CHAPTER 4

ZONING DISTRICTS

11-4-1: R-1a AND R-1b SINGLE RESIDENCE ZONE:

   A.   Permitted Uses:
   Accessory structures.
   Manufactured homes.
   Single-family dwellings.
   B.   Special Uses:
   Accessory residential units as provided in section 11-5-5 of this title.
   Bed and breakfast establishments.
   Boarding and rooming houses.
   Churches.
   Family daycare home.
   Group daycare facility.
   Home occupations as provided in section 11-5-3 of this title.
   Personal services, including, but not limited to:
      Barber and beauty shops.
      Hair styling/salon.
      Manicure/pedicure, etc.
      Tailor/bootmaker/shoe repair.
   Schools.
   Two-family dwellings.
   C.   Bulk Requirements:
      1.   Lot Area:
         a.   Medium density (R-1b): Minimum lot size is four thousand six hundred (4,600) square feet, being at least fifty feet (50') wide for each single-family dwelling.
         b.   Low density (R-1a): Minimum lot size is seven thousand five hundred (7,500) square feet being at least seventy five feet (75') wide for each single-family dwelling.
      2.   Lot Width:
         a.   R-1a minimum lot width at the front property line: Seventy five feet (75').
         b.   R-1b minimum lot width at the front property line: Fifty feet (50').
      3.   Rear Yard: There shall be a rear yard of not less than ten feet (10') including overhang.
      4.   Side Yard: There shall be a side yard on each side of the dwelling of not less than five feet (5') including overhang.
      5.   Front Yard: There shall be a front yard of not less than twenty feet (20') in depth.
      6.   Structural Height: Thirty five feet (35') maximum. (Ord. 2011-677, 6-13-2011; amd. Ord. 2013-688, 12-16-2013; Ord. 2022-758, 1-10-2022; Ord. 2023-765, 3-13-2023)

11-4-2: R-2 TWO-FAMILY AND MULTIPLE DWELLING RESIDENCE ZONE:

   A.   Permitted Uses:
   All permitted uses in the R-1a/R-1b zone.
   Two-family dwellings.
   B.   Special Uses:
   All special uses in the R-1a/R-1b zone.
   Medical offices and clinics.
   Multiple-family dwellings.
   Nursing homes and assisted living units.
   Professional offices.
   C.   Bulk Requirements:
      1.   Lot Area:
         a.   The minimum lot area for permitted uses in the R-1a/R-1b zone, when located in the R-2 zone, is four thousand six hundred (4,600) square feet.
         b.   The minimum lot area for all other permitted and special uses in the R-2 zone is seven thousand (7,000) square feet.
      2.   Lot Width: The minimum lot width shall be fifty feet (50').
      3.   Rear Yard: Not less than ten feet (10') including any eaves or cantilever.
      4.   Side Yard: Not less than five feet (5') on either side including any eaves or cantilever.
      5.   Front Yard: There shall be a front yard of not less than twenty feet (20') in depth.
      6.   Structural Height: Thirty five feet (35') maximum. (Ord. 2011-677, 6-13-2011; amd. Ord. 2012-682, 7-23-2012; Ord. 2013-688, 12-16-2013; Ord. 2023-765, 3-13-2023)

11-4-3: R-3 MANUFACTURED HOME PARK RESIDENCE ZONE:

