CHAPTER 1263

Permitted Uses by District

1263.01 PERMITTED USES.

   In order to avoid intrusion of undesirable uses and to foster all possible benefits for a continued high quality environment, all residential and nonresidential land and structure uses have been classified into permitted uses. Permitted uses include those which require a minimum of limitation and are therefore permitted anywhere within a zoning district.

1263.02 PROHIBITED USES AND USES NOT EXPRESSLY PERMITTED.

   (a)   Prohibited Uses Generally. No building shall be erected, converted, enlarged, reconstructed or structurally altered, nor shall any building or land with public and/or privately developed improvements be used, arranged to be used or designed to be used, in a manner which does not comply with all of the district provisions established by these regulations for the districts in which the building or land is located.
      (1)   Uses which do not appear in the Ordinance by virtue of their omission from Section 1263.04, Table 6. Permitted Uses by District are prohibited.
      (2)   A prohibited use may become a permitted use if Council passes an amendment incorporating the prohibited use into appropriate use lists for appropriate zoning district(s).
      (3)   A prohibited use may become a permitted use if the Zoning Inspector determines the use should be a permitted use in an appropriate zoning district because it is substantially similar in character to specifically permitted use in such district.
      (4)   Uses for enterprises or purposes that are contrary to federal, state, or local laws or ordinances are prohibited.
 
   (b)   Prohibited Uses. The following uses are prohibited in all zoning districts:
      (1)   Medical marijuana as defined in the Ohio Revised Code Chapter 3796.
         A.   The cultivation, processing and dispensing of medical marijuana are prohibited uses in all zoning districts.
         B.   This prohibition shall not be applicable to the extent it limits any research related to marijuana conducted at a state university, academic medical center, or private research and development organization as part of a research protocol approved by an institutional review board or equivalent entity.
         C.   Nothing herein shall prohibit the legal personal use or legal possession of medical marijuana by individuals in the City.
      (2)   Certain home occupations identified in Section 1264.33(j), Development Standards for Specific Uses, Home Occupations.
      (3)   Certain uses as identified in Section 1268.01(e), ADD-1, Austin Development District 1, Prohibited Uses.

1263.03 MULTIPLE USES.

   A use may be combined with any other use(s) permitted in the zoning district provided that the regulations for each use are maintained. Excluding home occupations, residential uses occupying the same structure as a non-residential use(e.g., dwellings per Section 1264.03 and Section 1264.05) shall be physically separated and shall have separate entrances.

1263.04 TABLE OF PERMITTED USES.

   The following Table 6 lists the uses that may be permitted in each zoning district, provided that the development also meets the design and building standards set forth for each district, along with all other development standards contained in this Ordinance. For instance, when a certain use is or may be permitted in more than one zoning district, each zoning district will have different standards for building bulk, location, and design. The customized design standards set forth in each zoning district are tailored to the existing and intended character of each zoning district, and are further intended to prevent contextually inappropriate development from occurring within the City.
   (a)   Uses Permitted in Each District. Table 6 lists the permitted uses in each district. Refer to Chapter 1290 for definitions of all uses listed in the following Table 6.
   (b)   Development Standards Applicable to Uses. Whenever a specific development standard is included for a particular use in Table 6, any development must comply with the requirements of the referenced section. All development standards are listed in Chapter 1264.
   (c)   Special Purpose Zoning Districts Not Listed in Table 4. Refer to Chapter 1266 through Chapter 1270 for the uses and development standards applicable in the special purpose zoning districts. Use and development standards for some special purpose zoning districts are not listed in Table 6, and include the PUD, Planned Unit Development District, ADD-2 Austin Development District 2, and Mobile Home Parks.
