The city council may from time to time on its own motion, or on petition, or on recommendation of the planning and zoning commission, amend, supplement, or repeal the regulations and provisions of this title. (Ord. 2011-677, 6-13-2011)
11-13-2: PETITION:
An amendment or rezoning may be initiated by an application from interested property owners or authorized agents of such owners for rezoning of the property owner's land, provided that said land is adjacent to or directly across a street or alley from property which is already zoned in the same zone as that to which said property is proposed to be rezoned. If the property proposed to be rezoned is owned by more than one property owner, each and every owner of the proposed change shall be in agreement to the change. The application shall contain the signature of every property owner, and the planning and zoning commission shall not accept any application not bearing all signatures. Upon receipt of a properly signed application, the proposed change shall be handled the same as a one owner application including, but not limited to, one application fee, one public hearing and one set of exhibits, etc. (Ord. 2011-677, 6-13-2011)
11-13-3: REFERRAL TO PLANNING AND ZONING COMMISSION:
Every such proposed amendment or change whether initiated by the city council or by petition shall be referred to the planning and zoning commission for report thereon before the public hearing hereinafter provided for. (Ord. 2011-677, 6-13-2011)
11-13-4: PUBLIC HEARING:
The city council by resolution adopted at a stated meeting shall fix the time and place of a public hearing on the proposed amendments and cause notice to be given as follows:
A. Publication Of Notice: Not less than fifteen (15) days prior to the hearing a notice of time and place or hearing and a summary of the proposed amendment shall be published in a newspaper of general circulation in the city.
B. Contents Of Notice: The notice shall state the general nature of the proposed amendments as well as the text. (Ord. 2011-677, 6-13-2011)
