CHAPTER 18

AMENDMENTS

10-18-1: INTENT:

All amendments to this title shall be made in accordance with the Comprehensive Plan of Land Use. It is hereby declared to be public policy that this title shall not be amended unless it can be shown that changed or changing conditions make the proposed amendment reasonably necessary to the promotion of the purposes of this title. 10-18-2: AMENDMENTS PERMITTED:

This title and the zoning map adopted as a part thereof, may be amended from time to time by the Town Council, but all proposed amendments must first be submitted to the Planning Commission for its recommendation. The procedure to be followed in amending this title and map shall be as set forth in this chapter. (Ord. 17-02, 3-16-2017)

10-18-3: PROCEDURE FOR AMENDMENTS:

   A.   Written Petition; Fee: Any person seeking an amendment of this title or zoning map shall submit to the Planning Commission a written petition designating the change desired and the reasons therefor, and shall pay a non-refundable filing fee in an amount established by resolution of the Town Council.
   B.   Amendments By Town: Amendments to this title and map may also be initiated by action of the Planning Commission or upon request of the Town Council.
   C.   Recommendation Of Planning Commission; Time Limit:
      1.   Upon receipt of the petition, the Planning Commission shall consider the request and shall submit its recommendations with respect thereto to the Town Council.
      2.   The Planning Commission shall submit its recommendations to the Town Council within thirty (30) days from the date of the next regularly scheduled meeting occurring after receipt of the request. Failure of the Planning Commission to submit its recommendations to the Town Council within said thirty (30) day period shall be deemed to constitute a recommendation of approval, unless a longer period is granted by the petitioner.
   D.   Public Meeting, Hearing:
      1.   The Town shall follow the procedures specified in Utah Code Annotated section 10-9a-205 for public meeting and hearing notice requirements.
      2.   No material change in or departure from the amendment as recommended by the Planning Commission shall be made after the hearing, unless such proposed change of departure shall have been first submitted to the Planning Commission for its consideration and recommendations with respect thereto.    E.   Amendments Adopted By Ordinance: All amendments to this title and map shall be adopted, published or posted and recorded in accordance with the applicable provisions of Utah Code Annotated section 10-9a-503. (Ord. 17-02, 3-16-2017; amd. 2017 Code)