   A.   Permitted Uses:
      Manufactured home parks, provided such parks comply with the standards set forth in this section.
   B.   Special Uses:
      Home occupations.
   C.   Requirements:
      1.   Site Provisions: The manufactured home park must be well drained, not adjacent to swamps or marshes, and adequately lighted at night.
      2.   Manufactured Home Space:
         a.   Minimum Space: Each manufactured home space shall contain a minimum of two thousand five hundred (2,500) square feet, shall be at least twenty five feet (25') wide, and shall have its boundaries clearly defined. The space shall abut on a driveway not less than twenty four feet (24') in width, which shall have unobstructed access to a public street or highway. Manufactured homes shall be parked on each space so that there will be at least fifteen feet (15') of clearance between manufactured homes, ten feet (10') between manufactured homes and any adjoining property line, twenty five feet (25') between manufactured homes and public street or highway, and fifteen feet (15') between manufactured homes and any building or structure not attached. No greater number of manufactured homes shall be allowed than the number of manufactured home spaces available therefor.
         b.   Off Street Parking: Sufficient area shall be provided for the off street parking of at least one motor vehicle for each manufactured home space.
         c.   Vehicular Access: Suitable vehicular access for firefighting equipment, delivery of fuel, removal of garbage and refuse and for other necessary services must be provided.
         d.   Recreational Area: A separate area shall be provided for recreational purposes, which area shall be in a location not subject to traffic hazards, and shall provide one hundred (100) square feet of open area for each manufactured home space.
         e.   Minimum Number Of Spaces: Each manufactured home park shall contain a total area sufficient to accommodate a minimum of four (4) manufactured homes.
      3.   Water Supply: An adequate and safe supply of water under pressure (20 pounds per square inch) shall be supplied to each manufactured home park. Each manufactured home space shall have a separate water supply outlet.
      4.   Sewage Disposal: Waste from water closets, bathrooms, lavatories and laundries shall be discharged into the public sewer system. Each manufactured home space shall have a trapped sewer inlet to receive all manufactured home sewage.
      5.   Refuse Disposal: Refuse must be stored in flytight and rodentproof containers, which containers shall be provided, in adequate numbers, within one hundred fifty feet (150') of each manufactured home.
      6.   Supervision: The owner or operator of every manufactured home park, before allowing any manufactured home therein, shall file with the city the name of the person who will be in continuous responsible charge of such park and who is authorized to act as or for the owner. Any change of such person will be immediately reported to the city. The duties of such person will be:
         a.   Register: To keep a register at all times. The register shall record the names and addresses of all persons renting a space in the manufactured home park.
         b.   Maintenance: To maintain the park in a clean, orderly and sanitary condition.
         c.   Parking, Spacing: To enforce proper parking and spacing as set forth in this title.
         d.   Sewer Hookups: To regulate accepted sewer hookups.
         e.   Lights: To see that all required lights are kept lighted.
         f.   Garbage And Refuse: To see that garbage and refuse is properly disposed of.
         g.   Animals: Not to permit any domestic animal in the park unless it meets the requirements of city ordinances.
         h.   Report Violations: To report promptly to the proper authorities any violation of law pertinent to maintenance and operation of the manufactured home park.
         i.   Enforcement: To enforce any and all applicable city ordinances. (Ord. 2011-677, 6-13-2011)

11-4-4: R-4 AGRICULTURAL RESIDENCE ZONE:

   A.   Permitted Uses:
   Any permitted use in the R-1 and R-2 zones, manufactured homes.
   Agriculture, including farm animals as follows: One cow plus calf, two (2) horses, two (2) sheep, two (2) goats, twelve (12) rabbits and twelve (12) poultry may be maintained in buildings or enclosures when approved by planning and zoning commission and when the facilities for such housing of any such animals meet with the approval of the building inspector, and do not cause offensive odor, noise or disturbance to the people in the neighborhood.
   B.   Special Uses:
   All special uses in R-2 zones.
   Any special use in the R-1a/R-1b zone.
   Cottage industry as provided in section 11-5-4 of this title.
   C.   Bulk Requirements:
      1.   Minimum lot size: Five (5) acres.
      2.   Lot width: Not less than seventy five feet (75').
      3.   Front yard: Not less than thirty feet (30').
      4.   Side yard: Not less than twenty feet (20'), including eaves and cantilevers.
      5.   Rear yard: Not less than twenty feet (20'), including eaves and cantilevers. (Ord. 2011-677, 6-13-2011)
      6.   Structural height: Thirty five feet (35') maximum. (Ord. 2011-677, 6-13-2011; amd. Ord. 2013-688, 12-16-2013; Ord. 2023-765, 3-13-2023)

11-4-5: P-R PARKS AND RECREATION ZONE:

   A.   Permitted Uses: No building or premises shall be used and no building shall hereafter be erected or structurally altered in the P-R zone, except for one or more of the following uses:
      Parks, playgrounds, community centers, recreational areas, cemetery and fairgrounds.
      Uses customarily incident to the above uses, including travel trailer/camper parking but only if a service building as described in section 11-5-7 of this title is provided for such travel trailer/campers.
   B.   Prohibited Use: No portion of a parks and recreation zone along navigable waters may be used for anything except navigation, swimming, or fishing or recreational uses incident to above mentioned uses. No travel trailer/campers shall be parked, nor any crafts, boat, boathouse float, or deck be moored permanently for a period of more than twenty four (24) hours; provided, that the planning and zoning commission may, with city council approval and after notice and public hearing, grant special revocable permits for the mooring of any of the above craft, parking of travel trailer/campers, or the construction of docks, piers, wharfs or boathouses if the planning and zoning commission finds such not to be unduly detrimental to surrounding property nor to the orderly development of the waterfront. 11-4-6: CBD CENTRAL BUSINESS DISTRICT ZONE:

   A.   Permitted Uses:
   All permitted uses in the R-2 zoning district.
   Eating and drinking establishments:
      Restaurants without drive-through facilities.
      Taverns.
   Financial institutions.
   Lodging:
      Bed and breakfast establishments.
      Hotels.
      Motels.
   Personal services, including, but not limited to:
      Barber and beauty shops.
      Hair styling/salon.
      Manicure/pedicure, etc.
      Tailor/bootmaker/shoe repair.
   Professional offices, including, but not limited to:
      Architects.
      Attorney.
      Broker/financial.
      Governmental.
      Medical and dental.
      Real estate/insurance.
   Retail uses where goods are made available for purchase, primarily by walk-in patrons. Specific types of retail includes, but is not necessarily limited to:
      Art/photo galleries.
      Bookstores/newsstands.
      Clothing/shoe stores.
      Drugstores/pharmacies.
      Gift shops.
      Hardware and logging supplies.
      Office supply/quick copy/printing.
      Sporting goods.
      Variety/novelty stores.
   B.   Special Uses:
   Apartments/condos (above the first level of a nonresidential use).
   Auto service/motor fuel sales.
   Churches.
   Dance/fitness/martial arts studios.
   Drive-through facilities.
   Home occupations.
   Multi-family dwellings.
   Schools.
   C.   Bulk Requirements:
      1.   Front Setback: Zero; at least seventy five percent (75%) of the building frontage shall be at the front property line.
      2.   Side Setback: Zero.
      3.   Rear Setback: Twenty feet (20') minimum as needed to provide for service and delivery. If there is no alley adjacent to the rear property line, the rear setback shall be ten feet (10').
      4.   Structural Height: Thirty five feet (35') (to top of pitch or parapet).
      5.   Minimum Lot Size: Two thousand five hundred (2,500) square feet.
   D.   Recommended Design And Development Standards: While not mandatory requirements, the following design and development standards are recommended in order to achieve the purposes of the CBD zoning district:
      1.   Retail uses should be at street level with adequate window area for good street connectivity and visual access to the interior space.
      2.   Recessed entries are encouraged.
      3.   Offices should be confined to upper levels of buildings and are discouraged at street level.
      4.   Exterior materials should be wood, stone, or masonry, or synthetic equivalent.
      5.   Canopies are encouraged. Canopies or awnings shall not encroach more than five feet (5') or half the sidewalk whichever is shorter.
      6.   In new structures, modulation that simulates existing storefronts is encouraged.
      7.   When drive-through facilities are provided (as conditional uses), entries and exits should be to the rear of the building via an alley, or from a side street. Front drive-through access is discouraged. (Ord. 2011-677, 6-13-2011; amd. Ord. 2023-765, 3-13-2023)

