Sunrise City Zoning Code

ARTICLE I

- INTRODUCTION

Sec. 16-1.- Title.

This Code shall be known as, cited as, and referred to as the City of Sunrise Land Development Code. It may, in subsequent sections, be referred to as the LDC, or the Code.

Sec. 16-2. - Authority.

This Land Development Code is adopted pursuant to Chapter 163, Part II, Florida Statutes.

Sec. 16-3. - Intent.

With regard to this Land Development Code in general, its provisions shall be construed and implemented to achieve the following intentions and purposes of the city:

(1)

To establish the regulations, procedures and standards for review and approval of all proposed development in the city.

(2)

To foster and preserve public health, safety, comfort and welfare, and to aid in the harmonious, orderly, aesthetically pleasing and socially beneficial development of the city in accordance with the Comprehensive Plan.

(3)

To adopt a development review process that is:

a.

Efficient, in terms of time and expense;

b.

Effective, in terms of addressing the natural resource, urban design and public facility implications of proposed development; and

c.

Equitable, in terms of consistency with established regulations and procedures, respect for the rights of property owners, and consideration of the interests of the citizens of the city.

To implement the City Comprehensive Plan as required by the "Local Government Comprehensive Planning and Land Development Regulation Act."

(5)

To provide specific procedures to ensure that development orders and permits are conditioned on the availability of public facilities and services that meet level of service requirements (concurrency).

Sec. 16-4. - General regulations.

(a)

Conflicting regulations. Wherever any provision of this chapter imposes more stringent requirements, restrictions or limitations than are imposed or required by the provisions of any other law or resolution, then the provisions of this chapter shall govern.

(b)

Scope. No building or structure, or part thereof, shall hereafter be erected, constructed, reconstructed, altered or maintained, and no existing use, new use or change of use of any building, structure or land, or part thereof, shall be made or continued, except in conformity with the provisions of this article.

(c)

Vesting of development rights. Any building or project for which a lawful development permit has been issued prior to the effective date of this chapter may be completed and used in accordance with the plans and specifications upon which said development permit was granted, and such rights shall continue during the life of the permit, provided that if the applicable development permit shall expire or shall be lawfully revoked, such rights shall be lost.
