CHAPTER 10

ACTION BY AFFECTED PERSON

11-10-1: DEFINITION:

An "affected person" as used herein, shall mean having an interest in real property which may be adversely affected, by the issuance or denial of a permit authorizing the development. (Ord. 2011-677, 6-13-2011)

11-10-2: PETITION FOR HEARING:

Any affected person may at any time prior to final action on a permit required or authorized by this title, if no hearing has been held on the application, petition the planning and zoning commission in writing to hold a hearing in the manner set out in chapter 8 of this title; provided, however, that if twenty (20) affected persons petition for a hearing, the hearing shall be held. 11-10-3: ACTION BY PLANNING AND ZONING COMMISSION:

After a hearing, the planning and zoning commission may:
   A.   Grant or deny a permit; or
   B.   Delay such a decision for a definite period of time for further study or hearing. The planning and zoning commission shall establish by rule and regulation a time period within which a recommendation or decision must be made. (Ord. 2011-677, 6-13-2011)

11-10-4: JUDICIAL REVIEW:

An affected person aggrieved by a decision may within sixty (60) days after all remedies have been exhausted under this title, seek judicial review under the procedures provided by Idaho Code. (Ord. 2011-677, 6-13-2011)