11-4-7: GC GENERAL COMMERCIAL ZONE:

   A.   Permitted Uses:
   All permitted uses in the CBD central business district zone.
   Auto oriented uses including:
      Auto and truck repair/auto body.
      Automotive sales.
      Fuel service stations.
      Truck stops/terminals.
   Churches.
   B.   Special Uses:
   All special uses in CBD Central Business District Zones.
   Ministorage.
   Recreational vehicle/travel trailer park (subject to Recreational Vehicle Park Standards).
   Schools.
   Wholesale/warehousing/contractor supplies.
   C.   Bulk Requirements:
      1.   Front setback: Minimum of ten feet (10') when site is less than two (2) acres in size; fifty feet (50') when two (2) acres or greater.
      2.   Side setback: Minimum of ten feet (10').
      3.   Rear setback: Minimum of twenty feet (20') or as needed for service and delivery.
      4.   Structural height: Thirty five feet (35') maximum.
   D.   Landscaping:
      1.   A minimum of ten percent (10%) of the site area shall be landscaped. This requirement may include areas for snow storage and on site stormwater retention when such areas are also landscaped.
      2.   The first five feet (5') of the front setback shall be landscaped, excluding the entrance and exit, as well as any parkway between the property line and the curb or edge of pavement as applicable.
      3.   Parking areas shall be punctuated by landscape islands and/or planting strips. Vast expanses of pavement shall not be permitted. Parking areas under one thousand five hundred (1,500) square feet are exempt from this requirement, but are still subject to front setback landscaping as set forth in subsection D2 of this section.
      4.   Landscaping shall be a combination of coniferous and deciduous specimen trees, ornamentals, shrubs, and ground cover. Indigenous plant materials are preferred.
      5.   Irrigation shall be provided and landscape maintenance is the responsibility of the property owner(s). All dead or diseased plant materials shall be replaced as soon as practicable.
   E.   Recommended Design And Development Standards: While not mandatory, the following design and development standards are recommended in order to achieve the purposes of the GC zoning district:
      1.   Driveway access points should be limited and controlled to allow for smooth traffic flow and safety.
      2.   Exterior materials should be wood, stone, or masonry, or synthetic equivalent.
      3.   Outdoor gathering and queuing spaces near building entries are encouraged. (Ord. 2011-677, 6-13-2011; amd. Ord. 2020-737, 1-27-2020; Ord. 2021-748, 10-12-2021; Ord. 2023-765, 3-13-2023)

11-4-8: M-I MANUFACTURING AND INDUSTRIAL ZONING DISTRICT:

   A.   Permitted Uses:
         Contractor yard.
         Manufacturing of any type, including wood product processing, metal fabrication, welding, and batch plants.
         Railroad terminals and facilities.
         Truck repair/terminal.
         Warehousing and distribution.
   B.   Special Uses:
         Caretaker quarters.
         Gravel extraction/processing.
         Ministorage.
         Wholesale/contractor supplies.
   C.   Bulk Requirements:
      1.   Front setback: Fifty feet (50').
      2.   Side setback: Fifteen feet (15').
      3.   Rear setback: Twenty feet (20') or as needed to provide service and delivery.
   D.   Landscape Standards:
      1.   A minimum of ten percent (10%) of the entrance area shall be landscaped. For purposes of this requirement, entrance area shall be the lot width on the side of the lot where the main entrance to the building is located.
      2.   Landscaping shall be designed and arranged to support a quality industrial streetscape.
      3.   Landscaping shall be a combination of coniferous and deciduous specimen trees, ornamentals, shrubs, and ground cover.
      4.   Irrigation shall be provided and landscape maintenance is the responsibility of the property owner(s). All dead or diseased plant materials shall be replaced as soon as practicable. (Ord. 2011-677, 6-13-2011)
