CHAPTER 1

GENERAL PROVISIONS

10-1-1: TITLE:

This title shall be entitled and known as the DEVELOPMENT CODE FOR THE TOWN OF STOCKTON, UTAH, and may be so cited and pleaded. (Ord. 17-02, 3-16-2017)

10-1-2: INTENT AND PURPOSE:

It is the intent and purpose of the Town Council to avail itself of the powers granted under Utah Code Annotated title 10, chapter 9a, as amended, in manner that will promote the health, safety, morals, convenience, order, prosperity and general welfare of the present and future inhabitants of the Town, and to this end:
   A.   To encourage and facilitate orderly growth and development within the Town.
   B.   To secure economy in Town expenditures and to facilitate adequate provision for transportation, water, sewage, parks, schools and other public requirements.
   C.   To lessen congestion in the streets, prevent the overcrowding of land, and provide adequate light and air.
   D.   To secure safety from fires, floods, traffic hazards and other dangers.
   E.   To stabilize and improve property values.
   F.   To protect the tax base.
   G.   To promote the development of a more attractive, wholesome and serviceable Town.
   H.   To create conditions favorable to prosperity, civic activities and recreational, educational and cultural opportunities. (Ord. 17-02, 3-16-2017)

10-1-3: INTERPRETATION:

   A.   In interpreting and applying this title, the provisions hereof shall be held to be the minimum requirements needed to promote the public health, safety, morals, convenience, order, prosperity and general welfare of the present future in habitants of the Town.
   B.   Where the provisions of this title impose a greater restriction than is required by any ordinance, code, regulation, standard or other provisions of law, or by easement, covenant or private agreement, the provisions of this title shall govern. (Ord. 17-02, 3-16-2017)

10-1-4: DEVELOPMENT SHALL NOT BURDEN OTHER AREAS:

   A.   Any development proposed within the Town boundaries shall assume all costs related to such development. Development, in this sense, includes individuals as well as subdivisions.
   B.   This shall include, but not be limited to: supplying adequate water rights for the development; providing means to irrigate the entire acreage where applicable; putting in all utilities; paving roads, installing curbs, gutters and sidewalks that meet Town standards; providing open space to the extent it is required by the Governing Body; protecting vistas that are important to the citizens of the Town; and controlling drainage water created by the development on the developed property.
