ARTICLE XXIX
Amendments
§ 99-2901 Amendment of chapter.
This chapter or any part thereof may be amended, supplemented or repealed from time to time by the Village Board on its own motion or by petition as set forth herein.
§ 99-2902 Petitions.
Petitions to the Village Board to amend this chapter shall be in writing and shall contain the description(s) of the property(ies) affected, together with such other information as the Village Board shall require. Such petitions shall include the names and addresses of all owners of real property within 500 feet of the property(ies) affected or any other contiguous property of a petitioner in the same ownership. All petitions for amendment of this chapter shall be accompanied by a fee set by the Village Board. The fee shall be returned if the Village Board does not hold a public hearing on such proposed amendment.
§ 99-2903 Hearings.
The Village Board shall fix the time and place of a public hearing on any proposed amendment and cause notice thereof to be given as provided by law.
§ 99-2904 Referral to Nassau County Planning Commission.
A.
If any proposed amendments of this chapter shall, pursuant to General Municipal Law §§ 239-l, 239-m or 239-n or the Nassau County Charter § 1610, be required to be referred to the Nassau County Planning Commission, the Village Clerk shall, prior to final action by the Village Board, forward such proposed amendment(s) to the Nassau County Planning Commission.
B.
Failure of the Nassau County Planning Commission to report its recommendations within 30 days after receipt of the proposed amendment(s), or such longer period as may have been agreed upon by it and the Village Board, shall be construed as approval.
C.
If the Nassau County Planning Commission disapproves the proposed amendment(s), then said proposed amendment(s) shall not become effective except by a vote of a majority plus one of all members of the Village Board approving a resolution, fully setting forth the reasons for such contrary action.
D.
If the Nassau County Planning Commission should recommend modification(s) of the proposed amendment(s) and the Village Board does not incorporate said modification(s) into the proposed amendment(s), then said proposed amendment(s) shall not become effective except by a vote of a majority plus one of all the members of the Village Board approving a resolution, fully setting forth the reasons for such contrary action.
E.
If the Village Board shall incorporate all the modifications recommended by the Nassau County Planning Commission or if the Nassau County Planning Commission should approve the proposed amendment(s), then the proposed amendment(s) shall become effective by a vote of a majority of all the members of the Village Board approving a resolution.
F.
A report of the resolution of the Village Board shall be filed with the Nassau County Planning Commission if referral was initially required.
