CHAPTER 6

AGRICULTURAL ZONES

10-6A-1: LEGISLATIVE INTENT:

   A.   The objective in establishing the A-4 Agricultural Zone is to provide a location within the community devoted primarily to the raising of livestock and/or the growing of crops, and to preserve and protect the continued use of the property for agricultural purposes. The zone includes those areas of the Town where the combination of soil quality, size of land parcel, availability of water, historic use of land and lack of urban development activity make the land most suited to agricultural and livestock purposes.
   B.   Representative of the uses within the A-4 Zone are livestock and grazing. Uses which are inconsistent with and tend to mitigate against the continued use of the land for agriculture and livestock raising are excluded from the zone. (Ord. 17-02, 3-16-2017)

10-6A-2: PERMITTED USES:

The following buildings, structures and uses of land shall be permitted upon compliance with the applicable requirements of this title:
Accessory sign pertaining to the sale of the real property or produce raised on the premises; provided, that such sign shall not exceed thirty two (32) square feet.
Corrals and pens for the enclosure of livestock. Also, barns, stables, coops, sheds, hutches or similar buildings used for the housing or confinement of livestock and fowl; provided, that any such corral or pen, or any building used for the housing of livestock or fowl, shall be located not closer than seventy five feet (75') to an existing dwelling or other occupied structure located on an adjacent lot, or forty feet (40') to such dwelling or structure on the same lot.
Customary residential accessory structures.
Farm equipment and the facilities incidental to the operation of the farm unit (i.e., grain, grain storage, silos, mills).
Gardens, orchards and field crops.
Grazing of livestock.
Home occupations, subject to the provisions of section 10-10-17 of this title.
Kennels, when included as part of a designated farm unit.
One-family dwellings, conventional construction.
One-family dwellings, manufactured housing, subject to the provision of section 10-10-21 of this title.
Raising, care and keeping of livestock and fowl in an amount not exceeding three (3) animal units per acre of lot area.
Roping and riding arena.
Special use permit allowing the raising of porcine (pigs) on parcels of land within the Town limits of not less than two (2) agricultural zoned acres for seasonal educational or food projects between March 1 through October 31 each year. (Ord. 17-02, 3-16-2017; amd. Ord. 2019-15, 12-12-2019)

10-6A-3: CONDITIONAL USES:

The following buildings, structures and uses of land may be permitted upon compliance with the requirements of this title and subject to the prior approval of the designated review agency:
Churches, with a minimum of five (5) acres.
Residential facility for disabled persons, subject to the provisions of section 10-10-23 of this title.

The minimum lot area and width requirements for a zoning lot shall be as follows:

10-6A-5: ACCESS REQUIREMENTS:

Each designated farm unit shall:
   A.   Front upon and have direct access to a public street for a distance of not less than two hundred feet (200'); or
   B.   Have direct and uninterruptible access to a public street over a deeded private travel easement. (Ord. 17-02, 3-16-2017)

10-6A-6: LOCATION REQUIREMENTS:

   A.   Main Buildings: All dwellings and other main buildings and structures shall be set back in accordance with the following:
      1.   Front Setback: All dwellings and other main buildings shall be set back not less than twenty feet (20') from the front lot line.
      2.   Side Setbacks:
         a.   Interior lots: All dwellings and other attached main buildings, including carports, garages or similar structures, shall be set back not less than eight feet (8') from either side lot line and the combined total distance of the two (2) side setbacks shall be not less than twenty feet (20').
         b.   Corner lots; side abutting street: All dwellings and other main buildings shall be set back not less than twenty feet (20') from the side lot which abuts on a street.
      3.   Rear Setback; Interior Lots: All dwellings shall be set back not less than twenty feet (20') from the rear lot line.
   B.   Accessory Buildings: All accessory buildings shall be located in accordance with the following:
      1.   Setback From Main Building; Front Setback: Accessory buildings shall be set back not less than twenty feet (20') from front property line, and not less than eight feet (8') from the closest side wall or rear wall of the main building. Accessory buildings which are located eight feet (8') or closer to a main building shall be considered as part of the main building. Where no main building exists on a lot, a detached accessory building shall be set back not less than twenty feet (20') from the front lot line.
      2.   Side Setbacks:
         a.   Interior lots: Detached accessory buildings shall be set back not less than three feet (3') from the drip line on the side property line.
         b.   Side setback; corner lot, side abutting street: Accessory building shall be set back not less than twenty feet (20') from the side lot line which abuts on a street.
      3.   Rear Setback: The rear setback for an accessory building shall not be less than three feet (3') from the drip line. (Ord. 17-02, 3-16-2017)

10-6A-7: HEIGHT OF BUILDINGS:

   A.   Maximum: The maximum height of any dwelling or other building used for human occupancy shall be thirty feet (30') or two and one-half (21/2) stories, whichever is higher.
   B.   Minimum: The minimum height of a building used as a dwelling shall not be less than eight feet (8'), except when approved as an earth shelter home project as provided in section 10-10-20 of this title. (Ord. 17-02, 3-16-2017)

10-6A-8: UTILITY REQUIREMENTS:

All dwellings and other structures used for human occupancy shall be served by the Town water and sewer system in accordance with the provisions of section 10-10-22 of this title, except that requirements for connection to one (1) or more of above mentioned systems may be waived by the Town Council upon finding that: a) connection to one (1) or more of the above utility systems is not reasonably practicable; and b) an alternative method of providing the service to the premises has been secured (i.e., approved domestic well right, septic tank approved by health agency). 10-6A-9: DWELLING REQUIREMENTS:

   A.   Minimum Area: The ground floor of any dwelling shall contain not less than nine hundred fifty (950) square feet of living area.
   B.   Minimum Dimension: The minimum width or length dimension of any dwelling as measured from the outside wall shall be not less than twenty four feet (24'). Nonliving spaces, such as garages, porches and sheds, shall not be included in determining compliance with this requirement. (Ord. 17-02, 3-16-2017)

10-6B-1: LEGISLATIVE INTENT:

   A.   The objective in establishing the A-2 Agricultural Zone is to provide a location within the Town for a residential and agricultural environment where the residents may engage in significant agricultural pursuits, including the keeping of livestock. A minimum of vehicular traffic and quiet residential conditions favorable to family living and the rearing of children shall also be characteristic of this zone.
   B.   Representative of the uses within the A-2 Agricultural Zone are one-family dwellings, the keeping of domestic livestock, parks, playgrounds, churches and other community facilities in harmony with the characteristics of the zone.
   C.   Residents and developers within the zone should bear in mind that the proximity of animals to dwellings is an integral part of the zone and should occupy the residences in recognition thereof.
   D.   The specific regulations necessary for the accomplishment of the intent of the zone are hereinafter set forth. (Ord. 17-02, 3-16-2017)

10-6B-2: PERMITTED USES:

The following buildings, structures and uses of land shall be permitted upon compliance with the applicable requirements of this title:
Churches.
Corrals and pens for the enclosure of livestock. Also, barns, stables, coops, sheds, hutches or similar buildings used for the housing or confinement of livestock and fowl; provided, that any such corral or pen, or any building used for the housing of livestock or fowl, shall be located not closer than seventy five feet (75') to an existing dwelling or other occupied structure located on an adjacent lot, or forty feet (40') to such dwelling or structure on the same lot.
Customary residential accessory structures.
Fences, walls and hedges, subject to the requirements of section 10-10-13 of this title.
Foster care home containing not more than three (3) non- related foster care occupants.
Gardens, orchards and field crops.
Home occupations, subject to the provisions of section 10-10-17 of this title.
Household pets.
Minor utility transmission projects.
One-family dwellings, conventional construction.
One-family dwellings, manufactured housing, subject to the provision of section 10-10-21 of this title.
Public agency parks and playgrounds.
Raising, care and keeping of livestock and fowl in an amount not exceeding three (3) animal units per acre of lot area.
Special use permit allowing the raising of porcine (pigs) on parcels of land within the Town limits of not less than two (2) agricultural zoned acres for seasonal educational or food projects between March 1 through October 31 each year.

10-6B-3: CONDITIONAL USES:

The following buildings, structures and uses of land shall be permitted upon compliance with the requirements set forth in this title and after approval has been given by the designated reviewing agencies (approval of other agencies or levels of government may be required):
Earth shelter home projects, subject to the provisions of section 10-10-20 of this title and the prior approval of a site plan in accordance with the provisions of section 10-10-19 of this title.
Public schools, buildings and grounds, not including storage yards, subject to the conditions of section 10-10-18 of this title.

10-6B-5: ACCESS REQUIREMENTS:

Each lot shall abut upon and have direct access to a Town street. The distance of said abutting side shall be not less than the minimum width requirement of the zone, except that the length of said abutting side may be reduced to not less than seventy feet (70') when the lot fronts upon a cul-de-sac or curve in a designated Town street and the lot lines radiate in such a manner that the width of the first lot will meet or exceed the minimum width requirements of the zone at a distance of eighty feet (80') from the setback line as measured along the side lot line. 10-6B-6: LOCATION REQUIREMENTS:

   A.   Main Buildings: All dwellings and other main buildings and structures shall be set back in accordance with the following:
      1.   Front Setback: All dwellings and other main buildings shall be set back twenty feet (20') from the front lot line.
      2.   Side Setback:
         a.   Interior lots: All dwellings and other attached main buildings, including carports, garages or similar structures, shall be set back not less than eight feet (8') from either side lot line and the combined total distance of the two (2) side setbacks shall not be less than twenty feet (20').
         b.   Corner lots; side abutting street: All dwellings and other main buildings shall be set back not less than twenty feet (20') from the side lot which abuts on a street.
      3.   Rear Setback; Interior Lots: All dwellings shall be set back not less than twenty feet (20') from the rear lot line.
   B.   Accessory Buildings: All accessory buildings shall be located in accordance with the following:
      1.   Setback From Main Building; Front Setback: Accessory buildings shall be set back not less than twenty feet (20') from front property line, and not less than eight feet (8') from the closest side wall or rear wall of the main building. Accessory buildings which are located eight feet (8') or closer to a main building shall be considered as part of the main building. Where no main building exists on a lot, a detached accessory building shall be set back not less than twenty feet (20') from the front lot line.
      2.   Side Setbacks:
         a.   Interior lots: Detached accessory buildings shall be set back not less than three feet (3') from the drip line on the side property line.
         b.   Side setback; corner lot, side abutting street: Accessory buildings shall be set back not less than twenty feet (20') from the side lot line which abuts on a street.

10-6B-7: HEIGHT OF BUILDINGS:

   A.   Maximum: The maximum height of any building shall be thirty feet (30') or two and one-half (21/2) stories, whichever is higher. Where the ground is uneven in height, the average elevation thereof shall apply. Chimneys, flagpoles, television antennas, church towers and similar ancillary structures not used for human occupancy shall be excluded in determining height; provided, that no such ancillary structure shall extend to a height in excess of fifteen feet (15') above the building, except when approved by the Planning Commission as set forth under section 10-10-19 of this title.
   B.   Minimum: The minimum height of a building used as a dwelling shall be not less than eight feet (8'), except when approved as an earth shelter home project as provided in section 10-10-20 of this title. (Ord. 17-02, 3-16-2017)

10-6B-8: UTILITY REQUIREMENTS:
