoning Inspector shall maintain a record of all zoning certificates and a copy shall be furnished upon request to any person.
 
   (c)   Failure to Obtain Zoning Certificates. Failure to obtain a zoning certificate shall be deemed a violation of this Zoning Code, punishable as provided in Chapter 1288.
 
   (d)   Expiration of Zoning Certificates. If the applicant has not obtained a building permit for the work described in the zoning certificate within 180 days from the issuance of the zoning certificate, such permit shall expire. Such permit shall be canceled by the Zoning Inspector and written notice thereof shall be given to the property owner(s), together with notice that further work, as described in the canceled permit, shall not proceed unless and until a new zoning certificate has been obtained.

1283.05 BUILDING PERMITS.

   (a)   Issuance of Building Permits. No permit for the erection, alteration, moving or repair of any building shall be issued until the applicant has obtained a zoning certificate. Once the zoning certificate has been issued, the building permit shall be issued in conformity with the Building Codes upon submission of the application.
 
   (b)   Expiration of Building Permits. If the work described in any building permit has not begun within 1 year from the date of plan approval, such permit shall expire. Such permit shall be canceled by the Building Department and written notice thereof shall be given to the property owner(s). The applicant may receive a 1 year extension of the building permit if the applicant applies to the Building Department for an extension not less than 10 days prior to expiration of the original building permit. If the work described in such permit has not been substantially completed within 2.5 years of the date of issuance thereof, or if work ceases for 6 months, such permit shall expire and be canceled by the Inspector and written notice thereof shall be given to the property owner(s), together with notice that further work, as described in the canceled permit, shall not proceed unless and until a new building permit has been obtained.

1283.06 CONFORMITY WITH ZONING CERTIFICATES AND BUILDING PERMITS REQUIRED.

   Zoning certificates and building permits issued on the basis of plans and applications approved by the Zoning Inspector and Building Inspector, respectively, authorize only the use, arrangement and construction set forth in such approved plans and applications, and no other use, arrangement or construction. A use, arrangement or construction at variance with that authorized shall be deemed a violation of this Zoning Code, punishable as provided in Chapter 1288.
